i have an query please suggest
my brother's wife file false 498a case against all the family member[ father,mother, my brother(married), me , sister, brother]
police has not arrested us but we are expecting soon (0ne or 2 day(s)even tonight.)
bhabi"s family came with police and they taken away all the list of gift and item they have given at the time of marriage. the day of FIR they seize stuff they had give to my brother who is married.
they have different real issue, the real issue is my brother had a love relationship before marriage so when bhabi come to know she feel something awkward and cheated.
we all slapped with 498a, 323, 506
police has not yet arrested from last 24 hours as of now but still...
matter is i never stayed in my home state i was studying in out of state(delhi). my home state is odisha where case has been filed.still how cab i be involve in such act. i do not understand why a 498a case. we know what she is feeling. she have another issue with my brother. they have communication problem and mistrust.she believe my brother has still such affair what he had once in his life before marriage. he did not marry his ex gf because he later found she is not girl but a women. the ex gf had a husband and she did not reveled it untill things are come out though outsource and found legal document of the lady mentioning the name of her husband. so he left her the have their mutual agreement to end the love relationship after 2/3 moth of stressful time. and my brother finally find a new girl and marry her (arranged one this time )
when the new lady come to know that he has an love affair before marriage she tell us that you people have cheated me and started ad things but we compromise it but finally she decided to teach us a lesson and lodge a 498a and other section. she should file a case of cheating if it is a cheating but dowry related complain is false. Applied for AB. our advocate is good giving us so high morale. we never been a in such police mess in our entire life this is first time so feeling not good at all.
i need advice and steps to follow.
please learned member suggest us ways to fight this menace.
he never married the ex gf but his ex gf is a women friend . later it was found through some of the enemy of the women but this time ex gf is not the problem. it the legally married wife who is feeling cheated and filed a false dowry case. can we be prosecuted for the previous love relationship??
my brother does not have any affair after marriage but she suspecting my brother.
marriage time 14 months old
they have a baby girl 3 months old
FIR day they taken away all the stuff they have given at the time of marriage which we never demanded but as tradition in our society we accepted that things.
can this seize of property is legal on the day of FIR,do we have any merit of this act of seizure.
please suggest dear experts

What will be the consequence if I do not respond to a court notice I received as a respondent? I have been made a party in the case where I have no role. Ex-party judgement is acceptable to me.
Can I send a reply by post?

Hi I am Sudharm Basapur from Dharwad, Karnataka. I am asking this query for my mother.
My query is, My mother's father had a land of 48 Acres and it was distributed among his sons only during 1995. But my Mother Smt. Laxmi Basapur did not receive any share of the property. My mother's brothers (my uncles) they took the signature from my mother's father (my grandfather) and they had took the authority of the property on their name. They did not even take permission from my mother or they did not take any signature for this. My mother's father is still alive.
Now I would like to file a case on them on behalf of my mother and my mother is also ready for it. But before that I wanted to confirm that will it be possible for my mother to get the property through the court and especially by enforcing the Hindu succession Act. Actually we are Jains (digamber).
Out of this 48 Acres, My mother 14 acres is from ancestral and remaining property was purchased by my mother's father.
These information may also help you to answer my query,
My mother was born in 1962,
She has stopped her studies during 6th std just because of her brother studies.
My mother's father is still alive.
I am not sure whether he has written any will or not.
my mother's one of brother is a Lawyer and he might have done all this long back. But even if there was a will and every thing made then are there still chances that my mother fits well in right to equality and equal share for women an all???
Now my concern is - My mother has sacrificed all her studies and property life etc just because of her brothers. Now my all uncles are well settled with government jobs, property and every thing. They are in a well status. Where as for us we did not get much from my father side as well and our status is low. If my mother would have studied and share equal property we would be in much better position. I feel so frustrated with this as my uncles son and daughters are in a great position like Engineers earning lakhs together a month. Because they have got such financial support from all these property. They got good education and every thing. For us it was nothing because we didn't had enough money to pay school fees, college fees etc.
So the final conclusion is that, there is no right to women? because they did not feel my mother is their family member and her family is in bad situation now. Just because she didnt get education as they got.
Hope you understand my concern. Please provide me the answers for my queries at the earliest. Waiting for your responses..

Sir,
I marry on 24.02.13. She live with me only 06 months in these also she stay maximum time her mothers house. and she filed 498a, dowry cases in another place where we cant marry, she cant live and both not start live in that place, Its completely not aware of that place. Now 11.04.15 she put maintenance case where we marry and where she lives.
Now i am asking you i am getting below 20000/- and i have see the my parents (both are old and taking medicines nearly 7000/-), maintenance of house. Can you all please explain me how to face these and how to calculate amount by court. I am not able to pay her its very burden to me.
My wife is educated she complete MCA.

Please give valuable suggestion .
In my brother DV case. Cross of his wife and her witness brother is over. (It’s in our favor).
Even my brother's cross has been almost 60 percent complete . During the next date of my cross ie: on 14th April 2015. Applicant lawyer has given application to Struck of Evidence which the judge has accepted.
We have filed our written arguments today. (Order would be probably next week ).
My lawyer is saying the evidence which we have submitted prior to 14th April 2015 won’t get struck off.
Is she correct…..?

Earlier I have not furnised my PAN so the deductor deducted 20% of tds but not though I have submitted my PAN instead of number of reminders The Are not revising tds return
Please Let me know the solution.

Can Central Govt Indusrtial Tribunal cum Labour Court(CGIT) has the jurisdiction to see the legality of such order if referred to it by the appropriate Govt under section 10(1) d of Industrial Dispute ACt 1947?
