Hello,
We planned to sell a property in Delhi and took a bayana of Rs 1 Lacs and signed on a receipt and did not sign any bayana agreement.
Now we have decided to not sell for sometime, what are our options? Can the owner or the property dealer take any legal step?

Dear Experts,
I would like to submit a civil dispute case before you for the advice from you to save the client (plaintiff).
1. The disputed property is ancestor property. It has two legal heirs as brother and sister. Male heir was passed and he has three sons. The three sons and his aunty (own sister of his father) had jointly borrowed the mortgage loan from co – operative society bank. Hence, the aunty was default to repay the share of his loan amount.
2. So, the three sons decided to close the mortgage loan from bank and sale the property. Now, the defendants (three sons) approached to my client (plaintiff) to purchase the entire property. My client gave the money for defendants to close the mortgage loan. As per deal, the three defendants and his aunty closed the mortgage loan from bank and executed the registered sale agreement deed for entire property by three defendants except his aunty to my client on 21.07.2005.
3. My client requested to execute the sale deed from defendants but they deliberately refused. In this, my client filed the Specific Performance Suit on court, mean time my client and defendant compromised and received balance consideration by the defendants. The court had passed the decree in favour of my client on 18-08-2009. Court had given two months time to defendants for executed sale deed in favour of my client.
4. However, the case had been pending, the aunty (sister of defendant father) 3 legal heirs sold the half of property on 9.7.2008 to female third party and deliberately hided the court decree and sale agreement for the property to third parties (third parties are husband and wife and relations to all the defendants). And another half of the property was sold on 03.09.2009 by three defendants same as above way to male third party intend to cheat my client.
5. E.P filed by us. Defendants made fake memo for compromise and used fake sign as my client signature and submitted it on court. But the court was not recorded that memo.
In this situation, the third parties now filed the petition under section 47 CPC. I humbly request you to clarify the following questions.
1. Is 47 CPC is maintainable in this circumstance or not?
2. defendant parties suit filing time had already expired, hence the 47 CPC can allow or not.
3. Is there any possibility to execute the sale deed as per court order to my client? If yes, kindly explain.
4. Requests - Citation regard this.

Can you please tell me the eforms to be filled by the company (Pvt Copany & Unlisted Company) on or after 01.04.2015 with ROC (MCA).
What are the eforms to be filled with ROC during the Financial Year 2015 - 2016 ?
Please guide me and help me out.

Hi,
My Grandfather purchased some land in 1971 but there was no formal paper work done.He divided the portion in three parts and gave 1 to his elder son and 1 to his second son. In the third portion he was living himself. Since at the time of dividing the youngest son was unmarried so he kept my youngest uncle with himself. There was no formal paper work dividing the land among the three sons. After the death of both my Grandparents, my youngest uncle sold the portion of land in which he was living to someone in village without consulting his brothers. My question is,
1) Since both the seller of land and the buyer of land (my grandfather) are dead, and no paper work was done at the time of sale, who is the owner of land?
2) Is it not mandatory on my uncle's part to ask his brothers first, if they are intersted in buying the land before selling it to third party?
3) What are the options with his brothers to get the land back as for us it is ancestral house and we do not want it to be sold to someone else?

I am a housewife aged 34 years married since 9 years 6 months with a 5 years old kid. I am holding a master degree. Now my husband wants divorce from me as he wants to marry some other girl. His monthly income is 72000 p.m. He has his parents who has got some 16 lack investment and flat in a posh locality. In that situation how much amount can I claim as maintenance for me and my kid?

sir, last year I bought a flat in a co-op. scty in vile parle at top floor in my wife's name with the stilt parking in resale, when we shifted then I noticed that they made flower bed in front my parking & also on turn to enter to my parking they allotted two parking on top of water tank illegally to other members by taking handsome amount, when I object that I am facing problem on turning & to take out my car from my parking the became deaf. my repeated attempt to talk to them & in writing but they are not bothering. instead of solving this issue they started to harass us. they put lot of hindrance in front of my car & when I remove them then they falsely alleged me that I damage the society property & fined Rs.5000/- for this. when I strongly object for this & ask them to provide me all the details but they refuse & said it is unanimously decision taken by the MC. since we are on top floor now they allowed some of co-members to put there ac's split unit in duct line area just above my flat & due to this we are having problems, we are facing scorching heat due to this when we ask them to remove or divert the same but they ignored. I don't know what to do ? should I file criminal complaint against them for this ? MC members are very arrogant not listening & do the things there own. our scty is facing serious cleanliness issues our premises is very dirty, the gutters are over flown all the time but they keep mum on all this issue. My serious concern is for health, I wanted to know is this allowed or permissible to park the cars or other vehicle on top to water tanks ? water tank on ground level & all the rainy water is mix with that so it is allowed to keep water tank on ground level ? pls suggest what I do ? we are new in this scty & we don't have much communication to other members.

Dear Sir/madam,
I approached local lawyer at tumkur related to our grandmother inasmuch land he need proper document for further steps for that he need Grant copy please tell me how can I take that immediately because for that that local lawyer applied through RTI in March 30th 2015 itself but still we not get that, Please Any one here who have tumkur surrounding contacts who can do this as early as possible please give their contacts.
And for put a case for asking share in inasmuch land on our grandmother how much expenses it will take because that local lawyer asking 10000/- please let me know.

As per news cheque bouncing ordinance passed. President okayed it. can we now file case at a place where cheque was presented say tomorrow. Or how much time will take to actually enable the litigants to avail of the benefit of the Ordinance?

Disowning parents
Hello,
I would like to know how can I disown my parents. I'm 31 yrs old, housewife, happily married and I live abroad. My parents in India keep sending me threatening messages, abusive name calling, messages to my husband so that my marriage will get wrecked and warnings to tarnish us just to send them money. I have blocked their numbers but they still try calling and mentally harrasing me as the details go in spam folder. My mother wants all the gold that she gifted me during the marriage and also claims the money she spent on my educational courses before marriage. It has been disturbing my husband and me. I'm blessed with amazing in laws and they are really supportive. Also, that my parents are above 60yrs and financially very well to do as they do not even encourage my younger brother who is 25yrs old to work. But constantly I'm pressurized to work and give them money.
So now that my husband n I decided to give the money asked for and the gold but what if she threatens us again after receiving this. Also, she threatens stating that she will tarnish our names on social networking sites and write letters to my husband's company stating that he is a fraud. I've been dealing with this since 6months and we are mentally stressed. Please guide as now I would like to take this matter legally and disown them as I don't want anything from them and we have been very patient considering them as parents. I can't take it anymore.
