How can we complaint against kinder garden school, which is opened in residential area in our neighbours. It creates huge traffic jam in school hours. Under which section/ act , we can take action against school. Where to complaint. Area comes under Patiala municipal corporation, Punjab.

illegal transfer of property from joint holder to family nam

Greeting to experts forum...myself kamal mitra residence of vaishali sec7 ghaziabad. At present am staying in Abuja, Nigeria for 3-4 years. Am married in Nigeria and staying with family....
I have a case of illegal transfer of property which is jointly hold by me and with my brother. Now my sisters are saying that elder brother has changed the WILL and put his wife's name on it..he used my old power of attorney which he asked me for changing the bank loan details..it was 2-3 years back..I left India since 2010 and never came back india due to some reason or other. Now am fearing that he will sell the property without my knowledge the way he changed my name in the property after I refuse to sign the general power of attorney or the document he sent me few months ago. I still have the details. It will be really great full if anybody can guide me what to do and how to do!! If I recover my old copy of the power of attorney from the Indian embassy here and also make a new power of attorney to prove the difference between them...how can it help me and how fast...is their any way that I can register F. I. R from here through any NRI cell/ helpline..

Quashing fir on jurisdiction

Hi Experts,

My brother's wife has registered FIR under section 498A, 34 on all of us including my parents.

In FIR all the incidents are mentioned in one state (Maha.) but to run the case in their state i.e. in A.P. they have registered one incident where me and my family went to their place and assaulted my brother's wife which is false, we were not in that area when the incident has shown.

So my question is can i challenge this FIR in high court for quashing on jurisdiction basis as all the incidents mentioned in FIR is from another state and just to run the case in her home town she has mentioned the said incident?

I have few citation/judgements where FIR was quashed on jurisdiction basis but want to know how to quash when one of the incident they have mentioned is from their city?

Please suggest.

Capital gains related query

Hello,

I've the query related to capital gains for the following situation:

Transaction 1:
I had purchased a flat in 2006 for 20 Lakhs and sold it in Nov 2011 for 57 Lakhs. The long term capital gain of 20.4 Lakhs (post indexed cost consideration) was re-invested in the Dec 2011 year in an under-construction property (Cost 80 Lakhs) that was supposed to be constructed with-in 3 years (by Dec 2014).

Transaction 2:
However, the construction got delayed by an year and now I'm selling this under-construction property for a sale consideration of 1.2 Cr given my changed family needs. I'll re-invest the capital gain ( 3 years) and re-investing the entire sale proceeds into a different investment, can i claim LTCG on this? As per all the articles that I have read on the internet, an under-construction property with requisite flat details and with an allotment letter issued more than 3 years back, it should be considered for tax exemption under LTCG.

Kindly confirm if there is any tax liability on me given the situation above.

i had a girl friend from 10years and we loved eachother truly we had physical reltionship too we lived like a husband n wife fromthe day 1 we are suppose to marry . unfortunately 2 years back 1 girl entered into my life as a friend even she loved me it came to the notice of my girl friend she used to doubt on me and started iritating me every second . ther was only a friendship .but day by day she became closer to me and she loved me a lot . can cant give my girl friend so i avoided her a lot .again my girl frn started the samething by that i started what she told n made that true .even i had a physical relationship with her .i convinced her and told her to get marry a other guy even she agreed and married on march 2015.she dint even lived for 10 days wid him she came back to me even I dint think what will happen .she was wid me for 5 days .then their parents given police complaint then we caught n they tuk her to home , she s not accepting him as his husband even he is not ready to accept her now .their parents are not ready to give divorce also. she s telling again she will cum bak to me .what ever might be the situation I wont be wid anyone this s her final decision .she wont marry another person also . elz she will die.coming to my girl friend she tried committing suicide 3 times .even their parents are not ready to accept our marriage . whom should I choose ? now My heart s not listening anything m feeling guilty on myself . both are not ready to leave me .should convince them but they are not ready.

Framing of issues

In my case the judge framed random issues and skipped necessary Issues that proves my case. I made an application to re-frame and frame additional issues but the judge without reason neglected the necessary issues to prove my case. If I go to trial with the present issues I will badly loose the case and later any Appeal will also be useless. At this stage is there a remedy to go into Appeal, Revision or Writ Petition against incomplete issues? I found in Sudipto Sarkar Civil Court Practice Revision lies (28 CWN 991; AIR 1947 Pat 45 but could not find these citations in Indian Kannon. Please Help Thank You.

Fathers name change in birth certificate

I want to change my fathers name in my birth certificate, My father left me when I was 6 months old, in my documents like 10th, 12th, degree and other documentary evidence the name of my father is Christy, without any surname. I recently applied Birth Certificate and in my birth certificate my Fathers name is Christy Joseph. When I applied for Passport it got rejected would you please suggest me how to change my fathers name as Christy. I don't have any documentary evidence of my father. Can you please help me asap.
