Respected Sir, property was original purchase by father of A:B:C:D from Z(saler) in year 1934 but till now property was not complete mutation due to some internal problem and present L.R record was still in name of Z(saler)....A:B:C:D an there father has died & Z(saler) also died.....present legal heirs is 13(person) all son/daughter of A:B:C:D....out of 13 person 11 person are handover property to promoter and promoter will complete all paper work including mutation etc....but remaining 2 legal heir denied for construction building due to property was still unpartition situation but promoter threated this 2 legal heir person and said they will construct building by taking up 11 person share and remaning 2 person share will left vacant.
Sir my question is that can this 2 legal heir person can stop promoter for construction building by filing an injunction against property and also can this 2 person ever get injunction from court because property recent record was still in a name of saler and property registration title deed was in name of present legal heir grandfather.
Mention property belong to muslim & presently whole property was utilizing some tenent.....Sir please help and reply as soon as possible...thanks you.

My grand mother gifted 5 flats in Vijayawada to my dad on June 2012 by registered gift deeds. He mortgaged those 5 flats to bank by way of deposit of title deeds in July 2012. His loan is declared NPA on July 2014 and sub sequently they bank invoked SARFAESI act. Unfortunately my dad died on 28-02-2015. The flats were not sold out by bank till now. They asking mine and my brother's signatures. What should we do. We don't know about the mortgage. And it is not registered . They harassing by calling and frequent visits to our home. is the unregistered mortgage is valid ?. Any ways are available to save our flats from bankers. At certain point we even told the bankers that go for auction but they still coming to my home asking to pay loan. I urged with them that " as my home not mortgaged you have no right to come to my home, go and sell those 5 flats and recover ur money". We already in depression with my dad death please suggest us the best ways to get rid of bankers.

Sir,
My brother was asked to pay interim maintenance at the rate of 30,000 per month to hsi estarnged wife. The interim order was paased in November 2013 but his wife has filed the excution application u/s 128 crpc only in August 2015
On the Application u/s 128 crpc, the magaigstrate issued directions
"He is directed to clear the arrears of interim maintenance on the next date of hearing." which is 15 september 2015
125 (3) crpc defines that arreas of the mainatenance cannot be enforced for more than period of 1 year
My query is
1 Whether he needs to clear the arreas of interim maintenance only for period of 1 year ?
2 Order is silent up to how many months he has to clear the arreas of mainteance, it means that magistrate can execute the order without clarifying the order?
3 In default of payment for more than period of 1 year whether he can send my brother to jail (without exhausting the remedy of penalty of leying fine as per define under 421 crpc)??
4 If he asked to pay the remaining mainteance whether in that case revsions is maintainable??
please guide us
