A and B being two brothers are the owners having equal share of a commercial premises from where they are carrying their business. A died in 1980 leaving a Will wherein he bequeaths all that he owns to his wife "W". B continues to carry on business from the said shop. B in or about 1990 applies for mutation of the share of A in the said shop to his name on the basis of a registered relinquishment deed executed by A in favour of B prior to his death and notice of which application is given by the Municipal Authority to W as the legal heir of A, asking her no objection. W neither gives her no objection nor writes back to the municipal authority. W dies in 1994. Her only child, a son S receives notice in 1995 of another application by B for mutation of the share of A in the aforesaid premises to his name on the basis of the relinquishment deed aforesaid. S institutes a suit in 1995 for declaration that the relinquishment deed on the basis whereof B is claiming mutation is forged and fabricated. B sets up a plea of the claim in suit being barred by time. Is this suit time barred keeping in mind the fact that earlier his mother also received notice in 1990 as stated above ?

A is in adverse possession of property since 1990. A in the year 2004 for consideration assigns his rights in the property to B and puts B into possession of the property. C, the registered owner of the property in the year 2008 institutes a suit for possession of the property against B. B sets up a plea of suit being barred by time for the reason of A having been in adverse possession to C, of the property since 1990. C contends that B having come into possession of the property in 2004 only and suit for possession having been instituted within 12 years thereof, is within time. Whether the present suit of C is time barred ?

During 'Suspension of Work" declared by the employer and applied for Sick Industry to BIFR and subsequently BIFR declared Sick Industry and the company reopened without giving any information to some employees. What types of claim can lodge by the employees? I want to know whether they claim for salary, gratuity, pf and other benefits from the company during the Suspension period? Please mention Case Laws reference in this regard.

Hi,
My father has a flat on pagri rent in Delhi. We live in this house and pay the rent.
The landlord expired and now there is a property dispute amongst his heirs. We now deposit the rent in the court.
My question is, if I buy a new house in my name and we all move in to that house while my father continue paying the rent for the flat on pagri,Can we continue to maintain possession of the flat?
Also, what would be the tenancy rights of my father's heirs?

I already applied cruelty against my husband.. last sunday i went out with him as a last try to live with him.. but it seems like he s stilla abusive person.. he came just to create evidence against me. While texting he said not wearing thali is a crime and also joining higher studies without husband knowledge s also a crime... is tat seriously a crime? One day i forget to wear thali after shower. And i hide thali inside while wearing fashionable outfits.. he said he has photo proof.
Kindly help me plzz.
Under what circumstances he can break my case ?

Sir,
My father inhereted about three acres of land from his father about 4 decades ago.
He has five daughters (including myself) and one son.(All are surviving).
Over a period of time, he sold many sites made out of the same land.
He gave in GIFT a site of 30' X 40' dimension to each of his daughters, including myself, and registered the same as GIFT DEED in individuals name.
Where as he gifted about 15 times of the said dimention to his son ( That is my brother ).
About one acre of land is transfered to my mother's name under GPA where in an Apartment is constructed and her share of six flats are in the name of my mother.
Now he is holding about ONE Acre, in various dimentions of sites, all in his name.
Now , when we 5 sisters are asking for equal share he says that HE IS GOING TO MAKE A WILL.
Sir, I want to know :
1)Whether the land transfered to my mother's name under GPA is legally valid ?
and
2) Whether my father can MAKE A WILL in favour of his five daughters and one son ?

My verification file comes under My local police station they call me and ask five hundered to comptete verification but i cont gffive it after they said you drink ahochle so tomarrow come here they inselt m how con i compliant nor vigilance compliant

MCD booked property sale purchase
I have purchased builder floor in Rohini sector 11 Delhi in 2012. Seller sold me property without sharing its MCD booking status, it was already listed in MCD records for unauthorized construction. Now I have further sold property n 2015. But new buyer got his registry documents stamped for MCD booking remarks. As I am cheated by my seller but person which buy property from me is chasing me to get it clear and threatening me for fraud 420 etc. I have not earlier served any notice in this regard. Now what is my legal complication. Please advise...
