Refusing to give noc

Dear Sir,

I have a flat at Nerul which I intend to sale to my existing tenant. He is living there from last 3 years. Not he needs a NOC from the society however the society is refusing to give and forcing us not to sale the flat to him. The reason they mentioned that his wife had a fight with the neighbors but when that incident took place no one informed me. Now that we are selling this flat every committee member has started calling us and complaining. Further they say that they have another interested buyer who can give you 2 lakhs more etc.

Now what do I do? This tenant has applied for a home loan from the bank . The bank won't disburse the money without the NOC , right?

Is there any remedy?

Cheating ,forgery and misuse of company cocuments

i am working in a pvt organisation as admin officer. One of my sales staff forwarded our company quotations and negotiation details to our competitor company . He also forged salary slips and that also sent to another company for getting a job there. what legal action can we take against him

sir, I'm a Christian, I have sent a legal notice through my lawyer seeking divorce from my husband and now my lawyer withdraws to proceed the case due to his personal problems. shall I send a notice again through another lawyer?

arbiteration act

Transection was entered at Mumbai and there in arbitration clause about place of arbitration at Delhi accordingly ex parts award passed. Want to challenge. pls expert Suggest expert opinion. Thanks.

About transfer policy of employee

My mother has completed 59 year. Still one more year of service is there remaining to retirement.
Now she received a transfer order for another department.
My question is there any act or rules to stop transfer of her..by consider her age

'fa' and 'ea' filing with consumer court against builder

Dear Sir,

I am from Mumbai.
My Aug 2010 complaint filing with State Commission against builder was disposed off on Nov 2015, with the order for builder to give flat possession and including compensation for possession delay and mental agony. As per the order, I also paid balance of consideration to builder and cleared my dues immediately.

Subsequently, I filed FA with NCDRC in Jan 2015 for review of compensations and unaddressed claims including correction of the interest amount stated in the order. Whereas, builder filed FA to dismiss/stay the state order on pretext of ex-parte order.

These FA are pending for final hearing at the admission stage. I am confident builder's FA has no merit and would be dismissed eventually.

Okay. With reference to the above my queries are:

1) Can I file Execution Application (EA) under section 27 with State commission for the flat possession only (while pendencies of both the appeals at NCDRC)?

2) Further, can I file (EA) under section 25 with NCDRC/State Comm, for the recovery once there will be final judgment for the pending FA?

My family has lost the patience to wait any longer for flat possession after 9 long years from its booking time. The building is ready now and other flat members are occupying their units.

3) So, if I forcefully possess my flat by breaking the lock and start occupying, will there be any serious impact on the current and future legal proceedings and the benefits awarded?..

Your expert advice will help me to take wise decision accordingly.

Customary law applicability on Schedule Tribes

My friend belongs to ST and HMA is not applicable on him. His wife is living separately from her for last one year. There is custom of second marriage and marital separation based on elders' decision. The same custom was exploited by his father-in-law who did second marriage without any divorce from his first wife.Now the question is that if the decision of separation is taken as per customary law, is there need to do anything else to end all marital obligations (legally). Please advice how to approach this issue to avoid any future legal complications.

NI ACT 138

I was issued blank cheque before 5 years.
Now they are fill with huge amount and file case NI Act 138 for non payment due to account closed.
