The Supreme Court of India in December 2015 has decided that the time limit of 45 days for the O.P. to file his version under sec.13(2(a) of the Consumer Protection Act is mandatory upholding a previous judgement passed in 2002, will this judgement be applicable retrospectively or prospectively. I mean will this apply to all those cases after 2002 or that this will apply to cases after december 2015 when the decision was delivered.

I am 34 yr woman who has suffered ventricular tachycardia which resulted in cardiac arrest in Feb 15. I was implanted with an AICD device thereafter. I now suffer from severe PAH and TR and the doctor has certified that I am 25-50% disabled. I have a 3.5 yr old daughter. Me and my husband stay together in a 2 bhk owned by both of us. In May I had been to my parents place but because my husband refused to come my parents had come to drop me and my daughter.after coming here my condition got worse and I had to be admitted twice once in ER and once 2 days hospitalization. My mother is staying with me in my house to take care of me. My husband and my in laws have several times objected to it that my mother cannot stay here. My husband and in laws insults me and my parents at any given chance. My mother in law calls her friends at home to tell my mother and me how we should behave. My husband and in laws have called my relatives to come and see how we are staying in her house(the house which is in name of me and my husband). She all the times talks loudly on phone and says we today met a crime branch officer we will we what can they do. Ulta wahi log jaayange jail mein. My husband does not talk to me , he listens to his mother. My in laws try every trick to hold my daughter and not allow her to come to me. My husband does not give me any money other than medical expenses. My and my daughters gold is in my husbands locker to which I have no access. My husband molests me whenever he can . His repeated molestation has caused my health to deteriorate till this stage. Please advice me what immediate action I can take as I fear for my life. I want to take my daughter and move to my parents place which is in another city if I go there can I file a case from there. If they do not allow my daughter to go with me what can I do. Please help me.

I am CA Final Student. I have completed articleship and also have received article completion certificate from ICAI after submission of form 108. Now my Principal telling me to come back for two month, for which i m refusing, otherwise i will file complaint against you that you have taken on-paper completion only and practically two months are still pending which should be regarded as extended period. I want to know whether he will succeed ? or Am I safe by virtue of receipt of article completion certificate ? Pls help.

Following the judgement rendered in
Civil Appeal No. 7217 of 2013 Supreme Court Judgement in Prakash & Ors v. Phulavati & Ors of 16 October 2015
facts of a case as below continue to be in question
a. An man bought a house ( living on first floor and rented ground floor- rented portion covered under rent control act) in 1944.
b. In 1944, he had 1 unmarried son and 1 unmarried daughter + 1 married daughter who never lived in the house.
c. He died intestate in 1964. His married daughter died intestate in 1997.
d. The son of the married daughter now wants a partition of the property claiming that
- his mother was a legal heir
- above SC judgement is not applicable to him but only to his sister
- since there is rented portion the house, Sec 23 of HSA, 1956 cannot become applicable (section was deleted in 2005 amendment)
Is he right in his assertions ? Will he be eligible to 1/3rd of the property ( that is his mother's entire right in case she was elgible in the first place since she was already married before the property was acquired by her father and moreover she died in 1997)
My uncle has received "Notice of Motion " from High court for the delayed revision filled by the party against him u/s 498-A in the high court.
Kindly tell at what stage notice of motion are sent that is before the admission of case or after the admission of case. Thanks
Sir we are planning for redevelopment of our society it is cessed bldg and falls under catagory A. My quary is that can we sign mahada's irrevocable conset without execution of development agreement . Can we put a condition in irrevocable concent that this consent is subject to execution of development agreement .
