Compensation in case of death

Hello Sir, I hv a question in my mind that a one year back my wife expired in a road accident by a minor boy (16 yrs) riding motor cycle, he had no licence, my wife (36 yrs) was working with annual ITR Rs. 3.5 lacs, i hv 2 sons ( 10 and 7 yrs), police filed fir and case in on going state vs accused, the bike was not in his name, it was in his relative's name, some one told that u can file MACT case against insurance company,bike owner and also with accused. Plz guide me that can i file claim case against them, my query is as below:
1. Is the insurance company is liable to pay becoz minor was riding.
2. is the bike owner is liable if he refuse that he has not made accident.
I hv many confusions regarding this and seeking a better guidance from ur side, will be very thankful to you for solving my query.

Dissolution of marriage

I am muslim married for 20 years and living abroad with 2 kids and wife and returned back with family in 2010. Due to misunderstanding she left the kids and went to her parents home and is working since then and not sent a single penny for their welfare. It is six years now since she left. There was no one to look after my kids who were 10 and 12 years old in 2010. In spite of repeated calls by the kids she was not willing to come back and they even told her that I will remarry if she does not return. So had to marry another muslim girls to look after us and life is going on for us. Also I am jobless for the last 5 years and my mother, brother and sister are helping us to pay for our house rent, food and kids education.
Now she has filed for dissolution of marriage citing cruelty and not paying any maintenance. Asking for dissolution on ground of cruelty and desertion and any other order the court may deem fit.

I dont want to pay any maintenance as I am jobless and kids burden but willing to sign the dissolution without any maintenance. If not can i tell the court she must come back to her matrimonial home and take care of kids education even though I have second wife living with me. What will be the courts point of view. Is she liable to pay for the children's education as she is working? she had earlier filed for custody but is still pending as she stopped coming and the kids had clearly said they want to stay with the father.

Regarding car parking

Respected Sirs

Iam parking my car in front of my house i,e, on road side. The road always belongs to government. But iam not parking my car in front of others houses.
Others are parking car in front of my house and causing difficult to park my car. I do not have car parking facility inside my house.

Kindly guide me

Tenant try to capture the property

i have rented a shop on ground floor and two room set on first floor 11000 p/m on an eleven month notarized rent agreement,first month he paid only security 11000 and promise to pay the rent within 10 days but he didn't, next month he paid 15000 the rent for last month and partial of this month again next month he paid 14000 by cheque to my son's a/c,but from the last 2 months he is not paying the rent .so I put a case in dist. court for rent recovery and eviction. there we know that he produce an advance receipt (revenue stamp on a plain paper) calming that he had purchased the shop and my son had taken the advance (cash 6.5 lakh). a police complaint have been given to sho, acp and dcp office for creating false document and forged signature but copy of fir has not been received yet.
in the first day the Hon Judge said that the court will not consider the receipt and given two months date .the lawyer told us that on next court day he will request the court to vacate the two room set on first floor bacause till now he hasn,t pay the rent

Mc election and action by old committee for sgm

I bought flat in redeveloped building in 2013, which got OC, and i got possession in May 2014. building has conveyance. now in July 2016 builder is getting us added as member in the same old society and not forming new society.Old society as it is will continue and thier MC members.

MC term was expired in Jan 2016 and they applied with registrar for election as per new bylaws now on 18th July 2016. in the mean time they are planning to call for Special General Body meeting to conculde the resolution of new flat purchasers to be added as member and to structure the monthly mantenance charges, forming of society rules.

1. whether the above transaction is valid as the committee term was expired and new committee is yet to be formed?

2. can still the chairman call for SGM? current year AGM is still to happen and Financials also pending.

Kindly suggest.

Pension scheme

Sir,
As per DPE gidelines All CPSU shall introduced Pension Scheme.NPCIL (Nuclear Power Corporation Of India Ltd )is one of the CPSU.
As DPE guidelines 30% of Employee salary shall contributed for Medical, PF,Gratuity AND Pension Scheme.
So far Medical,PF and Gratuity is existing (total 18%) at NPCIL.
Now NPCIL introduced 2% of Employee salary contributed by Management and 6.87% should be compulsory contribution for Post retirement Pension scheme and it will come in force if 40% of employees(minority of employees) are opted. But opted Employees are less than 40%.And also circulated that
either PF and Gratuity or Gratuity and Pension Shall OPTand NPCIL is not following DPE guidelines since corporation is following CDA pattern pay scale not IDA.

2.Now as per DPE guidelines 30% should be given.So any individual registered association can approach the Courts of Law directly or Any NEW proposal can submit the Management for consideration / Negotiation.
3.What is time limit for Prejudicial Notice.

Sale deed vs town survey records like plr or fmb

Hello Sir,

The property originally belongs to 1951 that time the extent was 9cents but after various sale with valid patta the extent of land increased. The town survey record like FMB or Permanent Land records shows the present extent of land and ownership. Now dispute arose on extent of land after 65 years through PIL as encroachment on road side. The court asked thasildar to verify the sale deed. But the same thasildar has given the patta for the present extent.

Which one is authenticated document sale deed or FMB/Town Survey record

Rent Receipt Name Change

Dear Sir
I am Prashant staying in tenanted one Room Kitchen at Grant Road.
"Our Room is still in the name of my Uncle". Uncle died in 1967 & his wife died in 1975 . Uncle is having two daughters .Both the daughters married in 1965 & went to their Husbands house.
My Father & Mother was staying with my Uncle since 1960 in the same Room. Uncle & my father are Brothers.
My father died in 1998 .
In 1998 , I had gone to landlord & request him to transfer the Rent Receipt in my mother's name but he refused.
1) Can I file a case against landlord ,for the transfer of Rent Receipt to my mother's name ?.
2) Now after 50 years two daughters of the uncle are saying that this is our room.
3) Can I completely Wash off (Remove) the Rights of my Uncle's Daughters ? , Since both of them are not staying here from last 50 Years.
Please Guide me.

Procedure

I have got contested divorce from my husband 2014 and legal custody of the child (Son) is with me.
My grand father-in-laws purchased a lease-hold property (House) in 1960’s at New Delhi. Since my grand father in law died in 1980’s without leaving any will. Therefore, in 1997 My father-in- law & his brother applied for free hold and & got that property registered in their joint names. Later on in the year 2000 they divided the property equally and executed partition deed which was also registered.

Query:- Now. I have come to know that my father in law has sold that property to one of his son.( i.e. my brother in –law ).
2. Can I file any legal suit to claim for myself and for minor son’s rights on said property.
