once the interim maintenance was decided by the metropolitan magistrate in pwdv act is the further maintenance order was passed in sec 24 by the family court also.
i was paid already 162000 as interim maintenance to my wife from 2013 till now but now family court also pass an interim maintenance in sec24 is this maintainable or not because i am not able to pay more to my wife and her child because i already pay 4000 for my wife & 2000 for my child, now family court judge pass an further order 6000 for her ,AND 2000 for her child , i am not able to pay more because family
pls send me the judgement also .
as soon as possible sir pls help me.

Sir, My father issued three cheques one cheque to my wife one to my brother and one to transfer a sum of money to his own account of another bank on 08/05/15. my wife deposited the cheque in bank on 13/05/15 my father died on 16/05/15, but the Bank did transfer the sum of amount to my wife's account after 28 days gape i.e after expiry of my father but the cheque was deposited during my father life time,(my wife & father a/c are in the same bank) Now the nominee (my younger brother) has field a Consumer case on bank and making us also a party for not informing about the transfer of money with a prayer to refund the cheque amount with interest. Now would you please inform about the maintainable of the case (2) What is legal position of a cheque deposited during lifetime of the drawer but for some reason the bank failed to credit the amount during lifetime of the drawer (3) what if one issued cheque against legal liabilities and he die and bank refuse to pay the cheque amount, what relief is available to holder of the cheque.

Hi,
Our family owns a land of 6.5 acres at our home town. There are 3 siblings among whom this land is to be distributed by their Father(who is no more).
However, the eldest son has sale-deed 2 acres of land from the father 18 years before. So, we have a total of 4.5 acres of land left.The eldest son who has already sale-deed 2acres of land have equal shares in remaining 4.5 acres of land as per Muslim law.He is ready to give half of his share( in remaining 4.5 acre) to one brother but not to give another brother.
My query is it possible to transfer his Half of the share on only one brother name?

if family court reject divorce petition than is it forceful to husband to live with wife.

Sir,
We, my mother,myself,my brother& my married sister are going to effect partition of our family properties. My mother is staying with my brother and wanted to give her share to my brother & we all agreed. But despite advice by other senior relatives to allow my brother to take it after my mother"s time, my mother insists to give all her share without any condition now itself.
Now the question is
1. If my brother fails due to any reason to look after my mother after taking her share of property, will myself & sister are liable for paying her maintenance.
2. Who will provide maintenance after my brother's time? His family?
We are going to prepare a family settlement document. Kindly advise how to incorporate this issue & what type of clause has to be mentioned.

Dear All,
At the time of marriage registration, there is a common statement for Bride/Groom/Parents that "I am declaring that I am not giving/taking dowry for this marriage" and both parties are required to sign.
If got registration and nevertheless the wife registered 498a case then can marriage certificate can be shield evidence preventing from the false case??

One person followed my wife 2-3 time and tried for friendship forcefully. We filled complaint to Police and Police arrested him under 354 D case. Now police filled charge sheet and courts first date is 27 September.
My question is- 1) now i am shifted to new city permanently. Is it necessary to attend court date? 2) Due to written apologies of that person, requests of his family members etc we decided to compromise and withdraw case. It is necessary to withdraw case ? Or my wifes absence in court will automatically beneficial to him? 3) My wife is pregnant and due to some complications my wife is unable to attend court. If my wife absent in court, then is there any possibility that court may issue warrant against my wife? We don't have any issue if court release that person if we do not defend.

sir i am petitioner in section 9 i filed a case against my wife in july 2013 ,after she left me in june 2013 after that she filed 1st complaint in women commission , i joined there also but she was not come in the court instead her father and lawyer.after theat she filed another complaint in caw cell ialso joined there ,after that she file complaint in pwdv act karkardooma court in this court ms principle judge mm court decided interim maintenance 4000 for her and 2000 for her child also i accepted in between her lawyer also file section 24 application in the family court in my case of section 9's reply with that .
so now family court judge also pass an further interim maintenance order as rs 6000 for her her and 2000 for her child
so now my question is when i filed section 9 case against my wife there is not single evidences filed by me and my wife also ,in april 2015 i withdraw my section 9 case in family court because she was not interested to join me then i file divorce case sir my further question is if mm court already passed an interim maintenance order to kya family court bhi section 24 me order pass kar sakta hai ki nahi jabki me already section 9 withdraw kar chuka hu kyunki section 24 bhi to meri wife ne mere sec 9 ke case k sath hi to lagai thi to kya section 24 ki application bhi pending rahegi jabki mene section 9 pehle hi withdraw kar lia argument se pehle hi.
sir meri pareshani ye hai ki me 6000 k hisab se ab tak 168000 pay kar chuka hu meri wife ko ab meri wife ne 8000 ke hisab se execution file ki hai family court me ab waha judge madam ka kehna h ki ya to 6000 k hisab se jo apne pehle pay kia wo to de dia ki nahi mujhe nahi pata me us order ko nahi manti jaha jana h jao kahi se bhi lao jan 2015 rs 8000 ke hisab sare payment clear karo 10 october tak pay karo nahi jail jao.sir pl help me what can i do now pls help me
as soon as possible sir with sufficient judgement for my help.
