Our writ petition in karnataka high court - change of lawyer

We live in Bangalore. Our layout's approach road was blocked by adjacent landlords. Approx. 1000 residents living in our lay out are in agony. Bangalore Development Plan shows the road. Documents clearly shows an encroachment. We have been approaching BBMP authorities to help us out. No response. To address this issue, we have filed a writ petition in Feb-16. Respondents keep taking time to file objections. The landlord's objections appear to be baseless while they are saying grammar errors, unrelated things, etc. without producing evidence whether or not they encroached the road. We have strong documentary evidence.

Problem that we realise now is: (Sorry to say) our lawyer is incompetent to deal our case. Uptill now, did not clear any objections except filed WP. She is coming to us asking how to clear the objections. Even writ petition content was prepared by us while she brought legal section numbers into it. In hearings, she keeps quiet and tells us she will clear in writing. But even that does not happen. Any how, we are in problem and need to come out of it.

Your suggestion is required for:
- What is the procedure to nominate another lawyer after we choose a competent one?
- Whether current lawyer has to formally hand-over in court or if we (Petitioners) give an affidavit, is adequate?

Please ADVISE. Urgent.

Execution

In an ecxecution of DV Act maintenance , the trial court is acting very lienient towards, JD. Approx more then 3 lacs of arrers pending and he is not even giving monthly maintenance. Trial court issued warrents many times but no arrest is being done. Can DH go to sessions /high courts against the delay in proceedings of trial court???

Appeal in High court

Hello experts ,
I m an Advocate...
I have filed an appeal on behalf of complainant against the aquittal order of accused u/s 138 of NI Act. Now the appeal is admitted and came in due course in July 2016 . The complainant/appellant is in the age of 75yrs. Shall I file an early hearing on the ground of appellant's age as schedule time will take many years. If so, how many months should I atleast wait to file early hearing??? Need experts advice on the same.

need leave during probation

Hello .,
I got junior assistant job ( government) in nellore muncipality as a compassionate appointment.
Joining date 20.7.2016
I'm under probation but I need leave for completing my internship in homeopathy.
Can I take EOL for 14 months I have no problem if my probation is extended
Please give rule positions if any present
Or else I will lose my job pls help.

Refund of motor vehicles tax

Hello everyone,
section 7(3) of the Karnataka motor Vehicles taxation Act states that "the Registered owner of the vehicles who has paid such tax is entitled to refund'. The RTO contends that it is only the first registered owner of the vehicles who is eligible to refund of road tax even though ownership of the vehicle is transferred to the third person.
By virtue of transfer of ownership of the vehicle, the rights and liabilities of the vehicle stand transferred to the present registered owner of the vehicle. kindly advise on what should be done to get a refund from the RTO.

Civil & criminal

Dear Sir,

Civil and Criminial case filed both are same issue. One judgment will affect another or?

Police investigating for IPC 419 468 471. If civil suit not favor to us. criminal case will be dissolved due to civil judgment we are complainant.
