Service matter

The workman is ordered to be reinstated into the service of the respondent w.e.f. the date of demand notice with continuity of service and 50% of back wages. This is award of Hon'able Labour court
My question is that workman eligible for back annual increment, Earned Leave, and other benefits. If yes and employer not giving these benefits, then we can do.

Reply of notice for non-filing of wb vat ret

One of My Client is a work Contractor. He has West Bengal Vat No., He got a notice from Sales Tax Office for Non-filing of Vat Return for the period 01.04.2014 to 31.03.2015. In this connection i want to say that the assessee has no any works contract and his transaction is nil til now. He has not submitted any Vat Return during this period. I Know that he has to submit Nil vat Return. He has disput with his lawyer so he also not know User ID & Password of Vat Return. Now please say anybody how he will get condonotion for non filing of Vat Return and how will penalty will excuse ?

Please let me know the procedure to withdraw cilvil case from supreme court.
Now case is settled out of court.
Please let me know how many days it will take to withdrawl and what is cost involved in this.

Property distribution in case of PLA

My father took a piece of commercial land in sector v salt lake electronics complex kolkata on 1992 in the name of his firm m/s Chemicals & Lacquer of which he was the proprietor. Later in the year 2002 he changed the name of the firm to m/s Indra Electronics and invited his elder son to enter into a partnership with a 50% share in the profits.Mode of business has been rental income since then till date. My father made a registered will through the sub registrar in the registry office in delhi maherauli distributing the Indra Electronics share in the ratio of 50% to my elder brother, 25% to his younger son I.e. me and 25% to my twin sister. My brother had bad relations with father to the extend that my father lodged an FIR with the sector v salt lake kolkata police in the year 2012 on the grounds of misbehaviour and mental and physical harrasment to grab the entire share in Indra Electronics.My father also revoked the POA which he gave to his elder son. My father also filed a suit against his elder son in sealdah court in the year DEC 2013 however unfortunately he died of cancer at his residence in delhi on 21 DEC 2014. Now the problem is that the will is getting probated in the Calcutta high court. All the formalities including the citation has already being done since April 2015. However my brother is killing time by giving lame excuses in front of the judge that he was not well and his lawyer fell off from the staircase so could not file the ccaviar and affidavit in support of the caviar on time. In the affidavit he has claimed that fast her has not given him anything from the estate and the will is not genuine. Since it is India and there is so much of corruption everywhere I would like to know that what will be the distribution of the Indra Electronics share if the will fails considering the fact that we are four members my elder brother, me my sister and mother.

Claim of maintainence under 125 crpc

For claiming maintenance for wife and two children aged 6 years and 3 years under 125 CrPC, is it not necessary to make the children as party in addition to wife? Or Simply wife can claim maintenance for her children from husband without making the children as petitioner. Brief fact of the case: "Husband filed a divorce suit on grounds of cruelty and adultery. Maintenance granted under HM24 for wife and two minors. On attaining the age of schooling of child husband demanded custody under provisions of GWA and HM26. Wife adopted delaying tactics to prevent decision of these applications. Wife filed petition for maintenance u /s 125 CrPC for herself and minors without declaring minors as petitioner. Is it as per law? " Can husband object the grant of maintenance for children to the wife raising this point?

Is co option allowed as per the new bylaws

We are a society of 256 members . We have 14 MC members duly elected by the election procedure.
Two of our members resigned as they had to move out of the country. Still we had a quorum and the secretary was against co opting .
A month back i tendered my resignation via email as I wasn't able to handle the politics and evil games been played . But since AGM was due the Treasurer requested me to continue as a MC members and think about resignation after the AGM .
I came to know from my fellow colleague that my resignation wasn't tabled at All since it was an email and not handwritten hard copy.
After the AGM there was a informal meeting called and it was decided that my resignation be deemed accepted . To my utter shock this was after the chairman spoke to me about staying put.Also my name was put up on the notice board inviting other members to join by co option.
As per the Chairman he has general body mandate to co opt . But before putting it in front of the GB the chairman didn't bother to speak to the other office bearers. So they don't have a clue about it.
It is not recorded anywhere that my resignation has been tabled or approved for acceptance.
After this incidence the Treasurer , the secretary and two more of my fellow MC' s tendered their resignation.
Is it legal to co opt? Is the chairman right on his part to consider GB mandate over bylaws?please help
