Will declaration

'A' have 6 children and he belongs to SC Community, he is possession of agricultural property, the same property is granted in the year 1998 with specific conditions not to alienate for the period of 15 years, thereafter in the year 1999 'A' executed a registered will in favour of his sister 'B' and in the year 2000 he passed away, consequently by virtue of the Will 'B' has transferred RTC and other revenue records in her name, subsequently 'B' executed a registered Gift Deed in favour of her son 'C', thereafter on 2016 'C' executed a Sale Agreement in favour 'D'
now legal heirs(children's) of 'A' wants to challenge the Will, Gift Deed and Sale Agreement, as Will is not probated.
please guide me what relief should i claim in civil case.

Pasupu kunkam property

Hi,
I want clarification for pasupu kunkam property.my grand mother has 3 sons and one daughter. my grand mother's father has given 2 acres to my grand mother as pasupu kunkam. Now she died and to whom the property belongs. She didn't write anything about that property to whom the property belongs.So please give your valuable suggestions,thanks in advance.

Complaint against sub ragistrar

Dear Experts, I work as home loan agent so i came to know about a fraud happening in sub-registrar office. Actually a sale deed was registered in Faridabad sub-registrar office 8 years back. A lady was the single buyer who had arranged fund by applying home loan with her husband X as co-applicant. The same identity revealed in her Sale Deed. A few days back she has corrected the name of her husband from X to Y through correction deed. But 8 years back the loan was availed with X has husband, stamps for sale deed was also bought as Mrs....wife of Mr. X. Even the ID presented that time shows Mr. as has husband. I dont know the reason behind it but how can a sub-registrar register this type of fraud correction deed.
Now kindly advise me whether
1. i can complaint this matter to magistrate in Court or not 156 3 against all involved and
2. whether a magistrate can order FIR against govt. servant sub-registrar?
3. i am not victimised due to this fraud, so can i complain?

Membership of committee members

I am registered member of society in Mumbai, since 9 years and aged 70 years old senior citizen. In 2010-11 gave my consent for redevelopement with the builder offer of 12% additional area to all the members. The offer was discussed in Special general body meeting and we gave our consent on 17th july and redevelopment agreement registered on 26 july 2011 by making changes in the additional area %(25% to 35%) to gain more area to redevelopment committee other than the offer of 12% without passing any rectification in the resolution passed already or passing any further resolution. Post registration even the copy of the redevelopment agreement was not shared by the committee to members.Committee didnot follow the directives for redevelopment given by the govt dated 9th Jan 2009 by calling the registrar for redevelopment process and video shooting of the Special General body meeting and allotment of flats once completed. I always argued with committee of illegal dealing and asked for redevelopment agreement & approved plan. I got passion in May 2014 with additional area of 14% post change in plan adjustment but committee members got the area of 25% to 35% free of cost.
1. as per redevelopment agreement 400 sq ft of carpet area was offered to committee members and actual given 500 sq ft carpet area free of cost and not paid the stamp duty on the additional 100 sq ft area. does this mean that their agreement is null and void to consider the membership of the society even though old tenant being cheating the stamp duty to the govt. advice whether their membership becomes ceases to exist due to invalid agreement? they are still running the society with thier dictatorship rule.

Possession of rented premises.

Sir, After long standing unsettled issues and legal cases tenant while injunction in force has vacated the rented portion without informing, but has not handed over the portion even after 15days. Unauthorizedly his son and agents are misusing the portion by staying in it drinking and using foul language and moving in and out through out the day and night. Our security and safety is in serious jeopardy. Pl suggest how, 1. I should take back the possession of the rented house. 2. What are the cases that are open to me that can be filed in the police station and courts for restraining them and take immediate possession. **I have photographic evidence while the tenants belongings were shifted and transported in carriers and tenants agents unauthorized possession and stay in the rented portion. Thank you

regarding redevelopment.

Hello experts,

I have a query. Our 50 year society in Mumbai is undergoing redevelopment and now 1 tower is ready.

Our society is proposing turning the newly built tower into a new society with a new managing committee.

Is that permitted , as the tower is in our society premises only which has been redeveloped and there are more to go.

Transfer of case from district judge to family court custody of children


Sir,
1. Mr. Nilesh Agrawal was filed a case under section 6 of the Hindu Minority and Guardianship act 1956 for custody of children in Nagpur District court on 23/06/2015 Nagpur (Maharashtra) . This case has been transferred to Bilaspur ( Chattisgadh) by Supreem-Court in the month of Nov.2016 . The case is pending in Bilaspur for want of reply of repondent.
2. Mr. Nilesh Agrawal was filed a case under section 13(1)(ia) (ib) OF THE HINDU MARRIAGE ACT,1955 in the Court of Joint Civil Judge (Sr.Dn.) Nagpur (Maharashtra) on 27/07/2015 for divorce . The Judgement was delivered on 01/01/2016 Ex-parte and decree of divorce is allowed.
3. Respondent wife of Mr.Nilesh filed a case in Family-Cort under section 125 crpc. for maintenance on 10/09/2015 at Bilaspur whch is pending .
I want to know that can the case of Custody of children in the court of (D.J.) be transferred to family court so both the cases may be under same court.

Is unelected or nominated rwa is allowed to work as full statutory body registered under hsra, 2012

We are residents of newly registered society in Faridabad. one year back few people had registered RWA under Haryana society registration act 2012 without any discussion with residents or may be registered by misrepresentation. And, now they neither increasing members nor declaring elections and still have unelected body. Also still they are accepting documents from selective residents and collated documents around 250 residents but not given any confirmation about membership or no etc except membership fee slip, those had applied for membership, Society have 1500+ flats. Now they are trying to change maintenance agency even they dont have maintenance rights of common areas or not taken handover from builder. Is this act allow them to work as statutory body without elections. Even few office bearer had resigned from their position and President had selected or nominated new officer bearer of his choice and we have doubt they have not intimated to Registrar office also. how we can force them to drive membership on fast track and declare elections soon.
