Dear Sir
If case is dismissed on being account of non present of applicant in section under crpc 125, can fresh suit be filed.bcz one year had been passed

125 Cr.P.C. deals with maintenance right. yes if your case was dismissed for non prosecution you can file a fresh case on new cause of action. Meet a lawyer of good repute and he will take care of everything.
