Plz need your advise on Death Declaration Suit.
Facts of the Case:
A woman committed suicide in the year 1997 by setting her self ablaze and in that course of suicide her husband tried to save her but unfortunately the whole house caught fire and even the husband died while undergoing treatment in the hospital leaving behind 2 children (boy 10yrs & girl 7yrs). An FIR was registered and the police filed a report that as suicide and closed the case. And the children were at a very tender age they did not have knowledge abt the formalities such as applying for Death Certificate of mother, and as father was a govt servant no one had guided them to apply for their fathers pension or any other emoluments or benefits of their father. However on a later stage one of their relative helped the children to get the Death Certificate of their father and at present when the children applied for their fathers Provident fund the authority of PF has asked to submit the Death Certificate of their mother as she is the nominee, whereas they do not have the Death Certificate of the mother as they did not apply at the time of the Death of the mother and at present the Registrar of Births & Deaths has also refrained to issue the Certificate as there is lapse of 20yrs and advised the children of the deceased to approach the Court.
Now my query is:
1. Will the Court issue Death Declaration after a lapse of so many years?
2. If yes what will be the duration?
3. What is the procedure and under which section of law a Death Declaration suit is filed in the court?
4. What Documents to filed in the court, as at present the children of the deceased have the Police Report and Cremation Certificate?
Plz suggest.

My father own a pagadi system house in south Mumbai. He is not staying in that house since last 4 years due to some health issues. Now the property owner has sent a letter to surrender the house within 1 month after receiving this letter.
1. Can i sell this house now?
2. Is there a rule to surrender the house if we dont stay in that house for certain period ?

My uncle who was unmarried died few days back.Now there is two surviving brothers both married have one daughter each.The son of eldest bother is also there married and have a son.Is their any chance of getting the legal heir in the name of the eldest brother's son??The deceased have not left any will also.but his wish was to give his property to the son of his elder brother.

Hi, l am working in a gaming company. I joined on 01 December 2016. As per the offer letter salary date is every month 5th. But till this month ( may 2017) they didn't follow the date and every month they are paying salary on 15 th or 17 and some months on 26 or 27. Many times l put complaint regarding this and management was not bothering. They sent an email notification of delay in payment in December. In that mail they mentioned till April there will be a delay in paying salary. But after that also they are not paying on time. l questioned this and HR informed they can't tell a proper date. So On April 21st l put my resignation because of this salary issue. Till this date they didn't give a reply mail for that. And l spoke to the Manager regarding this.l didn't sent the work which they assigned last month because of delaying salary. l have completed that but l informed the management the work but l informed manager that after paying my salary only l will send the work. l mentioned one month notice period in my resignation(21April 2017 to 21May 2017).May 21st lt will be completed. But still they didn't pay my salary. They are telling me to give the work and leave whenever company have the fund that time they will pay my one month salary(April 2017) and salary for the month May they will pay as f&f after 45 days. But l am not ready to leave without getting my April month salary. And I am ready to wait for the last month salary (May 2017) (As per company policy after 45 days of leaving). I informed this to the management but they are not ready to give the money and still asking for the work and telling whenever l am giving the work they are ready to relieve me but without giving salary.
Please suggest me what l can do in this situation.

Hello Sir/Madam, my sister has married mother's sister's son and they have two children. According to Hindu Marriage Act 1955, I've understood that this marriage is void. My question to you is, does she have rights over the father's self acquired and inherited properties? And does father have the right to remove her from the family tree because of her void marriage?
Regarding 33% issue
Hi..
My dad has shop in khar on paghadi system. Now he want to sell it. Intially landlord is not allow to sell but now she is ready on 33%.
Now main issue is that if new tenant wants to sell the said shop in future he will give 33% to landlord on his "profit". For e.g. today if he purchase shop say in Rs.50Lac and in future if he sell shop in Rs.80lac so he will pay 33% on profit i.e. 33% on 30Lac only but landlord denies she wants 33% on 80Lac.
Is there any such type of law exist? And if it is then please provide legal back up document?
Kindly advice.
