Whether a complaint only against a signatory partner of the cheque and firm is maintainable without impleading the other active partners of firm.
My client working as Jr. Asst in a government office from 2001. Before that he worked as agent for that office.
In 1998, some orders were issued by government for the welfare of some under privileged people. The order is a printed one and the name of the beneficiary, their address and date alone to be written by hand. And it has to be signed by a authorised signatory.
The charge against my client is he issued such forged orders in 1998 (before he joining the duty) to some beneficiaries.
Totally 18 witnesses, four witnesses (beneficiary) say they received the orders from my client, 3 witnesses (agents) also say the same thing. 11 witnesses say not in memory.
Police asked the accused (my client) to sign on white papers as available on the said orders. The accused also duplicated the same signatures (about 50 in numbers) in more than ten plain papers. Police also asked to write the names of the beneficiaries.
Then the police sent the specimen signatures and sample hand writings. The hand writing expert opined that specimen signatures and the disputed signatures matches and No opinion for sample hand writings.
My client/ accd say the police asked to duplicate the disputed signature, so it might have matched.
Now, my question is HOW TO CROSS THE HAND WRITING EXPERT?
Can he opine that just in one day one cannot duplicate another's signature?
Seven witnesses say they got the orders from the accused/ my client. But we have enough ground to cross them.
Dear Sir, Can I give 65 B certificate in MACT claim and re appeal case, If accused already acquitted in lower court in section 279/304 A, As CCTV operator recorded his statement that He has handed over to Police and I.O. also said in his statement that he has received CD from computer operator who was on duty at incident time, But 65 B certificate is not annexed in charge sheet only CD is annexed and had exhibited in lower court I have given an application to MACT court to see the cctv footage and application is on ARGUMENT stage, can Judge reject my application if 65 B is not in file or can summon to CCTV operator again because CD is not seen in trail court. In 2007 my in laws bought a property in Rajasthan. They gave the land to previous owners only for farming ..now the scene is that they have filed a case on us on the behalf of their daughters claiming their share in the land. We have been in this chios from the past 5 years. The case had been put to our favour earlier as the other party did not show up on the hearings but now they have again filed the case. We have all the geniune documents with us....what they say farad and all. Despite being in the right we have no idea why we are put to in this legal matter. As what i think is that it was previous owners' duty to give share to his daughters but he along with his daughters have dragged us in the matter. We want to sell the land but because of stay, couodnot. Any help???
