Two residence certificates in two different states at a time

Respected Sir/ Madam

My sister was born and brought up in State X. She belonged to schedule caste. So, she got residence and SC certificates of State X in 2005. Then in 2010, she got married in same caste in State Y. Same caste also falls under schedule caste in State Y. So, after marriage she got her residence and SC certificates in State Y. However, she didnt cancel her residence and SC certificates of State X. Then govt. job vacancy in State Y. She applied for job as a resident and SC candidate of State Y. After three months, there was govt. job vacancy in State X. She applied for job as a resident and SC candidate of State X. Then written examination happened for State Y. Then written examination happened for State X. Then result was declared in State Y. She got selected in State Y and verification of documents was done in State Y. Also she got place of posting in State Y. However, before joining some non - selected candidates put some court case and her joining was put on hold in State Y. In the meantime, the result for State X was out and she got selected in State X and verification of documents was done in State X. She joined govt. job in State X.

Her in-laws family was fully aware of this and also supported her in this context.

However, now some family dispute and case is in child & women care cell.

Now, her in-laws threatened her that they can harm her govt. job in State X.

We tried to cancel her residence and SC certificate of State Y, but certificates maker govt. officials told us that it is not possible without divorce.

What are the safety measures we can take now?

Can they really harm her govt. job?

Son's right on deceased mother's properties and assets

Dear Friends

My mother passed away intestate in February 2014 and was a government employee for more than 30 years. My mother left following immovable and movable assets intestate.

(1) A sum of Gratuity, PPF/GPF, Pension, Leave encashment which is now in possession of my father
(2) A farm house plot which is in joint name with my father where my mother is the primary holder (my father has no monetary involvement at all in buying the said plot. It is solely purchased by my mother’s savings)
(3) A tenement in a prime location which is in her maiden name (though it was purchased 10 years after her marriage) and my late grandfather (mother’s father) financially helped my mother in purchasing the said tenement.

All the problems surfaced when my father suddenly, without intimating us remarried in November, 2016 and forcing my family (me, my wife and my 3 years old daughter) to evacuate “his” house. We’re currently residing in a 3 floor tenement which is in name of my father (but residential plot was offered by government of Gujarat under a scheme at highly commissioned rate and with a condition to wave off my mother’s claim from claiming the plot under government scheme. Only one can be eligible for the plot if both husband and wife are government employees).

I’ve one younger sister who is married and settled in the UK. Now my problems are…..

(1) My father refused to give my share from my deceased mother’s gratuity/GPF/PPF etc.
(2) My father is claiming that the farm house plot is now his since he is the joint owner.
(3) My father illegal transfer my deceased mothers tenement into his name, without informing me or my sister. He also illegal obtained duplicate share certificate from the society. He did all these without any proper legal procedure. Now he’s claiming that the said tenement is also belongs to him and does not allow me to claim my share into the said property.

(4) Is my father entitled to claim his share in any of the above assets since he is remarried and earning that much that lead him luxury lifestyle.

(5) My sister is settled in the UK and does not intention to do any legal procedure against my father nor she’s interested in claiming her share legally. She’s also not giving POA.

(6) My father is misusing all these above, especially cash from gratuity/GPF etc as a tool against me and my family to harass and torture us.

What are my legal options to get my share?

Thank all of you for your valuable time and highly appreciate your guidance.

Old tenant nor vacating my house & neither paying right rent

Hi,
I bought a house 3 yrs ago. This is the same house where my ancestors used to live as tenants. We live on the ground floor & there's another family who lives on the 1st floor. We both families are staying in this house for almost 40+ years now. We both were living as tenants, although not paying any rent for almost 20 odd years. But now I've bought this house from the owner & house is on my name now.
Now I want the other family to vacate my house. But they're not ready to vacate it & when I ask for rent then they give me a rent of Rs. 20 (twenty) which they used to pay to the previous owner more than 30 years back. The current justified rent of such a portion (where they're living) is atleast Rs.6000/- per month.
Please advise what legal rights I have as an owner so that I, preferably, evict them from my house or if not possible immediately, then how I can get the right rent as per current market rate.
PS : This property is in Haryana.

NOC from IOB for education loan settlement

Hi,

I've paid my educational loan on August 9th 2017 to IOB under lok adalat settlement.

Once I asked for No Objection Certificate and loan statement. They are not ready to provide and saying lame reasons like that you paid under settlement so we need approval from center branch to waive that amount and close the loan.

My Query would be how long do I can wait or I can file RTI online to get the documents?

What is the procedure to file RTI in this case?
