Filing of a case

Sir,
We have won a case in High Court against SBI in Aug 2017 regarding termination. But, SBI didnot consider the directions of High court and SBI has stuck to its termination and the latest order of restoration of termination was given given by SBI on 01.11.2017. We would like to again go to High court on this. My query is what is the limitation period for filing the case?? I mean within how many days from 01.11.2017, we have to file a case??

Succession act

My paternal grandfather blessed with four daughters and one son. My father, grand father and great grand father was applied ceiling act 1961 and the properties share shown as Great grand father -50%, Grand Father-25% and father -25%. However, all the properties were registered on the name of my Grand father and individual division of the properties not taken place. In the year 1971 my grand father leased one of the property to Oil Company for petrol pump for 20 years. my great grand father was expired in the year 1980 leaving a WILL, but not covered with the property given to Oil Company. In the year 1982 my grand father expired intestate leaving his wife, my father and one unmarried daughter. After demise of Oil Company provided rents to my father and that time no objections were raised by my grand mother, 3 married sisters and 1 unmarried sister and in fact one document may be power of attorney was given by my grand mother and her four daughters (Document not available). My father taken rents up to 1989 and he expired intestate. Lease period expired in the year 1991. My father's younger sister filed a partition suit in the year 2000 except this property under famous Andhra Pradesh NTR Rule and the same is pending at High Court. I filed a eviction suit against Oil Company and the same is pending. My grand mother is also expired. Till date my father's sisters not claimed any right in the present property.

1. After demise of my Grand Father, the Succession opens to my father or not.
2. My father's sisters have any right in the present schedule property
3. Any oosting of rights clause is applicable or not.

Please provide any related information along with Judgements. Thanks

Certificates

Hi.. I got a free MBA seat under SC quota in X college.. I was already working in one company so couldn't attend the college properly.. So due to less attendance they detained me in the last minute without any prior notice about my less attendance.. So I had to put a case in college regarding the same by contacting one of the lawyers.. By the time I got the stay order..final exams were done n I couldn't write as they don't allow.. Got the stay after exams and attended second semester but when it's time fr second semester exams they again asked for a stay order to write exam by saying the old stay order was only for attending classes.. I couldn't take it and had to discontinue college without informing as job was important at that time.. Now I heard they are asking to pay complete 2 years amount to get the certificates.. Is it legal to ask like that? Mine was a free seat though.. If that is legal ..is it applicable for free seat as well? What can I do to get my certificates back without being charged.. They have all my certificates till graduation.. please suggest..

Under section 138 ni act

sir we have filed a cheque bounce case on a borrower.but he has changed his address before we file the case and not receiving notice. this is happened since 6months . nobody are attending court both complainant and accused . court has mentioned 1 last call in the last proccedings as per ecourts info. what will happen does it will serve warrant against accused or what action court will take. as the accused is not available to intimate we are also not attending court since 6 months.

Registered sale agreement validity -- total amount paid

Hi,

we have sale agreement with person X in Feb 2015 for a flat in Hyderabad and we paid total amount as he was in need of it.
now he is not coming to the registar office to complete the process. he is making excuses and avoiding us.

i want to know for how many years, that agreement is valid ? do i still have chance to file a case in court and is there any other way to make him come to registar office?

Gratuity payment

Hi, I want to know about gratuity payment if my joining is 7 Jun 2011 and date of living is 6 Dec 2017 then gratuity will be paid for six years or seven years.

Custody of child

This is regarding the custody rights of my son. I got divorced mutually in 2014. As per the petition my ex-wife got the custody of my son. As per the petition she also agreed to no financial help from me however for the last three years I have been paying a monthly amount to her and also the school fees and other requirements are bourne by me. She remarried in 2014 and now has a daughter from her second marriage. My son feels neglected with her also she is at times very violent. My son is terrified of her but is also scared to say that he wants to stay with me. His studies are also not taken seriously. He comes and stays with me during vacations though visitation rights were not mentioned in my divorce petition. During his last vacation he did not want to go back to his mother. Me and my ex-wife stay in different cities due to my job. I am not being able to shift to the same city as there are no opportunities. A custody battle will take ages and I can't see my son being tortured. I have started speaking to her regarding getting my son to me. She agrees once then disagrees after a few days. Is there any way I can bring my son to me without going to court. What legal steps can she take if I don't send him back to her after his next vacation. How do I fight it? Cannot see my son go through this trauma. He is 10 years old.

Claim for property by descendents of seller after 42 years

Sir i have a property of my ansectors registered on the name of my grand father . I do not have link documents of the property. I have an sales deed/ GPA of the property . I have tax paid receipts of thr property on the name of my grand father. In the ec of the property my grand father name is mentioned!!! Can any descendents of the seller of the property claim any rights for the property. In the papers it is mentioned by the seller that my grand fathers successors have the rights in the property and not by the descendents of the seller !!!. Plz give me guidance on what to do if any such person claim the property???

Injuction order

3 years back We have constructed a road with oral consent of our neighbours
Almost rs 60000/- i spend for this road
This road have access of 4houses all the expences bared by us only
On the basic of this road we got hoousing loan from bank we have location sketch from villege office
In that location skecth they have mentioned � mud road �
Now one of my neigher trying to block this road
What i will do for retaining this road
If i go to court for an injuction order can i retain this road forever

Charges u/s 353,504,34

Police constable falsely framed charges we had argument with rickshaw driver for over charging constable came and intervened in between in civil clothes. we have video recording of this incident we have filed for discharge and mentioned about recording.will it be accepted during discharge argument or u/s 173 (2) should we file report and submit our recording.but we don't want to give proof to police who have not heard our side.
