Mact case related

Dear Sir,
I am the conducting lawyer of the Insurance company in a Motor Accident Claim Case. After the evidence of the petitioner , I was not able to attend the case as I fell ill due to a tumor in my brain. The petitioner lawyer taking advantage of this cunningly manage to fix the case on 4 different dates with in a month and judgment was pronounced. I have not adduced evidence and have not argued in this case. 5 months after I suddenly came to know about the judgment. Can I be allowed by the High Court of Orissa , if a case is filed before the High Court to allow rehear the matter and permit me to adduce evidence.

Please comment.

Respected Learned Counsel,

As per the recent notification by the government that the shop will remain open for 24 hours so what is the exact process to apply for the 365 days opening licence in maharashtra particularly in a taluka like ambernath which is located in the thane district because i came to know that taluka is exempted from the scheme.Please guide me whom to approach for such licence.My client is continuously asking for the same.
please provide me your valuable suggestion on the above mentioned query?

Reg 506 r/w

My wife filed a complaint 506 r/w against me a 2016 as i was not ready vacate the house when we were staying together in trichy. got bail. she told me that if was ready to vacate the house,she would withdraw the case. so i left the house and city.
But i recently heard from relative that she didnt withdrew the case and was also not interested in running the case She didnt inform me also.As i was not aware of this i didnt appear in the court.

Now how could i approach the case. Can i hire a lawyer in that city and close the case, as she is not ready to run the case.
Please explain me.

My query get resolved but now just i would like to know that is it compulsory to submit no objection of legal heir on the stamp paper which is to be notarized or if it is written on the plain paper will also sufficient for submission in the bank?

Dakhil kharij of 143 land but not under lucknow municipality

Hello Sir

I bought a 1000 sqft house yesterday which is build on a land which is under 143. A 3000 sqft piece of land was bought by a XYZ housing society Ltd and converted to 143 by them, then another lady bought this plot and she sold it to Mr Arif who constructed 3 houses on it (1000 sqft each), Mr. Rahul bought 1 house in it and had a registry in his name, then i bought the same house from Mr Rahul and got the registry in my name. When i asked about Dakhil Kharij i was told that Dakhil Kharij is not required for 143 converted lands even though this land is not under Municipal Corporation. When i check upbhulekh.gov.in it shows the name of XYZ society. Please suggest if anything needs to be done here.

Child kidnapping and dowry

we married 9 yrs ago, my son born abroad, we separated 4 yrs ago, my son and second son were living with me. 6.5 months ago my husband took my kid to abroad without my concent, i have a recording in which he is telling my son to come out and he took him.
i filled domestic violence case in uk as he beat me, but that was 4 yrs ago.

There were no court orders, I waited so long to reconcile and he sent a divorce notice, i filled dowry as he demanded dowry
and kidnapping complaint with police but he is not coming to india with my son police asked him to come

could you please help how to get my son back ? what i should do? Mahi

Property investment

Hi, Me and my wife jointly owned a apartment and sold it around a year back. 2/3 of the amount from selling was paid towards the outstanding home loan and for the remaining 1/3 amount I am yet to make any tax payment. We planned to buy a residential plot with the gain i.e. 1/3 gain, and I would like to register this plot in my wife's name. If so, will I still need to pay the income tax towards the gain from the apartment? Or should we register the property jointly in both our names

Transfer in Public Sector bank

Reverend experts, my query is-I have been working as a PO in of our public sector bank, posted in Delhi and my hometown is West Bengal. As I got legally married and my wife is a government school teacher under government of West Bengal and as there is a certain circular by the DOPT of transfer policy of posting husband and wife in same station, would I get the benefit of the same? As banks some time ignore such circulars saying these are only for women employees, though the concerned circular is for everyone and unfortunately there is no categorization of PSU and central government. Please suggest me. Thanks in advance....
