Transfer petition in sc

Hi Experts,

My wife filed 498a on my entire family and relatives and then forced us for a divorce (only 3 months into marriage). We agreed to her demands but then she went to her native place and after two months filed DVA and maintenance cases demanding 5 times the money that she had asked initially.

I filed for a Cr.TP in the SC and that took two years to be decided with wife not responding and just taking time and dragging the case. It became ex-parte but they some how managed to bypass 2 -3 benches and finally landed on a bench which had a lady judge from her state.

As expected the transfer was rejected and awarded in favour of the wife even though they never filed a response, the lady judge was so determined to block it, my word, I can't explain. She gave the reason as inconvenience to the wife which never got into the official orders. The official was a bull shit to read but who can question them? Some of them feel they are GODS.

Now, I filed RCR in my City (no Divorce filed before) and as usual no reply from her for months and it became ex-parte again on the day before an order is given, she gets a stay order from supreme court just like that. The same was not provided to us for the DV transfer case which was Criminal case and we were taken for a ride for close to two years for bull shit judgement.

Now, I will get a notice from SC for the transfer of this RCR case soon. When I can't get a criminal case like DV transferred to the place of allegations especially when there is a 498a already I have no hopes that the SC will reject her transfer petition for RCR case. Every advocates sympathise with us and tell that is how it is in this country. The SC is a Women welfare organization rather than a court of justice in these matters.

The SC has absolutely no regard for merits and establishing justice. It just looks at whether the petitioner is a man or a woman and if it's a women it is super advantage.

Now, I don't want to spend money and time on this losing course fighting to retain RCR in my City. I have very well understood how SC decides the transfer. Men have no chance for either criminal or civil cases getting transferred. We are literally at the mercy of the complaining women.

I want to know whether I can respond to the notice my self some how by send a post or email or their online services etc.

Are men being at the mercy of the women and the system the only way forward? I have given up and my fighting spirit is wading faster and her demand has gone increasing.

Some times I think whether men should take up arms and turn rogue to get justice and then suffer which is much more satisfactory at least. But unfortunately men have their families who are also bound in these false cases which blocks many men from turning into murderers.

Maintenance judgement, cost was imposed on wife for lying

Looking for a judgement in which cost was imposed on wife for lying to get maintenance. She was also asked to deposit back the maintenance she had received uptil then. I think the girl's father was a lawyer. Can't recall where i read it. Please help

MCS Act, Transfer of 50% Shares

I am purchasing 50% share in a flat from one of the brother, the other brother is confirming the same. However, can Cooperative housing Society object to transfer 50% shares in my name, since one of the brother is exiting but other one continues to be owner.

The brothers inherited the flat from their parents. Their father had actually bought the flat.

Criminal inquiry under section 202 crpv

We have filed criminal inquiry under section 202 crpc before the magistrate against a PSI for forcefully dispossessing us from our own office but Megistrate ordered the dcp and cp to investigate the matter and to submit report in 40 days. And informed the same by notice But now its 60 days . Still no investigation or inquiry is held even there is no response from police authority.

Before the filing enquiry we have complained the CP and Dcp but they were not ready to take any action on our complaint.

My question is what should we do now?

1)Can i file an application of contempt of court
2)can i appeal against the said order of megistrate seeking the court inqui
3)which one is the batter option from these two?
4)in the said case we have video footage against the psi. What is the method of submission of video footage to admit the footage as evidence in court? How should we get the FSL report of the said footage?
5)CP and Dcp helping the PSI. We are not feeling safe to give the original mobilephone to the cp or dcp in which video footages are recorded. is the safe way of submission of said evidences with the conget value

Cancellation of sale deed

My father is blind by birth, he has One brother. On my father we have land of 2.13 acres of agriculture land in Andhra Pradesh. On 2015 september there was sale deed transaction done to three other People with the amount of 24 Lakhs rupees. It was done through My fathers brother with out knowing me. The amount was not given to my father through any bank transaction, It was transferred to my fathers brother account. I get to know recently, I want to get back my fathers land back. Please help me in this regarding.

Can some one fight 482 (court direction )

Filled a complaint with police, but no action was taken, when am trying to get a court direction( u/s 156(3) /190) to file FIR,

Question

1) Is there a way the opposite party fights it at the court? to object getting the court direction?

2) Can they file a caveat petition to know any such cases?

Complaint agaist society chairman

Dear sir.

I am the owner of the flat at 4th floor in mudit garden Chs at koparkhwrane. Navi mumbai.
Here the issue is vwry critical. The chairman of the society is the local dealer who is also residing in our society. I am having a stilt parking on my name. And now we have shifted to some other location . And given our flat on rent. Erlier tentent was not having vehical so this chaiman was using our parking without our permission. Now recently we have rented out to a man qho is worling in media. Now this chairman always block our parking way to give problems to our tanent. This is becuase that we have rentend the flat thru this chairman dealer.

Even some free space always ahead with his vehical to get his vehical 2 to 3 feet ahead. So our parking way is to be clearier. Kindly tell the way to deal or get compalint of the chairman who is an uneducated property dealer belongs to up. And get his flat like a business office. And always 4 to 5 gunda of UP reside with him

Compensation from central government department

Under which article/provision of law can an application be filed in the high court for demanding compensation against a central govt department for wrongful issuance of a license to some people and on the basis of the license I acted and sufferred loss and later came to know that due to ignorance of the department the license was wrongly issued to fraud people.

Huf account for tax benefit

Hi.

I have an annual income of 11 lacs from salary and till date savings of Rs. 25 lacs which earns an interest of 1.5 lacs annually through fixed deposits. However because the tax slab applicable for me is 30%, I end up paying tax of 45 thousand every year on my income from FD. We are a Hindu family and eligible to open an HUF account. I also understand that if I open an HUF account and show the FD income in that account my tax liability will reduce.

However I have the following queries:

1. Do I need to transfer the saving of 25 lacs in the HUF account (created on the new HUF PAN card) ? Or can i only take the interest income is HUF bank account without moving my savings to HUF account?
You may choose not to answer this one as I can find it out from the bank. But if you have any idea please share your thoughts.

2. In case If I transfer my savings to HUF account as gift, can I take it back from HUF account to my personal savings account (may be to buy a property or such a big expense) without paying any tax? Or will it be considered as income in my personal bank account and I will be liable to pay tax for such a transfer from huf to personal account?

Any help on this is appreciated. Thank you in advance
