gifting/selling of UN-partitioned ppty

Im spinster &sr.citizen.in1964 we(2sisters}jntly. purchased ppty.{3600Sq Ft}in maharashtra.my married sister died in1965;leaving behind 7small children.her hesband's name was mutated in her place in1971. he died in1982. children are grown-up now but reluctant to mutate &add names of all 7 heirs especially their sisters[2}.they{3}are running a hotel there since 1990. due to my service i was in mumbai till 2002.i have no physical possession of the ppty. 7/12 excract sill have my name alongwith brother-in-law's. Q.whether it is possible to GIFT/SELL the UNpartitioned ppty. kindly guide along with stampduty obligations.

lack of infrastructure in educational institution

Sir,

Whom should we contact, if the educational institution coming under CBSE, Chennai lacks basic facilties of sanitation and washing, when writing to the shool authorities is of no use.

Is there any law which regulates functioning of CBSE Schools in India.

Can we write to the SECRETARY, CBSE, DELHI for interference and necessary correctional measures in case of MALADMINISTRATION on the part of the Management of the School.

Employment in CA Firms,

Sir,

Is there any law in India, which governs conditions of employment of people in UNAIDED SCHOOLS that is to say CBSE schools, Crushes etc.

In CA Firms, or partnership firms of Advocates, though there is good training and exposure, the financial aspect of employment appears to be bleak. In Courier agencies also, this is the case.

Is there anything to protect the service conditions of those employed in the above mentioned sectors

I myself was a victim of exploitation, four five years before after my post graduation in commerce.

I invite the opinion of our esteemed members to my suggestion that why not labour laws be made applicable to the above employments also.

Territorial jurisdiction of FIR?

Can FIR be quashed on the ground of lack of territorial jurisdiction? also as per my understanding, the police need to transfer the FIR if there is no cause of action within their territory. But if the police due to some influence doesn't act in lawful manner and retain the FIR despite having no prima-facie cause of action, what is the remedy with the alleged accused in the FIR?

Please tell me in detail and also let me know if there are some Supreme Court judgments on this issue.

Under which law vehicle is insured with the insurance company in case of damage in accident? is it the same with insuring third party under MVA of 1988?

How to recover the Advance paid.

Dear Forum members,

I request you to Kindly, solve/ show me way the out


to my PROBLEM....


I have paid an advance for purchasing a land (

Around 40%, of the cost of land),and obtained a

receipt.As the land owner refused to sign the

agreement,the balance amount is not paid.Now the

land owner is not paying (Refused to Return the



Advance paid by me) the amount, i had given to him

as advance . What are the options left to me to

recover the amount.

The Receipt contains the following wording....

Repudiation of Insurance Claim

Mr. A has parked his 2 wheeler unlocked in front of his house.

The vehicle was stolen and police have registered case u/s 379 IPC and subsequently filed final report was in the Court stating that the vehicle is not traceable and the Court has closed the case.

Mr. A has lodged a claim with insurance company. The claim was repudiated by the insurance company stating that adequate safeguard measures was not taken by Mr. A.

Is this violation of terms and conditions of policy ?

Is there any citation in favour of Mr. A ?

I seek the valued opinions of the experts.

Property Tax

I am an a Licensee and am paying my licence fee after deducting tax as per Sec. 194 (I) @ 17%.

Is there any change in the percentage of deduction or is it still 17%

Please reply, urgently, as I have to make the payment for the month of April by 3rd April, 2009.
