Dear friends
I have filed the Original Application (OA) along with the Miscallenous Application (MA) which was attached with the main application but i am surprisedthat in cause list only O.A Number has been given without MA Number .Please inform to whom I should contact for getting the MA No? Whether it will be appropriate to inform Hon'ble Bench on the date of hearing?

My father was died on 2000 after writen registered Will.The property is at village & not coming under municipality limits.How to get the name transfer to beneficiary.He has indicated all heirs name and married status.What are the documents are needed to proceed for? where to proceed? howlong it take? Whether is it recommend to do this process at Taluk office with Advocate? Whether other heirs who doesn't have rights as per Will on said property can stop this process

Under the PF Act, the principal employer is liable for deducting and remitting the PF contributions of not only its employees but also that of contract labour. Is this applicable even when the contractor engaged by him does not deploy more than 20 persons and is not covered under Act for registration and for obtaining PF code. If that is the case, where will the PE will deposit the contributions of contract labour where PE is an exempted establishment. What remedies are available.

I am trying to start a new industry. Where the trust CGTMSE (credit guarantee trust for micro and small enterprises) will provide guarantee for 75% of entire loan amount and rest 20 to 25 % we shall deposit in cash in term of margin money/owner’s contribution. So this way when there would be no issue of aspects such as collateral/security assurance in such case can I go to set my new industry over a leased/rented land which is already mortgaged with some other bank provided all the concerned account at first bank attached with this property are in order/standard position?

My father who died on 2000 has made all settlement thro' registered Will in which he has authorise to enjoy the property ( agricultural land) his only son and also mentioned that he had settled his 2 sisters by the way of cash and jewels. The year of Will register is 1995 during which all sisters were got married. Now one among the two sister wants to go court for claim the father property by equal rights due to jealousy whereas other sister has accepted that father had given enough settlement by way of cash and jewels.Now the above property is still in the father name.But all other control under me incl. property tax receipts. She may stop the name transfer also. In this case, if she go to court, what will be the result? Or what is your advise to execute property as per Will.

Dear all brothers,
In a pending criminal case of 406 of IPC before a metropolitan court of Mumbai,where no plea was recorded yet and hence,trial was not set in motion in real sense.
During its pendency,a simple application was made before the said court by the complainant i.e registered corporate body and consequent acquittal of accused took place by mutual trust.
Later on, an agent through whom the said criminal complaint was lodged by the said corporate body,filed an application on his own under section 340 of Cr.P.C.against the said corporate body present functionary and the said acquitted accused.
The said application was rightly dismissed by the said trial court but the Sessions Court has overturned the said dismissal order.
In the light of the above,now please let us know as to said section of 340 is applicable to the said application as the said application is not a "document produced or given in EVIDENCE "?
When even plea was not recorded and where was the question of evidence?
We are surprised at the perverse judgment of the Sessions Court,which had not mentioned a single word from the 67 paged written arguments involving historic citations of constitution benches of the apex court of the country of the said respondents.
Kindly throw some light on the aforesaid dismal scenario and any citation or authority,if available,in a similar situation will be highly appreciated.
