The Supreme Court of India in Sheela Devi and Others vs Lalchand held that sucession opens up on the date of death of a hindu woman's father. Therefore if a hindu woman's father dies before the above act came into force, she will not get the benefit of the above amendment. Only those hindu women whose father expires after the amendment of 2005 came into force, can benefit from the said act. Am I correct ? If so, Indian women have to wait for a couple of decades to get the benefit of this amended act ?(p.s.- I am not an advocate)

If an establishment receives Form F from employee, is it mandatory for the establishment to verify and attest the particulars mentioned by the employee in nomination form?
If yes, what are the penalties for not following the same?

If an establishment is covered with in the radius of 8 kms is exempt under ESI act?
And if the establishment is exempt in the above mentioned act, Is contractor employed by the establishment also exempt?

Only the plaint is returned to the plaintiff
The court which returned the plaint says that the new court will call for the records with them.
The new court is asking to file the plaint along with the documents.
What should be done.
Any citations.

There was an explosion of gas cylinder in a house ending two lives and injuring other three. I would like to know if there is any insurance cover on those cylinders or any other remedy should be availed.

Dear Sirs,
I am interested to purchase a plot in Jaipur (Rajasthan). The plot is owned by individual say "A" ( intially alloted by Jaipur Development Authority), wants to sale it to me but by drawing a power of attorney in favour of another individual say "B". In this transaction, the whole of the proceeds will go to "A". My query is :-
1. Is sale of plot / property through power of attorney valid in courts of law?
2. Is registration of the power of attoney drawn in favour of "B" be done beforehand sale transaction and registration of sale deed.What is the general stamp duty for such registration of power of attorney?
3. "A" is willing to be witness in the sale registration to be executed by "B". Inspite of this can future dispute be raised by "A"?
4. What can be the foolproof process where it can be checked that "B" has not done similar transaction of sale through power of attorney to some other individual/s ?
5. In the eyes of Law, the sale of a property which is registered will be considered genuine where another man who also claims right of property ( but which is not registered) of having been sold the same property by keeping the person in dark.
6. Is publishing a general enquiry in the newspaper about any claimant for plot is desired at the time of purchase and legally enough to protect one's interests ?
7. What general precautions should be taken for purchase and registration of purchased plot?

Petition for divorce and maintainence filed by wife
My wife has filed a petition for divorce and maintenance. She has left the house since last one and half years along with children. She is living with her parents with our children.She has taken all the belongings and valuables alongwith with her. She being an advocate, and knowing law, is harrassing us a lot. My father and mother are constantly falling ill, due to this pressure. Many of my relatives including me have tried to resolve the issue. But, she being very egoistic doesnot listen to anybody.Now she is claiming in her divorce and maintaintence petition a very huge amount, basically to harress us and take maximum money from us. I want the custody of both the children(daughters), since she is not concern about them. I have many a times told her to forget the ego for the sake of children. But, it seems she has found her conterpart there and hence not ready to come back to me.One is 7 years of age and other is 3 years. She has gathered many false evidences and charged allegation of adultry and cruelty. She had also filed an application in police while leaving allegating me and my parents that we wanted to kill her. But, the local police on enquiry found the application as far from truth. Even her parents are supporting her. It is very clear that their intentions are not good at all and they are doing so with the sole intention for money. I am living with my parents. I am the only son. The house is in the name of my father. It is constructed on ancestral land. Please advise me as to what stand I should take?
