A widow without any issue died in 2003 living a will-{not probated] the contaents has two parts 1]the ownewship flat she was living has been bequethed to her brother's son where no executor is mentioned . In the 2nd portion &to her other movable &immovable pptys. she has mentioned the name of her sister-in law as executer.the original will is with the executor.The benefishier is having possession of the flat &now wants to despose-off the ppty.but cannot because of pending Probate. It seems the executor seems nether interested in giving the original will nor ready to accompany for lodging it in for probate. kindly suggest the way-out.

hi. i m niyati a II year law student, got a moot problem..
a lady monica, after 4 months of marriage wih Rohan, filed a complaint for dowry harrassment. Rohan's family was charged under sec. under sec 3 & 4 of Dowry prohibition Act, 1961 and sec. 498A of IPC.During trial her parents his brother and other 4 people deposed as prosecution witnesses.
at this stage, rohan filed an application under sec. 3 of the dowry prohibition act and sec. 108 and sec. 120 of IPC. he has also challanged the constitutional validity of the Dowry prohibition Act, 1961
now what shall be Monica's arguments?

Respected Sirs,
In a civil case summons sent by registered post to opposite party.
Summons not returned back till today ie nearly 40 days.
Whether is it right that if summons not back in 30 days it will be presumed as served.
Any case law of high court or supreme court in this regard???

My client was declared quilty by the court and sent jail now case is fixes for 08/08/2009 for quantum of sentence,i want to know on the order sheet of quantum order my client name will be mentioned as accused or convict on order/Zimni sheet,,,,,,,,,,,,I explain the query with a sample order as (accused/convict present in policy custody with counsel Sh....)

USAGE OF CASTE CERTIFICATE
Please clarify whether one can use his/her caste certificate at latter stage while taking admission in any college for higher studies without submiting it at school secondary level.
In other words, whether it is compulsory to sumbit caste certificate at secondary school level or one can submit the same even later at college level.
