Max. amount to be paid in 24 HMA

Plz. tell me the max. amount which can be granted to the petitioner, as if I have displayed my salary is Rs. 4000/- per month.

Partition Pending : How to obtain stay ?

I have a partition application pending with the DRO for a common piece of land to be partioned between 3 shareholders.

I had requested for a stay against construction and sale of the land till it is not partitioned as the respondents are not very eager to have the land partitioned but eager to grab it by hook or crook.

As per the revenue officer, he is not empowered to provide the same.

However, i would like to know what is the best possible way to prevent a possible sale of the land or any contruction on it without it being partitioned.

1. I do not want to go to the civil court as that would prevent me from getting any police assistance if the need be.

2. Is there any way i can get a note on the Jamabandi regarding the pending partition proceeding. The Patwari is reluctant to help, so i need to know of a formal procedure that i can initiate.

3. What are the other ways in which the stay on the property can be obtained ?

Act u/s 125 (3) is specific. payment and liabulity are different issues,

Criminal law

I have a problem in a case that Some person committed a fraud relating to a big plot of Land. Accused created a false fabricating manufacturing document by a person in the plase of original land owner . Original land owner at present residing in U.K. When he come in india a hear a rumar that his land was sold by the caretaker of his property by false fabricated power of attorney of original land owner , then land owner filed a police report at police station then police started investigation U/S, 468, 469, 471, 420 , 34 (B) I.P.C.and arrest some accused and put then in the court. Court orderd for detention of the accused person . after some time accuseds file bail petition and take bail from D.J. (Patna) . After bail he submitted an application U/S. 239 cr.p.c. on the ground that this case nature is civil because a civil suit filed by the land owner. So Please help me and give some caselaw for disallow the petition of discharged .

Charitable Trust

Many innocent people now-a-days were facing lots of problems regarding legal and other things.

I think GOD has given a life to do something which can be realized after the death of human being.

In that inspiration I am intending to run charitable trust with regard to legal aid.

Please suggest the guidelines for how to register and how can be draw a road map for trust.

whether girlfriend can be proscequted 304 B ipc

Hello everyone,
whether the girlfriend of husband can be oprosecuted for offence of dowry death.
Recently the hon,ble supreme court has held that girlfriend does not come under the purview the word'relative'.
Similarly word relative is also used in section 304b of penal code.
So, whether she can be prosecuted, if anyone knows any caselaw please reply

i married to vibhawri on 6\7\2008.before that vibhawri married to milind on 1\1\2005.But milind expired on 17\11\2007.on 3\7\2008 vibhawri father took the rights(haq) from their ancestral property forcefully .will she get back her rights? can she file a case against her father?in which category it comes?

one divorced women have two major sons she married other man he accepted those sons also now he want to keep these sons as leagal heirs for his property my question is two sons legally father don't have any objection their mother's second husband can adopt those sons what is the procedure how they become legal heirs any solution for that in this matter i want to ask another question is at the time of divorce in divorce decree one para is mentioned that is those sons are not father responsibility from that onwards those responsibilities are taking mother now who will give adoption mather or father

Mortgage-Leasehold rights

Hi All,

Can a leasehold rights be equitably mortgaged? A leasehold given for a period of 30 yrs to a trust and the trust needs to avail a loan from the bank.

Please advise how has to create EM in favour of the bank?

1.The original owner
2.The leasee since the period of lease os for 30 years
3.The original owner and Leasee jointly since both have interest in the property
