Is there any time limit?

Dear Experts of the forum,

Here i have a typical problem : My father got some property through a WILL. But this fact was suppressed by some interested persons, and known to us only two years back. In the mean time my father fell sick and died. But, before his death he wrote a WILL on my name in regards to the above property. But sad part is this ( Earlier this was an Agricultural land )land made in to plots and sold to different persons and even some is occupied by Government(?).

What should i do now ? Can i claim this Land back ?

What role does Limitation act play ?

Can the plot owners claim this property under Adverse possession or under a reg. docmt.?

Can Article 226 is of any help to me?

Or, is there any course left to me ?

Please GUIDE ME.

With Regards,

Thanking you ALL.

PIL Against Govt and SC in Bhopal Gas Tragedy Case

"BHOPAL: Twenty five years after the December 3, 1984 Bhopal gas tragedy, a local court will issue verdict on June 7 against the Union Carbide and other respondents in the case.

CBI had chargesheeted Union Carbide Corporation, Union Carbide (India) Limited, Union Carbide (Eastern) Hong Kong, UCC chairman Warren Anderson and eight Indian officials for the tragedy on December 1, 1987. Thousands of people were killed in the gas poisoning."

Dear Learned Experts,

Though the current trend is to discourage PILs (in the name of 'Publicity Interest Litigation'), is it possible to file PIL against the Govt and SC for having failed to deliver the justice in time, in the above case?

SLP

I need a sample of SLP.

Secondly what question of law arises in following case-

that the Himachal Pradesh Public Service Commission (HPPSC) issued advertisement No.IV/2007 inviting applications for filling up 12 vacancies of Civil Judges (Junior Division). The advertisement specified that out of these vacancies two are reserved for scheduled castes, one for scheduled tribe and four for other backward classes candidates of H.P. resultantly, five vacancies could be said to fall to the share of the general category.
The non-appellant qualified the written examination also and was called for interview. The interviews were held on 9th and 10th of January, 2008. He made several requests in the matter, no letter of appointment was ever issued to him. Before the Hon’ble High Court, he contended that the State has made excessive reservation and has carried forward the reservation for scheduled castes and scheduled tribes and other backward classes for more than three years which is not permissible. The validity of the circular dated 26.7.1989 issued by the State of H.P. whereby posts falling to the category of scheduled castes and scheduled tribes can be carried forward indefinitely was challenged.

In CWP No. 1624 /2008 & CWP No. 1122/2009 the circular dated 26.7.1989 removing the time cap and making the carry over rule perpetual in nature was held to be illegal and liable to be struck down. The High Court held that the non-appellant shall rank senior to all the candidates selected in the year 2009 since he was selected two years earlier and should have been offered appointment at that stage itself. He shall hold that the seats of OBCs could only be carried forward for three recruitment years and no further. Consequently, the seats falling to the category of OBCs for the year 2009 shall be reduced by deducting the seats carried forward for more than three years and selections made from the general category candidates if found suitable.

Property Dispute in Maharashtra for Turst land (Inam III)

Hi,

I am from Maharashtra, This is about Trust land porperty (Inam-III).

Since around 1927 my grandfather was cultivating the turst property and after his death my father is cultivating the same land.
There is a letigation as in some person illigally purchased part of the land from one of trustees without taking permission from my father who is a PROTECTIVE TANENT in the same property. and the case has been files and the court declared that its illigal purchase and that person has been fined.

Now my father wants to purchase the land from trust. So the court mentiioned that the trust need to place a tender notice for purchse of the land and the highest bid will get the land. My father also can palce the tender bid.
However the court also mentioned that my father being PROTECTIVE TANENT, he will get first preference to purchse the land. As in if other tender bid is higher than my fathers bid, and if my father can pay the highest bid amount he can purchse the property. And if not then he will get 60% of the bid amount as he is PROTECTIVE TANENT in the same property.
The court also mentioned that even if my father purchses the land he has to pay only 40% to the trust and keep the 60% as he is PROTECTIVE TANENT.

So I would like to know if this is correct as per the law and can be done.
OR if there is any other option available.

PLEAS HELP ME TO KNOW AS SOON AS POSSIBLE.

THANKS & REGARDS.
ROHIT.

Exploitation in private hospital

Dear All expert,

I have admitted my mother in a private hospital at Kolkata for a sergery. She has gone for the sergery through mediclaim. Before the admission of my mother the hospital team had told me that the total expenditure for the surgery would be arround Rs 97000/-. But after the sergery yesterday they told me that the bill has been increased to Rs 1,52,000/-. When I asked them about how come this huge bill can be increased? They said some medical equipment has been put inside the body of my mother which I cant see now. Whether it is true I dont know. Even at the time of sergery they never told me about that addition sergical equipment. They said it was unexpected but thease equipment has been put in the body of the patient.

Now my question to all the gentlemen that can I get the information through RTI act that what is their actual cost for the OT charge, surgeon charge, other medical expenditure etc. After getting the information through RTI, can I file a court case against them? Pls advise .......

Because this was a very minor sergery but they are charging Rs 1,50,000/- for that.

Regards
Sidharth
