Mediation agreement mou in mcd

Dear Experts

My 498a 406 was compromised in mediation cell of the high court, and order was passed by the court which we discussed earlier the link to it is attached

http://www.lawyersclubindia.com/experts/498a-quashing-449081.asp#.Uvsgd_shJIw

now my quiery is should i use the same agreement as MOU in MCD as the terms and condition are same and this agreement is also mentioned in high court order

the mediation agreement includes all the terms like
1.filing of 13b
2.quashing of fir ,where she is bound and have no objection claus
3.payment through DD in second motion and rest half at quashing
4.return of istridhan( which we did after this agreement )

so is there need to make new MOU for MCD with similar terms or should i use this agreement as consent terms of MCD

Recovery

Dear member kindly advice on below mentioned query;

Our organization planned family get together at an amusement park and accordingly we purchased 600 tickets; however, we utilized only 570 tickets. since we notice the same only after 2 days that 30 tickets have been lying with us, we informed amusement park to refund the amount of the unused tickets to which they replied "that it can be used upto 90 days from the date of issue; however, the tickets which were issued were given in a discount rate which was valid only for that day when it was issued; however, if one has to used these tickets now then he / she has to pay full amount then only entry will be permitted."

Since there is no deficiency of service or negligence on the part of amusement park, is there any other legal mode of recovering the amount of unused tickets???

Since, my job does not permit to approach advocate except in an extreme special cases, self will be thankful you all for solving my query.

Purchase of resale flat

I am planning to purchase a resale flat in Pune. The owner of the flat (a young boy who was mentally retarded) has died. Parents have not been declared as the successors or the legal heirs till now. All the flat documents, property tax receipts, light bill are in the name of the owner who has died. What is the correct procedure to go ahead with the deal? Will the affidavit by tehsildar be sufficient and good enough to declare the parents as the successors or is the legal heir certificate essential to avoid any problems in future?

Regarding availability of "buy-out" option.

Hi,

I am an engineer working at a private IT firm "Paladion networks P Ltd" located at Navi Mumbai,
My query is that I resigned last month from my current company because I got opportunity to work at my desired location in another company.

When I joined my current company (Paladion) in 2011 the notice period to be served was 1 month, But after the revision of HR policy last year it changed to 3 months.

Hence I need to serve for the 3 month but that is not possible so I asked my manager and HR for the buy-out option (I am ready to compensate my 2 months salary if they are releasing me).
But to my surprise they told me that they don't have "Buy-out" policy at all in HR policy.
But I have seen people getting the same facility in past.

My questions are:
1. Is it possible that an employee has to forcefully serve 3 months ie can any any company enforce one sided rule like my HR team saying they don't have policy at all ?

2. And if policy is not there how they are given the same facility to other people in past ?

Please help me out ASAP because I am clueless and I am just watching my career getting ruined.

Partition suit by son

Please Solve this query

X died intested having 3 daughters[m,n,o] and 2 sons [ a ,b]..

after x's death his three daughter waived rights from x's properties.

so in revenue record A & B became owner of all immovable property. there is no dispute among all A,B,M,N,O...

Now A died in 2010
having one son P, & Three daughters E,F,G

till today no partition held between A & B or P, E,F,G & B...

so in revenue record P, E,F,G & B are owner of all properties.

now sons of P -R[major] & S[Minor] and wife of P -Z filed suit for partition against P,E,F,G,B,M,N,O as per Hindu law MITAKSHaR FAMILY -Coparcner right.

is suit maintainable ?

If yes then lead me defense for P,E,F,G,B,M,N,O ...

as per my view I am going to file an application under order VII Rule 11.
