There is a provision in the Employees Provident Fund Scheme 1952 (Para 26-B) regarding the date of eligibility of membership for the purpose of PF. Is there any such provision under ESI Act in case there is doubt of date of eligibility ?

PARTNERSHIP FORMED BY TWO PARTNERSHIP CONCERN ALONGWITH PVT LTD BEING JOINT VENTURE AGREEMENT. WHETHER INTEREST ON CAPITAL A/C INVESTMENT OF THE SAID PARTNERS ARE ALLOWED OR NOT FOR AY 2011/12
Policy - Group Insurance Scheme for L.I.C's agent(GIS)(find more detail on enclosed article)
Decease Agent - DA1
Insurer - LIC
Date Of intimation and claim form submission date - 13/02/2012
Deceased DA1 was the top agent of LIC ,who passed away on January 27,2012 due to road accident and then claimant approached to LIC for earlier settlement of aforesaid claim,However repeated visit to nearby branch office,Insurer replied to claimant that premium for aforesaid policy has been not deducted from Financial Year 2008-09 2009-10,2010-2011 and therefore no claim would be given.
However prior to taking LlC agency DA1 had given all right to insurer for deduction and as mentioned earlier DA1 was the top agent and gained smart commission so there was always enough amount presented into DA1's account for deduction but LIC Branch office said due to technical mistake premium was not deducted.
Having suffered from LIC procedure claimant approached to IDRA and filed a complaint and due to IRDA interference claimant received claim amount after 1 year and 10 months.
and as on IRDA guide line Insurer is liable to pay interest on delayed payment of claim, however when claimant contacted to CRM-LIC they says claim has paid to claimant as ex-gratia Payment and in such case insurer isn't bond to pay interest on delayed payment of said claim.
On this regard claimant again approached to IRDA and requested to escalate existing complaint but they recommended that you may present aforesaid case to insurance ombudsman .
should claimant approach to insurance ombudsman ? or what would be another remedy for this ?
Please download L.I.C -GIS-Booklet from following link, I have tired to upload many times here but donno why it says connection unplugged .

My Writ Petition wp 21313/2013 in HC of AP is pending since Jul 2013.My advocate says he has put all his efforts to draw attention of the Hon-ble Judges to my case which involves admission of my daughter to medical 2013 against her EAMCET 2013 rank (OC/OU 2318) under CAP quota. He had written three letters to Registrar (Judicial) as well. The case is pending. Some of my well wisher says it is because there are too many 13 in my case number. My erst-twhile advocate said that bar in AP is divided. My interaction with registry official confirms that there is booming business of issue of cheats sorry chits. One of the advocate in this site has drawn my attention that it was fault of my advocate by not insisting on listing under education instead of Women and Tribal welfare as it is not a welfare matter but education of my daughter. Initially it was listed under Justice Rao against his portfolio for women welfare. But he probably understood the game and directed my case on 19 Jul 2013 to Justice Nooty who was responsible for eduction matters. It was taken up on 8Aug 2013..and two weeks time was given to GP Home and not GP WOMEN WELFARE. bUT CASE STATUS STILL LIST MY CASE UNDER WOMEN WELFARE..
nOW THAT I AM THE PIP fighting the case and an hon-ble member of this elite club would somebody tell me how do I get my case title changed to Education from Women welfare which may the excuse for the registry as well as LOBIS to keep my writ in the ONWARD list or listed at the bottom of the cause list so that it is neaver reached..??
Respected Sir's.
The Landlord has filed an eviction suit in small causes court against Tenant for illegal additions/alterations without written permission from Landlord.
The illegal work was carried out by Tenant in 2006 and immediately after entering the premises the Tenant stopped paying the Rent. The Landlord asked the tenant to pay up the Rent but Tenant did not give any attention till 2009.There was No written correspondance between the Landlord and Tenant nor the Landlord complain to BMC against Tenant as both the parties were in mutual correspondance and in very good cordial relations.
However till 2009 when the Tenant didnot tender the Rent or Taxes the Landlord sent a notice thro his advocate and terminated the Tenancy rights and after second notice when the tenant did not pay the rent for third time a suit. after which there has been extensive correspondace between both the parties and their respective Advocates. Also the Tenant has filed a suit on BMC in City Civil court for challenging the MRTP order served by BMC on Tenant for restoring the suit premises as per plan.
The Landlord is for cross examination. However the Landlords Advocate has told the Landlord that since YOu have not entered into any written correspondance with the Tenant from 2006 to 2009 your suit is in trouble.
Is it true or he is just trying to frighten the Landlord.
Please advice
Thanking you in advance
