Ancestral property dispute

Hi,

Our grandfather had three children's, My father and two daughters. He had 3.5 Acres of agricultural land, 9 cents of land, and one house which is a ancestral).

My Aunt's got married before 1986 and given some agricultural land as dowry (0.5 Acre to Elder Aunt and 1.0 Acre to younger aunt). But, there was no registration happened regarding this. All the property has been registered on my grandfather's name.

After my father's marriage in 1987, he's living separately and didn't take any property or cash. Our grand parents living in their house and surviving themselves with running a shop and income through remaining land. We're two sons to our parents, Elder aunt had a son and younger aunt had a daughter both got married.

My father was died in 2004 then onwards my mother taken care of me and my brother. My Grandfather also died in 2008 due to some health problems. My mother bared all expenses while he's in hospital and other activities. Then we asked our grandmother to live with us, but she refused to living with their daughter.

After few months our aunts get transferred all the property to our grandmother(By changing name in passbook since husband died). And then my grandmother registered reaming property to my aunt(Elder) and her granddaughter. My grandmother sold the 9 cent of vacant sight.

They did all these without knowing to us. Recently we came to know all these registrations and all and asked our share. We're ready give their share, but their not at all accepting to give our share.

Could someone help us on this issue. I would like to know about below points:

1. All these registrations are valid without our signature(mine and my brother).

2. Is there anyway to stop further transactions on these properties? Now, they're looking out to sell all assets.

Share in property

Experts Please Advice,

My brother has a property in Delhi. My name is not on the title. He has now agreed to give me 30% of the sale proceeds when the property is sold. He is not willing to give me gift deed or relinguish deed but He is ok with doing some kind of agreement or putting a Lien or mortgage on the property.

Please advice what legal document can be made so I can secure my share whenever the property is sold.

Thank you

Public interest litigation

Dear Experts,
Please give your opinion upon a case given below :
A person fighting against illegal mining and mafia in a district, for this he had started fighting from many days he wrote many complain to concern department like Police, DM,BL & LRO etc, and brought many information through RTI, he accumulated many evidences like news paper cuttings which itself prove that the illegal mining is running in its optimum level.
But no punitive action had been taken by the concern department appointed by Govt.because a share from that business were distributed to them also.
At last he filed a PIL under Article 226 of The Constitution Of India, in which the Respondent where the delinquent officials and the mafia engaged in illegal excavation, the Judgement of Honorable Court was that, a direction was passed upon the concerned Police to take a step to stop the illegal jobs which were being conducted by the help of Govt. Officials.
My question is :
1) If the Judge has reason to believe that the Respondent were not performed their duties they are one who give shelter to the mafia to carrying the illegal business and causing harm to the national properties, then how the order were directed to them for stoppage of the illegal business, because the document produced before the Hon'rable Court is sufficient to prove that entire department is involved in the said business.
2)If after the order passed for stoppage of the same, regardless of the order illegal business is running in its original form.
3)What to do next if the police, DM or other Department is not following the order of Court.
4)Is there any other option to call for Justice.

Execution of warrant out india.

Hello Madam/Sir,

I am a practising Advocate from Hyderabad. I have a query:

A private complaint was filed and the judge has taken the cognizance of the offence and the court has issued a NBW in the year 2012 against 3 of the Accused who are residing in USA.(The complainant has approached me at this moment, as their previous advocate could not succeed in executing the warrant).
What i have come to know is According to Section 78 & 166B of Cr.P.C a Warrant can be executed outside the Jurisdiction.
Now the question arises:
1. How to execute the Warrant out side India?
2. First do i have to file a petition in the court for look out notice? If yes then under what section?
3. If a warrant can be executed U/s 78 & 166B of Cr.P.C? What will be the format of the Warrant? (If anybody have it plz mail me on kanth.naveen@gmail.com)
4. Is it better to write a letter to the Indian Embassy and US consulate about the offence?

Thank You,

Naveen Kanth.
