Resignation by office bearers

Would like to know about what happens when Chairman, Secretary and Treasure resigns together? In our society Treasure resigned one year back but requested to continue.. Then last month Secretary resigned and this month Chairman. office bearers are opting for Re-Election and confirming that they would not nominate themselves. Re-election can not happen til Oct 2014 due to non appointment of Election commissioner. I feel when office bearer resigns, other two office bearer have rights to accept / Hold/ Reject resignation with reasons and those reasons to be recorded. As they haven't resign simultaneously re-election point should bot hold right.. Can other MC members accept resignation one by one date wise and co-opt for new members? In such what step other MC members need to take . MC members total strength is 9 and if office bearers resigns they still have 6 members left.

Second question can a member become MC member of two difference societies? one where that person stays and second wherein he is having a associate membership from hi father?

Need your expert advice..

Minimum time take for judgement in small causes court

Hi

Our is the case related to Tenant (pagdi) Room in South Central Mumbai.

The Landlord wants to Redevelop the building but is not ready to make the Agreement.

He has filed a case on us in Small Causes Court for our eviction. We have appointed a Advocate for our defend. But now it seems our Advocate has joined hands with the Landlord & he is telling us that we will lose the case in small causes, which initially at the time of taking the case he was very much positive.

The case was filed only 3 months ago.

My Querry is

1) What is the minimum time taken by Small Causes Court to pass the Order
2) Can we change the lawyer in the middle of the Case & what effects will have on our case
3) How can we find out what reply our lawyer has filed on our behalf in small Causes court
4) Our House Rent is pending to be paid in the Court. Our Advocate says that when the court will direct, we will have to pay the Rent. How will we know when the Rent has to be paid if the lawyer does not inform us. Can we pay the Rent in the Court directly now without informing the lawyer

Please help me

Thanking You

Agreement between my brother's in laws and my family

Hi Sir,

I need your help for legal agreement between my family and my brother's in-laws.
From last 5 years, my brother's in-law's and her wife are threatening my brother and my parents with 498a and suicide . Even she burnt her suit and took expired medicines. My parents are in deep depression with this metal torture. she had many times beaten my mother and purposefully created problems. Now she is at her parents home form last 8 months. We tried many times to fix this issue and even they ask some political persons to intervene. And even after that they are continuously threatening us. Also she made many false allegations against my parents, brothers, me and my wife for which she later denied and we proved it with recordings. Now it has been decided by member panchayats that they will give us written assurance from their family that she had made false allegations and she regret that and she tried to kill her son and herself deliberatly just to put us behind bars. And in future if anything like this happens from her side then it will be her responsibility . No body from her in-laws side will be held responsible for that.

Kindly let me know the legal wording for this so that we can prepare the legal affidavit to proceed further.

Thanks & Regards
Rohit Pahwa

Confirmation deed required from 1st seller

Hi Team,
i am planning to buy a old house in Bangalore near KR Puram. i applied for Bank loan, as well i have given all property documents to personnel lawyer.

Personnel lawyer verified and signed everything OK. but Bank legal team said, we require a confirmation deed from 1st seller.

i am buying from 3rd owner
example
( Person A sold to--> Person B) with registered GPA and sale deed.
(Person B sold to --> Person C) with register GPA and sale deed.
(Person C sold to --> Person D) with registered GPA and sale deed.

Now i am trying to buy from person D. i got all previous GPA and sale deeds.

But Bank saying that they require confirmation deed from Person A.

At present we are not able to trace Peron A. if i trace him, what type of confirmation deed do i need to get from person A.

Though i requested BANK many times and other details, every time they are saying confirmation deed, confirmation deed, not giving much information.

Any suggestions how to proceed further?

Regards,
krishna Rao
