I had entered into an agreement with a chit company for a chit of Rs 5,00,000/= payable at Rs. 25,000/= per month. I paid my instalments for the first eleven Months. On the 12th month, I bid for the chit and received the chit amount against all the securities and a cheque of Rs. 2,00,000/= being the future instalments for Eight Months at Rs.25,000/= per month. After that I paid two more instalments and I had a dispute with one of the partners of the firm. therefore, I stopped the instalments. But after one month, the company presented the Cheque of Rs.2,00,000/= without any information or notice to me. At that time, the amount payable was Rs. 1,25,000/= which the company has admited in the complaint and filed a case u/s 138 of NI Act. Can I fight the case, with an agrument that the amount due was only Rs. 1,25,000 and the amount of the cheque was Rs. 2,00,000/= and therefore I did not honour the cheque. Is this case maintainable under sec 138 ?
I left my last company almost 10 months Back and at the time of Leaving my salary for Total 25 Working Days was onhold with company
I was told the same will be Cleared in Full & Final Settlement .
After 5 Months of Leaving that company and after my repeated mails to company I was Given a Full & Final settlement letter ( Copy Attached ) by the company asking for my acceptance to take that settled Amount.
Which again was not paid even I was ready to take that amount.
Now the company has accepted the liability for Dues pending for Payments to me in written
Pl suggest
1. under which provisions of C P C I can file a Civil suit for Recovery
2. How to prove the Authenticity of that Mail Received by me which was send by the company using company domain for Full & final settlement
( which is now the accepted Liability )
Recovery Value : 45000/-

We inherited a property in Mumbai wayback in 1989 through a will, which was contest with a forged will brought in by neighbour, this matter is in the court at arbitration stage.
This neighbour sensing that he is not making progress coaxed a relative to file a claim on the property, can anyone file such a claim after 24 years. If so how do we combat such a fraudulent move , so that matter can be delayed further.we are also a adopted family to the property owner

Please suggest How to file complainant against accused persons who are released on bail and now not appearing before court , till now 6-8 times, with impunity though the complainant/ witness is appearing to depose her evidence?
What would be the befitting procedure to file complaint before same magistrate u/s 229 A of IPC (Punishment for failure by person released on bail or bond to appear in Court).
Should the magistrate entertain such complaint u/s 190 (1) of CrPC?
Does it have any impact of Sec 195 and 340 of CrPC?
A partnership firm with 2 partners father & son.Another 2 daughters are married. Immovable property is in the name of the firm. If after death of father, what is the position of the firm? Will it become proprietary concern of the son automatically? Whether signature of 2 daughters is required at any point?

Dear Sir,
One of my client is a work contactor and he is being asked to obtain PF number by his contractee department.
Please enlighten me about the procedure to obtain PF number.
Thanks and Regards.
I am appearing for a complainant. The accused has obtained an Anticipatory Bail and the case has been numbered and the charge sheet is yet to be filed.
I doubt that the accused might flee out of country to avoid the legal actions.
1. Under which Sec of Cr.P.C gives the complainant to seek the Magistrate to direct the Accused to deposit the Passport.??
How tanent can get protection against eviction
Dear Sir,
I have had agreement(Rs.10 stamp paper) with landlord at New Town,Kolkata for 11months which has just expired on 31st March'14. Though the agreement has clause to extend the tenancy further with increased rent and I had verbally told landlord at the beginning of the agreement that I need to continue to stay till December'14 and he was agreed at that time. But agreement extension has not yet done. Mean time landlord has sold the flat to other person without giving me any written notice to vacate. Though ownership handover/ registration is pending and its going to happen in 2nd week of April'14. Now Landlord is asking me to pay the rent for month of April'14 and willing to give receipt for the same. But my worry is once ownership handover/ registration done by middle of this month and then if the new owner ask me to pay the rent for this month again, in that case what kind of legal help I can get. In that case Can I approach to West Bengal Tenancy Tribunal for help.
Can any one please help me. Its very urgent.
