Dear sir,
please guide me.....
There is a issue regarding full & final settlement claim after resigning a job. I joined a company in May'13 and resigned a job in Ma'14.
In my offer letter, there was a clause for performance incentive-entitlement of performance incentive could vary based on individual performance and paid to confirmed employees only.
After that in my appointment letter, there was a clause for performance incentive-entitlement of performance incentive would depend on company as well as individual performance and will be payable to those who continue to be on rolls till 31st mar of each year and will be paid after completion of the appraisal process.
Sir, my query is that...
1) There is any remedy for me to claim performance incentive because at the time of offer letter they are not told me about the condition of PI as per appointment letter.
2)I also worked late hours, which is also not paid to me. There is any guidelines for late hours working in the labour law for harassed persons.
Please sir, help me....

Hello Friends,
Wife Filed Divorce under HMA Section 12 after 4.5 years of Marriage with the ground
that she has been harrassed for Dowry (treated with Cruilty) & she has been deserted for last 4 years with 498 & CrPC 125. Husband Objected the Divorce under Sect 12 after 5 years & requested to close the case as Sect 12 is not valid ground after 4.5 years of marriage.
Husband is already having the RCR decree.(Ex-Partee as wife never appeared for RCR in court)
Now wife has requested to Court with modified affadavit that it was a typing mistake
& the case need to be modified under CPC Section 6 Rule 17 from Section 12 to Section 13 1(a) & 13 1(b)
Husband objected strongly.Judge threatened to Husband for Contempt of Court.
Judge asked husband to provide say on their modification request.
Husband's lawyer is always saying from the begining that it is a typing mistake.
Husband already submitted in his say that since he has RCR & he want his wife back, Please close this case. What are the possible options open for Husband for his reply to this case?

Dear Sir/ Madam,
A customer booked a flat. The costumers brother who is also a estate agent filled and signed the booking form on behalf of his brother who is the costumer. While filling his name, he inadvertently mentioned as "Ramesh Kumar" which was in regular use, instead of giving his name as appearing in revenue records as "Ramesh Mittal".
All correspondence was made by the builder in the name of Ramesh Kumar. The customer has paid the instalments as and when demanded by the builder through the bank account held in the name of Ramesh Mittal and the corresponding entries are reflecting in the books of the builder.
Now, when the Agreement for Sale is required to be registered the costumer realised that the name in the records of the builder is different from his name in official records and has accordingly requested the builder to register the Agreement for Sale (AFS) in the name of "Ramesh Mittal" instead of "Rakesh Kumar".
As a builder we wish to know as to what precautions we should take before executing the AFS in the different then that appearing in our records?
What documents/proofs should the costumer provide to the builder to satisfy him that both names are of one and same person and no legal issues would be created at a later date?
Regards,
Sachin

Letters patent appeal abolition
Hi I just came across THE MAHARASHTRA HIGH COURT (HEARING OF WRIT PETITIONS BY DIVISION BENCH AND ABOLITION OF LETTERS PATENT APPEALS) ACT, 1986 which came into force from 18th March 2013.
As per my reading u/s 3 of the Act appeals from under any statute instituted or commenced, whether before or after the commencement of this Act, shall lie to the High Court from a judgment, decree or order of a Single
Judge of the High Court made on or after the commencement of this Act, whether in the exercise of
the original or appellate jurisdiction of the High Court.
hence in such a case an appeal against an order to conditional leave to defend will lie to the Supreme Court and not to the Division Bench of the Hon'ble Bombay High Court?
Please help..!!
