What are the provisions for defamation under CRPC, against a news article NOT at all based on facts and maligning the image and tainting the character of a woman. She was falsely implicated in a case where her husband had committed an offence under NI Act. The police defamed her name and fame which she had earned by being a professional AIR singer.The police officer there gave statements not at all related to her and the case where she was falsely implicated.
1.Can she file for defamation & Against who the case will be registered?
2. Does she have to have a FIR for this or file it in the court as regards defamation suit.

There is security Cheque being bounced in my account to clear a personal loan amount I am aware there are few pending dues on me but i am still paying my loans not by ECS directly as a cash in to the concerned bank I still have time to pay the complete loan till 2016 but the recovery team has gone head and deposited the security cheque which was issued in 2011.
and they did say that the loan will be recalled.
Loan financed : 310000
According the calculation total outstanding comes to : 226170
per month EMI is : 7539
dues pending : 30137
Installment paid : 196033
interest paid : 90774
Principal paid : 105259
over due charges on me : 14014
But presented cheque amounting to : 217912 which I am unable to understand kindly provide some advise. I went to the bank and asked them to give some time to pay the overdue amount they say they will 1 days time to pay the overdue amount or i have to face consequnces please advice.

Today the lady/Complaint was examined, She made statement under Crpc164 today were in she which said a lot which she has not said in Crpc 161.
Will it be called improvisation.Will it benefit me/accused.
When asked about the demand she said the list which i have given in police station is list of demanded & i have given it to my inlaws as they demanded,when asked why she has not given receipt/Voucher of these items to police she said. She replied that I have given receipt/ Voucher to my inlaws so they were not with her.In crpc 161 she not said anything about Voucher/ receipt.
She also said in Crpc 164 that accused has demanded house,but she has not said anything about house in her Crpc 161 or in her complain.
She was asked in cross examination that does she have ATM,she replied yes but I used to keep it with accused.
Sir My point regarding ATM was basically different, I have got her ATM details were in she has made all ATM Transaction in the month in which she claims to be thrown out of house by accused & inlaws from her parental house & that too in early morning & late in evening which i almost 30 KM from place.So it didnot worked the way i wanted.Actually she was already at the her parental house two months before which she allege the date of occurrence .Will it create any problem
Please advise are they Contradictions/Improvisation. Will it help me/accused any ways.

The summon order for speed post , Registered AD and Courier was made by Hon'ble judge in the first date in April 14.
All these I arranged to be posted. However, only courier out of these was delivered and acknowledged by the recipient.
Now the next date is Oct 16. My question is do I need to deposit the summon delivered note of courier to the Court to put in file before the next date ? or it has to be given to the judge on next hearing.?

hi i live in the city of mumbai and went to new delhi to file an slp. I have filed an SLP criminal in the supreme cr of india last week and the vacation started. now I had also filed the Affidavit of urgency with my slp, but it seems every efforts are going jn vain. While I was in delhi till the 16 of may from 7 may. but had to return back to mumbai cause no dates were given to me though I had filed the affidavit of urgency and since I am in person, I am not allowed to go inside the crt premises to mention before the judge my problem that my life is in Danger. now I want my date somewere in the first week if june but am not given. can someone help me in such case.

Hello experts' can I claim the land of my grandmother who is expired in 1983.and also my father is expired in year 2004.my grandmother brother's are fighting for equal share the land which is ancestral.my doubt is can I claim the land as the land being ancestral and notdivided into equal shares no partition.please give me a suggestion experts.

what is remedy if my father has given his signature on blank papers or stamp papers under undue influence or by their own will , so that such papers can be used for claiming share in property which is under forged will of my grandfather.
IS THERE ANY EFFECTIVE REMEDY AGAINST THIS.

Respected lawyers,
A lady (Neighbor) filed a false case u/s 354/509 in early 2013 near to Delhi gangrape Sad incidence. They have been demanding property expansion over our house since 2007 to which we have been resisting.
Case is in Prosecution evidence stage. The lady came once for partial cross questioning in December 2013 where she gave statements different to police statement in a confused manner. She was answering yes and no for many questions which has been recorded.
They threaten us outside the court to settle the case while in front of honorable judge they say that we are threatening them to settle the case. I am fighting case with 100% honesty and attendance. But now the lady is not coming to court for cross questioning since last three court dates despite being bound to come. They just want to delay proceedings and make it a long case.
What should be my next course of action? Can I apply for discharge application? I have some police complaints against the lady and family before case registration to prove that FIR is motivated and filed for property expansion.
Need Quality advice. My MBA studies and career have suffered a lot.

sir,i am a mohammadean ,my elder brother who was married died recently .After five months of marriage ,his wife filed a complaint case before the court contending that my brother i.e her husband is demanding dowry and harsasing her along with her family members but instead of filing a case under section 498(A),she filed the case under section 406/506/34 i.p.c.The magistrate after taking cognizance ,recording stamen t of my brother's wife and his father -in law and issued a search warrant.but during this period ,my brother expired and at the time of his treatment in hospital she never visited the hospital and subsequently after two days staying in hospital he died and we paid for his treatment.my brother do not have any children from his marriage.now my question is that how can we deter his wife from getting his retiral benefit .our mother expired but our father is alive and he is paralytic and was dependant on my deceased elder brother for his treatment.can our father claim any right in our deceased elder brother retiral benefits? Then how and where and under what law pls specify and presently what precautions we can take ,can we sent a legal notice through an advocate to the authority under whom my deceased brother last worked stating that my father and rest of his brothers are legal heir to my decesaed brother,and apart from his wife can we do that ,pls advised.and lastly what forum we can approaced and what will be the content of our petition .

Dear Experts
My brother's wife had left him for 4 yrs and came back through court one year back.He is in Army. Brother was not agree to call/take her back because of her cruelty (she put many allegations on him like he beats me, abuse and many more)but at last our lawyer also turned and made pressure on him for compromise and take her back. Also the judge pressurise him to take her back, but he always refused that I Can live with her she is very cruel and can do any thing and put me behind the bars.But finally by pressurising him they agreed him and send her back. She also confessed I will change my self and live with him.
3-4 months every thing gone well but after her real color started to come out and the same things starts repeating.
Last week she quarrelled with brother for money, brother said I will give money you required in morning, how can I arrange in night. She made this dispute bigger and hit her head with wall 3-4 time and injured her self and shouted he beated her and called the police.But fortunately there was retired police inspector in our village handled the situation and not let my brother to arrest.
Sir, we are in this situation please guide us how can we save our self.
My brother is a COW (Wo gaye hai,)please advise how we can save him and our family from this cruel & cleaver lady.
