Hi
I am resident of India and planning to buy property from NRI. I have read through some articles and not sure about TDS%. Property is bought by seller from builder and is held for more than 3 yrs
1. As per latest provision if immovable property is bought exceeding 50 lakhs then TDS of 1% needs to be deducted by buyer
Question - Is this applicable if bought from NRI
2. Since this is Long term capital gain, would TDS of 20% needs to be deducted of SALE price
Question- This rate is too high.
3. If property is jointly held by couple, would 2 TDS certificate needs to be issued by buyer in proportion to sale price.
4. If seller wants to reinvest the proceeds, but as a buyer how much TDS needs to be deducted.

X1, X2 and X3 are brothers having ancestral lands L1 and L2.
Partition and division happened among them. As per partition deed, X3 relinquished his rights from L1 and L2. L1 went to X1 and L2 went to X2. Mutation entry for this partition marked as M1.
Afterwards, after 4 years, X3 filed suit for partition in trial court and obtained decree of 1/3rd share in L1 and L2 by fraud. X1 and X2 filed appeal against this decree in district court. Meanwhile X3 made his name on land record of lands L1 and L2 based on trial court's decree. This mutation entry was M2. This M2 was completely illegal as final decree was not carried out.
After M2, X2 and X3 sold the land L2. This transaction marked with mutation entry M3.
X1 challenged mutation entry M2 as it was consisting his land L1. Revenue Authority declared M2 as illegal entry and ordered to set aside M2.
After this order, X1 went to Tahsildar to remove X3's name from L1 land. Tahsildar is refusing to remove X3's name with following reason.
According to him "Illegal mutation entry M2 consists of two lands L1 and L2. In case of L2 one more transaction happened and M3 carried out. X1 needs to challenge the sale deed as well to remove X3's name from L1".
X1 is not capable to challenge sale deed and M3 as he was not party(either seller or purchaser) for this illegal transaction. And also sale deed happened before 15 years. In such case, what is the legal remedy for X1? Your views with reference to citation are most welcome.

Can you please enlighten me with the meaning of the terms - Remainder man, reversionary or a devisee in the following -
"Where the suit is by a remainder-man, a reversionary (other than a landlord); or a devisee the possession of the defendant shall be deemed to become adverse only when the estate of the remainder man, reversionary or devisee, as the case may be falls into possession;"
We had ancestral property which came to My Grandfather in 1951 (by partition)and he passed away in 1990.
He had 2 sons and 2 married daughters. The sons are managing the properties without any involvement of the daughters since 1990. The Land and BMC records also have the son's names.
What are the terminologies above mean with respect to the daughters.
iduring proceedings under Hma 26 in main u/s 9 pending,my daughter has seek temporary custody/ ocaasional stay of her minor 7 year old child with her at her own house during his school summer vacation. The child is already meeting mother regularly during visiting rights under dv act and she getting interin maintenance under crpc 125.
Under proceedings hma 26,the judge found the child turning hostile towards mother's However, the judge rejecting the application ,he convened separate in-chamber meetings with both lawyers, parents, etc and stressed petitioner mother, and made her agree to go to her matrimonial house.,also knowing the fact there is bitterness among both parties.Being father of petitioner mother, should we send our daughter to her matrimonial home as per court direction? However, the judge (Sr.grade) respective distt.couts has mentioned all cases against respondents shall continue. So what is rational behind it.We are confused and my daughter is so depressed that she has lost all faith in courts but I still have. Please advice should she go against all odds.Once she left her home to matrimonial home she can't leave that place without permission of her matrimonal members of joint family and court knows that too.My daughter life is at stakes with no option but to end or live

hma 26 case
iduring proceedings under Hma 26 in main u/s 9 pending,my married daughter,a housewife, has seek temporary custody/ ocaasional stay of her minor 7 year old child with her for 8-10 days at her house during his child' school summer vacation. The child is a school going, atpresent is living at my matrimonial house with his father who himself is living with his parents in joint family .The mother is already meeting child during visiting rights under dv act and getting interin maintenance under crpc 125 from husband. Under 26,the judge found the child turning hostile towards mother's However, the judge instead rejecting the application ,he convened separate in-chamber meetings with both lawyers, parents, etc and stressed petitioner mother, and made her agree to go to her matrimonial house.,knowing the fact there is bitterness among both parties.Being father of petitioner mother, should we send our daughter to her matrimonial home as per court direction? However, the judge (Sr.grade) respective distt.couts has mentioned all cases against respondents shall continue even she go to her matrimonial house. So what is rational behind .Why the judge ask wife to continue living where she was once thrown out by her husband with cases of crpc 125,dvd act still pending against husband. under this situtation,.We are confused and my daughter is so depressed that she has lost all faith in courts but I still have. Please advice should she go against all odds.Once she left her home to matrimonial home she can't leave that place without permission of her matrimonal members of joint family and court knows that too
