Case law on section 60 of registration act 1908


Sir,
Greetings. kindly furnish me citations of Supremecourt/highcourt decisions on Section 60 of Registration act 1908.

Am interested in those decisions where it is held that non compliance of Sections--34(1),34 (3) (a) and 25 of registration act doesn't give the indispensable foundation of authority and jurisdiction to issue certificate of registration under sec 60 of Regn.Act 1908.

Cheating done by bhutan travel agency

Dear Sir/Madam,

I had traveled to bhutan between the period 13th to 20th of June. I had booked a complete package from them and it was an all inclusive package, it included the stay, car with a driver and an exclusive guide.

The hotels and all were ok and as per expectation, but the car provided was a non AC one and also they had mentioned on mail that they will show me a place called Wangdue in BHutan which was not shown as the permit of it was not taken from the capital city Thimpu. I had spoken to them and also put a mail to them regarding these issues,they told me they will resolve it but they didn't.

I had to forgo and cut short the visit to this place and also had to deal with a substandard service wr t the car. I have also come to know that the air tickets charged to me were quite high than the usual ones charged for indian nationals { indians have special fare to travel to bhutan}

They had charged me seperately 13k per head for a return airfare i.e Kolkata paro Kolkata, I Had checked online and found out that the airfare offered to indians were a little cheaper i,e at 8k for return fare. Since the fares were charged separately and I had to do a RTGS, have requested them an invoice copy for the same as they would have paid the air fare to the airlines.

They are still not providing the invoice copy and are also denying that no one can offer at such low prices the tickets. I have told them that probably the carrier would have charged them extra, so kindly provide the invoice copy of the bookings. They are now not responding on this request as well.

I have told them that as a client, I am entitled to get a proper invoice copy of the airfare as it was charged seperately by them.

Can I take this matter legally or thru a consumer court with them? In case they have actually paid the same amount to the air carrier then they shouldn't have a problem giving me an invoice right?

Need all your views on this matter and how to take this forward. The issues here are deficiencies of services and providing incorrect details of the air fare.

Re-argument after transfer of magistrate

Sir,

Argument on both the sides was over and I was expecting a favorable judgement. Now the concerned Magistrate has been transferred and a new Magistrate has taken charge and has suggested to begin the argument all over again.

Any remedy?

Interstate divorce case transfer

Dear experties...
I have filed divorce case (march 2013) in Hrishikesh (Uttrakhand)after that girl filed a complaint in CAW cell,nanakpura(Delhi).After 15-16 dates and failure of mediation FIR has been loged against me( 498/406/34) but even after 7 months chargesheet is not submitted by police.
Meanwhile In Divorce case (Hrishikesh) her application under 24 was rejected as they are not present in the court.
Now on last date i came to know that they have moved to SC for case transfer and SC has put 2 month stay on our divorce case.
Till now i havent received any notice from SC.
Her father and other relatives are in delhi police and due to the interference and harrasmnet i had left delhi.In past,they even tried to influence CAW proceedings.
I was born and bought up in delhi and even marriage took place in delhi itself but due to girls family interferences and to save my old parents i have relocated to uttrakhand and from last 1 year i am jobless.
Pls suggest what are chances of case transfer and whether it is worth to contest this transfer?
In how w much time ill b get this TP notice from SC
What are the outcome of this transfer and its affect on pending 498/406/34..
If the divorce case gt transferred can i request the court to put all the cases in same family court and hearing on same date..

Governement pension

Sir my clarification is regard to family pension we are Hindu. My father was government employee he death in service 2001 .in government records (SR Book) second wife and son name mentioned, and first wife son name also mentioned. In mutual understanding between 2 wifes regard job for first wife son and pension for second wife. We applied for pension along with family tree but in AG Office they sanction pension for first wife. When first wife is alive then second wife not eligible for pension they said. Know pension and job are they enjoying from last 10 years last 2 years back first wife also died. Sir please answer me now second wife is eligible for pension? In Government record second wife name is mentioned.( first wife is Christian they marriage in one temple they showing temple certificate)

Status of a statutory authority

A statutory authority under a state or central Act are apparently artificial juridical person. Similarly, a deity too is an artificial juridical person. Therefore, while applying for PAN, the status ought to be 'Artificial Juridical Person'. However, the problems arises, when such authority or deity is also 'charitable' institution. If its status is filled up as Artificial Juridical Person for the purpose of e-filing of return of income, the option of filing the return in Form 7 (for approved charitable institution) is not available unless the status is filled up as AOP (Trust), which is not the status as per PAN registration, and other problems showing mismatch arise. What is the remedy for this problem? What is AOP (Trust), it is not defined in the Income Tax Act, 1961?

Consumer forum or civil court ?

Dear Sir

We have gone for redevlopment of Mhada Building in Pantnagar,Ghatkopar, Mumbai with a Builder.Builder demolished the building with our concent before bringing IOD.Now Builder want to reduce the area in agreement saying as he have loss in Project as he have to give some stock to Mhada.

Above matter will be trated as consumer court or Civil court ? as he is not provided service but agreed to provide & demolished the building.
