Can a restitution of conjugal rights
be filed even before responding to a
section 13 cruelty divorce case?
In this case husband filed divorce
petition on cruelty grounds.
Counseling failed. Instead of
responding with counter on the same
case, wife filed restitution of
conjugal rights petition. Is this
case maintainable? Can the husband
oppose filing RCR until
Section13 case is brought to trial?

Dear expert,
child custody case was filed by me ,court order for, visitation right to me .during visitation I notice that my son is very much fond of her mother , seeing that I decide not to try separate them ,but I will meet my son weekly as per court order , my question is 1) is it possible to withdraw the case but visitation right order till, effective ? 2) later can I pray for modification of that order (if required ) ?
in a partition suit, one of the defendant who purchased the ancestral joint family property, even after filing his WS, failed to aduce on the part of his evidence. Suit for partition was decreed agaisnt. Subsequently, the purchaser preferred an appeal on the grounds that proper apportunity was not given by the lower court. Is it a proper ground to prefer an appeal. No further grounds are mentioned
