Sending notice to the tenant before filing the eviction petition

My grand father has acquired a house with shop on main road at khammam.that house came to my father after his death. now my father is also passed away.as per hindu marriage succesion act that property shall be equally divided and is a joint property.but my brother and my mother alone signed on rent agreement without my concern and taken 3 lakhs advance and collecting 28000 as monthly rent and they are alone sharing without giving a single pisa to daughters.Can i send a notice to the tenant directly eviction petition.what notice period i have to give what are the documents i have to produce in the court of lae and how much it costs?

Property share

sir,

If "x" is a grandfather and died without any will leaving his ancestral property (not self acquired) but property was on name of "x"(grandfather)

His only son "y" is enjoying the property after "x" death and "y" doesn’t have any siblings to share property.

Now does “y”son (“X” grandson) who is a major get share in that ancestral property in life time of “y”?

Because “Y” is enjoying the property alone without giving share to son though he was major.

Agriculture land passbooks were updated on “Y” name after the death of “x” because he is only child.

But now weather grandson of “x” has right on property to claim because he got married and have his own family burdens?

no will was left by grandfather “x” when he was expired and still land records are running in name of grandfather, only passbooks were updated on “Y” name.

Is property law same to all states in India? And this is Hindu family.

Character assassination by husband

Dear Lawyers/ Experts,

I want to file a case on my husband for assassinating my character. I left my husband and came to live with my brother family since I wanted divorce from that miser. Ours is a very big family and we have reputation in our small town. People are conservative and they do not understand that I left my husband because I hate him. My father told everyone that I left my husband because my husband had illicit relation with some other girl. I told everyone that he used to beat me after drinking wine. And he used to live on my salary. We did all this to keep our dignity and not to harm him only in our town and not in his town. But some of our people informed him about what we said.
To take revenge he started telling people that I have illicit relation with my female friend & I want to live with her in her flat. I have filed dowry case to keep his money and jewelry. He also sent sms to everyone about my salary, his salary and all the details of our marriage, claiming his innocence. He has also sent some sms to my father and my brother saying that if I get pregnant, he will file a case of adultry against my father. He also sent love & sexual sms for me in my fathers mobile saying that it is only meant to be read by his wife(me). I have not given my no. to him so he is doing all this to get my mobile no.
Pls guide me if I can file a case of blackmail and defamation against my husband.

Non institutional written on date of birth certificate

Hello,

My son born on 17/04/2014, There was mistake in my name in his date of birth certificate. I submit any application in municipal corporation office in delhi on 15/06/2014.

Now, I am checking the status online. My name has been corrected. But, Date of place is showing as non institutional instead of name of the nursing home. In the previous date of birth certificate place of birth was correctly written as the nursing home name.

What is this and What should I do to get it corrected.

I am currently living in Delhi.

Adverse inference if witness doesnt appear

Ld Counsels,

Husband came to know about the illicit affair of wife with another person. He sends summons to the person who had illicit affair but if he chooses not to appear before court and enter witness box can the court take adverse inference against the person provided husband proves the affair by way of frequent phone calls exchanged between them.

Mother and father are very old crossed 80 years and not mental fit

Dear Experts,

My Mother and fathers has crosses 80's year of there life and not they are not mental consuse they have 2 farmer lands and 1 bulled on there both of names. my relatives always try to take benefit of there mental condition and always try to get registry from there they are still not doing the same but some time they can do it. is there any process or law to stay there rights to sell or transfer to others name or relatives ?

Encroachment

Hello Sir/Mam,

I have shop, i am doing the business from since 1980 and we paid all taxes till now, but 2 year ago the Municipal committee came for break the shop and we resgiter the case agains then we won the same and after that they the muncipal committee given the shop on lease for 15 years and we paid the cahrges as they requested and agreement also done,but in out city now new comminsioner came and they brok the shop and they declare that the place going for town planning so they are thrown to us.As pe legal law we have agreement and they take the charges so how they destroyed the shop then we have case against then , as per court we have order from court, but they are not ready to accept.

Please suggest for same and need help.

Can I buy next house, only my name from capital gain amount.
