I got married in 2010 and right after the first year, I have been facing severe issues and harships because of which I am continue facing lot of problems living together with my wife.
These are the issues I have been facing:
- Mental harassment and verbal abuse
- Severe mental agony
- Abnormal behavior, suicidal threats, and tendencies
- Extreme mood swings
- Lack of trust and confidence
- Filthy language and vengeance attitude
- Emotional blackmails
- Violent at most times
The following are some of her ways of threatening:
- Get into a room and say she is going to hang herself
- Go into the kitchen, have the gas on and say she was going to blow us up
- Lodge a false case against me and parents for dowry
- Get away from the house in the night around midnight.
On 14th April 2014 she ran away from the house in the midnight at around 12 o’clock and then I call my In-laws when my in-laws came my FIL, MIL started screaming on me and my mother (widow+handicapped) I was shocked to see such sort of behaviour from my In-laws instead of giving good advice to their daughter they started screaming on me, I felt disheartened that what kind of illiterate in-laws were. After verbal argument for 2 hours thy left their daughter and told me that I was asking for dowry and other baseless allegation. She is living with me but no change in her behaviour she is not respecting me my mother.
We were relatives before marriage (close relatives marriage) and also I have one daughter.
My Wife qualification is B.A. (correspondence ) and I am B.Tech degree holder.
My in-laws lives in east delhi shahdara and I belong to Bareilly (marriage took place in bareilly)
Could any experienced eminent lawyers advice me on this?

Hi,
My wife worked in Cognizant and quit almost 3 years ago but She is still struggling to get her F&F Settlement, Relieving and Experience letter.
She has been following with Mr. Senthil and other departments and the whole scenario is too funny I would say. There has been no formality pending from her side as She has not been asked to complete any left over procedure.
The HR department says that She got to pay them some dues and obtain a clearance certificate to get Relieving & Experience Letter. The She spoke to Mr. senthil from finance dept. regarding the amount She needs to pay but he said that after all calculations, The company has to pay her Rs 80,000/- and once the payment is done, HR will get clearance to issue other certificates. He has been promising the payment to be done by end of month since past 10 months. The worst problem is that the Organization is not dealing with freshers but senior engineers with over 10 yrs of experience. I have really never seen such a disorganized and employee unfriendly organization in my whole career which doesn't respect the people who have contributed to its success.
I am planning to take legal action on this since I have all mail communication with me and follow up call detail records. Please suggest way forward.

Is it prohibited under Hindu Succession Act in respect to sale of share in unfregmentated residential house bequeathed to shareholders Vide a will of person to his wife, two sons and one daughter had each equal share viz 25% in one three storyed house.
Actually, One brother dies nad his wife after getting her 25% share transferred in her name , sells the house at Chandigarh where partition by metes and bounds is not allowed. Such 25% of her share of the described house was sold without getting her share determined by Competent Authority/Court and put the purchaser in possession of whole first floor and one parking garage (i.e. excess of her share). What can be done by other shareholders now, besides filing suit for partition? Can sale deed be cancelled as the third party was in notice of her share 25% in joint house?

I wish to know the legal procedure to ask previous owners of a property to vacate after the property has purchased by the new owners.
Also, are the laws for the same subject different on the basis of the price of the property (say more than Rs. 1 crore)?

please tell me what are legal things we should know about diffrence between filing of summary suit and normal recovery suit?
for filing summary suit, there should be written debt acknowledgement by second party through bills of exchange or promissary note?
if we dont hv bills of exchange or note, can we file summary suit?
case is somebaody owe my money,i have raised invoice against him/ bills,now he is saying i will not pay you are charging extra money..
he has sign the agreement in which there is clause that he will be liable to pay amount raise by invoices..
by advocate told me we will file normal recovery suit and i knw it will take years for justice.. i want summary suit? advocate said conditions are not fullfilled for summary suit hence we cant file..
experts please guide..will appreciate

We were residing away from my hometown(close to my in laws place) and I was posted away so I made the GPA on my mother`s name so that my parents can look for better tenant and sign the rent agreement in our absence but in Era of rapidly deleting social & moral values,my wife joined hands with her greedy parents and had the desire to settle permanently close to them.
In fact my wife had expressed her inability to look after the hometown house with the malafide intention to sell the house but with positive attitude I made GPA on my mothers name being unaware of her malafide.That is why she immediately filed the suit for P & M Injunction and simultaneously filed DV case u/s 12 and harassed me by all worst possible mean ways to compel me to sell the house.
That after sometime my wife withdrew the civil suit by submitting before the court.
Statement in Hindi read ditto as follows:-Byan kiya h ki mai Prtvadi ko Hamare Ghar me aane se kabhi mana nhi karungi Aur Hum sath-sath sukh -shanti se rehenge.Mai apni taraf se kisi prkar ki koi Anaitik(Amoral) batt na karungi.Moujuda Dawa Vapis Leti Hu.
Court reader also asked me to sign the prewritten statements and the Hindi written lines read ditto as follows:-
Byan kiya h ki Mai Vadhiya ko apne ghar me sukh -shanti se rakhunga aur kisi prkar se tang nhi karunga.Hum khusi-khusi sath rahenge.Na Hi Mai Ukt Makan No 1234/6 Ko Bachne Ki Chestha Karunga.(I will not intend to sell the house number 1234/6.)
That the Court order of the same day also read ditto as follows:-Written statement and reply to the stay application not filed.Same to be filed on 10-08-2010.Plaintiff has submitted that she wants to withdraw the present suit.Now to put up on 10-08-2010 for consideration on that point.At this stage one date is requested by the plaintiff.
And the final court order on 10-08-2010 read ditto as follows:-Heard.In view of the statement made by the plaintiff,Neelam on 21-05-2010,present suit of the plaintiff is hereby dismissed as withdrawn.File be consigned to the record room,after due compliance.
That as my wife in collusion with her parents was all set to flee back close to her parents with the proportionate sale amount and tried to implicate me in 6 total false criminal cases including All out poisoning case and created the circumstances and threw me out of the house.
That then to save home from permanently breaking and for the children I gifted my house to my both parents.Now again she filed the civil suit for PI and for the cancellation of the gift deed in pursuance of my statement given(I will not intend to sell the house no 1234/6) during previous suit.
Kindly advise as the previous suit was withdrawn by her only.That she is staying in the house and getting maintenance under DV case.

We are getting the joint registration of a flat. Joint registration among father and daughter. Flat was allotted to father. Daughter paid all the dues, even home loan EMIs are being paid by her.
Now, what is the best method to get this transferred to daughter..Partition deed
Succession deed or release deed.
What is basic difference in these deeds.
As Gift deed is not permitted by the Organization.

Dear All
We are a christian couple, we got married in Goa in the year 2008 both civil and church. Me an my wife met in Dubai and decided to get married. soon after we got married and went back to Dubai all hell broke lose. Communication being the most essential part of marriage was never happening inspite of having our self under one roof. My wife started to do financially well compared to me and disrespect was slowly spread over me. Because of the sour marriage I went into emotional displacement and became an alcohol abuser. During my alcoholic period I went into complete insanity. Anyone who knows what alcoholism is all about would understand me. I lost a lot in my life due to this, coming down to zero financial status. I left everything and came back to Goa last year and took help for my Alcoholism. Now I am sober since 2nd Jan 2013. We have a son, born in Dubai in 2010 and currently living with my wife in Dubai.
My wife came down to Goa this year in Feb and asked me for a divorce which was very heart breaking for me, inspite of me trying to get a hold on to my life. I don't want this marriage to break but I am helpless and knowing the fact that I would lose custody of my son is even more devastating.
My wife got her birth registration done for Portuguese nationality and is now asking for my signature to register the same for our son. I know that If I do that she would move out of India with my son.
I have not received any legal notice for divorce yet, but as for my wife she says she wants a amicable divorce.
Could you please advice what should I do to safe guard my interest in an amicable divorce. Even if I don't want the divorce I have no choice. I believe that everyone deserves to be happy in life and if divorce is what she thinks will keep her happy I have no choice and to let go.
