Divorce and maintenance

1. After marriage wife started to misbehave with family members.
2. To save marriage husband shifted to separate accommodation.
3. Wife left matrimonial home when husband was not in home taking all money, ornaments and cloths.
4. A missing dairy lodged at local police station.
5. A month later a general dairy lodged by husband claiming wife taken husband’s money and ornaments while she was missing from separate accommodation.
6. Husband files RCR.
7. In reply wife files 125 CRPC and 24 HMA.
8. Husband withdraws RCR as reconciliation failed twice.
9. In the certified copy of RCR judge order “RECONCILATION FAILED”
10. Husband repeatedly requests wife to live in his family but dishonored.
11. Wife wants to live with husband in separate residence from the family of husband.
12. No FIR lodged till date against husband but a general dairy lodged calming husband refused to accept wife.

Question:
a) Can husband file divorce on the ground of desertion (as two years passed) and cruelty?
b) If yes, what are the evidences requires? Is there any merit of the case?
c) If any other options please advice.
d) Husband earn
Gross salary Rs 30000
Gross salary after govt deduction Rs 22000
Net salary after private deduction Rs 8000
How much amount may be granted for maintenance?
e) Can above amount be converted to one time lump sum? My opposite party wants monthly maintenance.

Right to agriculture land for daughters in uttrakhand

dear sir,
my self is the daughter of a father who has expired recently without leaving any will.He left agriculture ,residencial as well as commercial property which he owned himself.we are two sisters and three brothers .do we daughters have right on this property especially on agriculture land.
My father had already given some recidencial and commercial land to my two brothers who have done construction on it and my father had given them power of atorney .Does this power of atorney work as the same after the death of the giver.

Conversion of criminal revision application to writ petition

Sir/Madam,

We filed Criminal Revision Application in Gujarat High Court against the refusal to discharge us in CBI Court under Section 397 of Cr.PC.

Now, it has been decided to convert this Revision Application filed in Hon'ble HC to Writ Petition to enlarge the scope of the decision making.

Kindly inform the process to be adopted for this conversion in Gujarat High Court.

Bye-laws on transfer fee of co-op society

Dear experts
please help...

I have a plot in a sehkari avas samiti registered with awas vikas, uttar Pradesh. The society has registered the plot in name in 2003.

I want to sell the plot.. the society says that the transfer fee is 10% to be paid..

Ques 1 : is it legal to charge such huge amount? Society says its in the bye-laws by government

ques 2 : can this fee be reduced by the committee through any resolution or any other process lawfully?

as this amount is over and above the stamp duty to be paid by buyer and agent commissions to be paid by both sides. this huge transfer fee is keeping the buyers away....

Husband got exparte divorce and application for setting aside exparte decree is pending filed by wife .Wife also filed petition for maintenance under dv act.
My query is whether the suit by wife can be continued and any interim order can be passed against husband till the exparte decree is not set aside.

Hma 24 & crpc 125

1. My Wife put her Divorce Application in Oct 2013. but She filed HMA 24 Application separately in May 2014.

Husband opposed the HMA as capable of earning & presently working. She was working before marriage & husband ready to maintain her as he already have EX-partee RCR decree in his favour.
In the court also wife saying that she want divorce & do not want to join husband.

Inspite of this Judge passed the HMA 24 order in summary manner of Rs 1500/- from October 2013. After husband presented review application with all wife's job proof, for the HMA 24 order, judge rejected review application with Cost of RS 2000/-

Can the HMA 24 be decided in Summary Manner? and this order from Oct 13 is maintainable?
Isn't it wrong as wife applied separately in May 2014.

2. Husband paid wife Rs 6000/- as Interim maintenance under HMA 24, and submit the payment proof in CrPC 125 requesting Stay of proceedings in CrPC 125, as wife already getting maintainence under HMA 24, but the CrPC 125 Judge also rejected this application.

Please answer is CrPC 125 maintainable after wife get interim in HMA 24?
