Greeting to All,
I live in small Registered society where 6 members out of 8 members have appointed Redeveloper without following Bye laws or GR of Mah. 79(A).
1) Society is registered.
2) Society does not have Conveyance.
I being Secretary have tried to explain the legal process of GR 79(A) and redevelopment, however Chairman and Treasure and total 75% i.e. 6 members are not willing to listen and understand.
Chairman have called SGM with following Notice.
NOTICE
As resolution passed in majority in SGM for dt..... for the redevelopment and Secretary has voted against it, which create technical problem, contradiction to move on further.
AGENDA
1) Whether Secretary is to continued on his post or he should resign and hand over the charge to other person/member.
QUE. 1) Can Society Majority force me to sign MOU as Secretary, where redeveloper is appointed with out Conveyance and without following GR 79(A)?
QUE. 2) Can they force me to Resign if I refuse to sign MOU?
Thanks in advance.

Mr Raj Makkad Sir,
We are a condominium in Gurgaon who conducted its first elections under the above Act in June 2013 when the builder moved out and handed over to the RWA. 10 residents were elected uncontested. Since June 13 to date, 10 residents joined and resigned from the Board due to misbehaviour and malpractices by 2 members.Currently 2 of the original Board members who refused to resign despite the residents having lost faith in them + a new joinee still continue.
As per our byelaws, the quorum is 1/3rd of 10 so 4 members must be there for it to be legally able to conduct the affairs of the RWA. The residents demanded fresh elections. The RWA put up a notice on OCt 15 saying elections will be held
We have complained to the ROS who has written to them to explain the malpractices stated by us.
No election date has been fixed and is purposely being delayed. We had asked for a neutral election officer to be appointed and an observer from the ROS for conducting elections
MY questions are
-Does the Board dissolve when it drops below quorum?
-Can these 3 residual memrbers continue to sign cheques and carry on the business?
-Can the majority Residents with voting power take a decision and call and conduct fresh elections?
-OR do we have to wait for 3 residual members to call for election?
-OR do we have to wait for ROS to appoint an election officer and observer?
I do hope you can give some insights as I see you are very knowledgable

resp. sir(s),
i am a practicing advocate. my query is as follows:
when we apply for the registration of any engineering product under the designs act 2000, we pay the requisite fees and then we get its acknowledgment wherein date of application and it's number is given.
we get the certificate of registration after a year or two. under the circumstances my question is that .....
after applying for the registration if any other person attempts to copy our design which is pending registration and tries to sell that product in market what protection we get against this? further how to prevent that other person from selling that product in market?
There is piece of Agricultural Land which was given by the GOI to Scheduled Castes in 1972, And the Land was suppose to be given in the names of all family members.
My Uncles father was not at Home during the distribution so during that time my uncles Uncle said to the officer that as my brother is not home you can give the land in my name & once brother comes from other village after few Months, we distribute among ourselves equally.
As that time the panchayat where strong, the The Uncles Uncle gave the assurance in the Village Temple in front of Other relatives that once his brother is back he will Transfer his name in it.
Now here the Both the brothers expired & their childrens are left. And there was not attempt to distribute that land to is Brother names. & after his death the children of the that person took the land.
But from the pressure from relatives & other village people, the childrens allowed that the to cultivate to their cousin who is suppose to be the 50% owner of the land.
since 30 Years this is happening but in 2012, the childrens in whose name the 7/12 are there removed his cousin,
Now my uncle is without land, and who is suppose to be 50% owner of the land.
The Land is in Gujarat.
Can what can be done.

Dear Sirs, when my relative in Mumbai made an Affidavit on a 100 Re. "franked" paper and went to get it notarised, the notary did the following: (1) put his stamp on all pages. The stamp has his name and registration number, (2) affixed a red seal (sticker) on the first page, which also bears his name and registration number, (3) affixed 5 stamps on the first page. Each stamp is of Rs.5/- and "Notarial" is mentioned on these stamps. Hence, total value of "Notarial" stamps affixed was Rs. 25/-.
When my second relative in Jaipur went for notarisation of an affidavit on a 100 Re. stamp paper, the Notary did not affix the (1) Red seal (sticker), and also did not affix the (2)Rs. 25/- stamps with "Notarial" printed on them.
My queries are:
1) What is the correct term for the red seal?
2) What is the correct term for the stamps with "Notarial" printed on them?
3) Is it possible that the red seal and the "Notarial" stamps are applicable in Maharashtra and not in Rajasthan?
4) Is an Affidavit invalid without the red seal and the "Notarial" stamps?
Thanks.
Rti act 2005
Dear Experts
I need advice from you
I have been asking a file copy under RTI Act 2005 from AP State Government Department, which is not responding for the past 2 years. Earlier I sent several remainders and sent a request in CC to CIC of Andhra Pradesh also, who did not taken up any initiative
As I have no trust on CIC of AP, recently I submitted the entire correspondence to Central Chief Information Commissioner. Truly, I don't know how quickly the CIC takes initiative to resolve the issue as recently came to know that near about 22000 pleas are in pending at CIC of India
Can any one tell me which department (central government department) monitors the successful implementation of RTI Act 2005. Can I have any response, If I approached them?
Please guide me
Thanks and Regards
