Father evicting adult unemplyed son from property

Hi,

Want to know if an unmarried adult son can be evicted from property (not ancestral)in name of father. Previously employed though currently unemployed.

Son Not dependant upon anyone for finances. Not having issues with other family members living in the same house.

Not abusive towards father though father is loud with other family members, drinks regularly. Verbally abuses and threatens son for life and dire consequences etc.Father is currently employed

No eviction notice has been given in written.
1.Can the son continue to stay by claiming right to property?
2.Can cops be called to force eviction in absence of court order?
3.Whats the minimum time period provided by court for an eviction notice for this situation?
4.If the cops are called can son refuse to visit chowki or respond to questions unless an eviction order is shown?
5. To what extent can son expect to extend the minimum period in court notice on grounds of being unemployed?

Thanks.

Use of open space land adjacent to house

Survey No.32 open space land(agreeicultural) attached to my neighbor mutually used for 50 yrs by us and Survey No.33 open space land attached to our house used by my neighbor putting one shed for storage.

Recently quarrel eruped that our house waterpipe outlet passing by his shed blocked by neighbor. We told him to remove since water is not passing as usual and it is our land. We asked him to shift. But he refused to do so. We lodged police complaint to remove blockage. Police advised and transferred case to Tahasildar. Tahasildar advised for survey, which was conducted and found land Survey 32 is his and Survey land 33 is ours. Still he refused to shift his shed to his place Survey.32 from Survey 33. The case in Tahasildar's office is on 30-1-15. My queries are:

1. What Tahasildar will suggest
2. If he refused to shift his shed.
3. Do we need to file civil & criminal case(under which Sections).
4. We are reluctant to approach court as lengthy litigations. Any other remedy.

Experts kind advise is solicited

Validity of a legal notice

Dear Sir,
I have sent a notice to my tenant to quit and vacate and deliver the flat, of which he is a tenant since 2003. He defaulted ( most likely intentionally ) in payment of rent since more than a year. The notice was posted on 10.11.14 and served to him on about 10 days later and acknowledged by him. The postal acknowledgement card was been received with his signature. It was mentioned in the notice that he should deliver the khas possession of the flat on the last day of December, 2014 and therafter suit for eviction shall be filed against him. Before, the notice was served, he was planning to sublet and often brokers visited his place. After the notice was served, now, I don't see any one of them. Nevertheless, he has not paid any rent till date and buying time. Some local people say, he is depositing rent with the rent controller. As of date, I have still not filed any suit of eviction. My question is that, what is the deadline by which I need to file an eviction suit following the said notice to my tenant. Are such legal notices, time barred for cause of action? If so, what is the tenure?

Regards,
Sabir
