Crpc 125 and dv 2005

my husband replied of my petition and wrote that he wants me and ready to keep me. but he is not appearing in court to take me and his lawyer denied to opt for mediation center.
i want to know will he ask for divorce if he do not keep the words he wrote. i dont want divorce if settlement is done with certain matters discussed.... what i should do.. alimoney is not a major thing i demand the matter is to make him free from blindbeliefs and liberate him from bawa.. so next he should not ask me to go to bawa. so.
i dont want divorce what should i do???
if he is ready to take me i am ready to go.
but he is not coming in court.. he just filed the answer and it is pending??? what should i do..
does 125 means divorce??

Pending divorce, wife breaks the lock and enters the matrimonial house

Dear Experts,

Divorce matter between husband and wife, is pending before the court. But wife, in absence of husband or any of his persons, goes to the matrimonial house locked by husband, break the lock and enter the matrimonial house. Neighbor and watchman do not object because they know she was staying with husband in that house.

Now my questions are--

Does the wife has right to enter matrimonial house when divorce petition is pending before court?

Will it amount to cruelty if husband throws her out of matrimonial house in above scenario?

What remedy available to the husband in above situations?

Joint property with father

Dear Sir

My Name is sachin I carry a commercial property in ghaziabad with registry in name of me and my father.
100% finance is done by me but not mentioned in papers.
we are three brothers, so do my brothers hold any rights now or in future on the said property.

Ration card rules for defence servant

I am a Ex Defence Person and fighting a case to evict one notorious tenant from my ancestral property. I am not having any ration card post joining Defence. But the oponent lawyer is disturbing my parent saying that as I am not having any ration card at my native place, I will not return to native again.

Just want to clarify what is the Ration Card rules for Defence pesonnel on joining Defence service.

Admission of case

Sir i have filed an appeal in Supreme court on the Judgement of High court of AP Judicature.The Diary number converted into SLP(appeal) on 24.02.2015. My opponents have already filed caveat in the court.
What is the further procedure? and when will it be admitted? What is the approximate time for the further stages?

Application to issue commission

Respected experts,

In a civil court case, disposal of 6c ( temporary injunction) has to be decided on 2nd March 2015. The court had asked both parties to submit written arguments on 19th feb’ 2015. We are respondents in the case and have submitted our written arguments in the court but the other side is trying to keep this issue pending. Their advocate has asked for the time to submit an application to send the case to commission.

I request you to kindly explain the meaning of sending the case to commission.

An early response shall be highly appreciated.

Name change in tamilndau

Hi All,

My son is 4 months old. Need to make change in Name.
He don't have any document other than birth certificate.

My queries are.
1. Is it possible to make change in Birth certificate by approaching corporation? Since the name is used only in birth certificate.

2. If I have to go via Gazette process. Is it enough, if I produce my address proof. Since he dont have any document other than birth certificate.
3. If I have to apply Passport for my son. Do I have to advertise in news paper or change in Gazette is enough?

Excess fare ticket receipt

During my journey from Ahmedabad to Rameshwaram on 3.2.2015, the TTE has collected an amount of Rs.4820/- vide receipt No.EKT- 119210 being the differential amount of fare in absence of correct identity proof showing my age. The ID proof shown to the TTE was not showing my age and therefore he has demanded the differential fare and accordingly I paid the same. He has informed me that I will get the refund subsequently.

I am therefore herewith forwarding the following:

Is rtc correction possible

In the sale deed it is mentioned the sale of "ONE and HALF ACRE" of land in words,but in that same deed the mentioned measurements doesn't equate to One and Half acre of land,it equates to 28 guntas. 1)EC has 1 and half acre recorded in it as per words in the deed. 2)RTC has recorded 28 guntas according to the measurement in the deed. My doubt is, can we get the rights over the remaining 32 guntas legally? NOTE:Deed was registered in 1917.
NOTE:Part of the land is still vacant

Transfer of property post father's death

We are two sons and a daughter and mother left post father's death. Can someone pl help on below questions-

1. Is a Succession Certificate necessary to be obtained from the court? What is the percentage of court fee charged of the property in Mumbai Civil Court?

2. Does obtaining a Succession Certificate mean that every asset shall have 4 owners who will deal jointly with such assets? - Or the Court assigns each asset to a different heir basis valuations?

3. Is it possible to transfer individual assets to nominees named therein basis an affidavit and an NOC of other 3 members?

4. If the daughter intends to claim a share in the property, should a suit for partition be preferred over a suit of succession? What is the difference between the two?

5. If a Suit of Partition is initiated, will the court assign individual assets or joint ownership of all assets.

6. In case of assignment of joint ownership of all assets, can one heir dispose of his share in the property - subject to nature of such property and asset class.
