Noc format from sibling.

Hi,

My Flat is in my grandfathers name and he passed away in 2004. Before he died he had nominated the flat to my Father(50%) and mother(50%). So now we wanted my parents name to be transferred to the share certificate and also do the changes in the society register. Society is asking NOC from my Grandmother and my Uncle (fathers brother). They are ready to give the NOC.

1) I want the format for the NOC.
2) Should the NOC be on a stamp paper, if yes what value stamp paper.
3) Should i get it notarized.

Property

My father died without writing a will and he had promised that the house we reside will come to me. He had already contributed quite a lot of money to my sister to build her house which was around twenty years ago but there is no proof for it as he had paid cash and no receipt was taken. There is some money kept in fixed deposit which will be given to her after my mom breathes her last and land in native place which was purchased by dad two-third share of the property is already given to her. As there is no will return by dad the flat where I am staying is divided among three people, sister, mom and me. My mom have already gifted me her share of the flat to me by a registered gift deed (as per last wishes of my father). so I am the two- third owner and my sister is one third owner, In the society and share certificate, my mom is absolute owner of the flat. My mom has not disclosed to my sister about the gift deed. My sister is now insisting that she wants 50 percent share of the flat. She is not willing to settle for anthing less. She and her husband had fought with me for this. Now they are keeping quiet as mom will be affected by this but after her death certainly she will fights or have legal tussle for the property. My sister is well off monetarily, they have a 2 BHK flat at Powai and I am without any flat of my own. I don't want to have any fight and also get my two third share of the flat. Can you please let me know if the registered gift deed can be challenged in court, if challenged, whose favour will it be in. Can any memorandum of understanding can be made my mom and ask my sister to sign that she will not go to court for the property.

Please advise what best to do.

About obc - ncl for nri at gulf

Hello Experts, Greetings. Is a son or daughter of a NRI parent eligible for OBC - NCL for IITJEE /NIT admission? . My main concern is about Non- creamy layer . The income of the parent in India is less than Rs. 6 Lakh per annum only.

The father also does not belong to a class I or class II officer in Gulf.

Please clarify.

Caw and 498a

can a person file directly 498a instead of going to caw. or is it more effective to go by way of caw .
also if the victim left house 2 years before and filed complaint in women cell after 1.5 years, then is it still valid for filling 498a. as i have heard that a victim need to file it within 2 years. in this case will the date of case registration willl be date of registering case in women cell or the date women cell sends it to court?

EXPERT PLEASE GIVE REPLY.
A SCHOOL TEACHER AT SIKKIM, AND MY SALARY COMES FROM HRDA, AND MY INCOME IS RS. 5 LAKHS PER YEAR. AND NO TDS HAS BEEN DEDUCTED FROM MY SALARY BUT AS PER INCOME TAX LAW MY INCOME IS ABOVE TAXABLE LIMIT.
SO, SHOULD I GIVE MY RETURN PAYING SELF ASSESSMENT TAX OR INCOME EARNED IN SIKKIM IS EXEMPT UNDER SPECIAL ECONOMIC ZONE.
PLEASE TELL ME AS SOON AS POSSIBLE, I BELONGS FROM BIHAR AND POSTED AT SIKKIM AND LAST DATE IS NEAR FOR FILLING OF INCOME TAX RETURN. PLEASE TELL ME UNDER WHICH SECTION ECONOMIC ZONE IS EXEMPT.

Contempt of court

The court has ordered interim stay on the department not to proceed further on termination of service and has given a returnable notice by giving 45 days time. But the department has terminated without taking into account the stay.

Does it mean contempt of court?

What is the remedy available?

Hello
I am in central govt office that is central railway & recd a decree on my name thru Central railway.
Order is for payment of compensation of Rs. 35000 to be paid by central railway as liable vicariously for their negligence of employees within 30 days from Order date 3/2/2015.
I am innocent in this case but my administration had entangled me by giving wrong reply in RTI made by plaintiff.
Administration has decided to go in appeal but our law dept said there is no merit in case.
Now I want ur advice what to do .
Admin has not made any correspondence with me in this regard but had taken my sign on vakalatnama.
Pl help me out.

Substandard flat work

Dear SirS),
We have purchased flats. After taking possession,we came to know the various deficiency in construction.
The builder is not ready to attend these deficiencies on the pretext that these should have been pointed out prior to formal take over. The same was very difficult to check unless we started using the flat.
The builder now insisting to attend ourselves.
Deficiencies are like uneven floor level, water logging in balconies & bathrooms, elecric & phone wiring faulty.
Is there any remedy ?
Kindly advise.

Registration of settlement deed without the presence of settlee at the time of registration

Can a father execute and register a settlement deed for his apartment at Chennai in favour of his son even though the son is presently out of country?

Is the signature, thumb impression & photo of the settlee (son) required at the time of registration of settlement deed?

Divorce petition by husband

My client's husband has filed divorce petition. what should i suggest her. his behaviour towards my client was not good from the beginning. Moreover her parents gifted some property to her husband that he has already sold for doing business and for children's education. She has two college going children. Now he has filed divorce petition and is telling her that i will keep children with me, you perform second marriage. he has mind washed the children too. Should i suggest her to ask for alimony in turn for divorce and lead her own life? and shall the alimony include her parent's property that he has sold? Please suggest.
