Have to file a case for divorce through the husband since he has found his wife to b involved in xtra marital affair for which he has mobile records available.
Can some1 help in guidance and provide a format for drafting. Also the child is 3 yrs old can the husband claim her custody.
Also the wife alongwith daughter is in other city. Can I file case in my city if yes how.
Can u also giv referance on the order of SC by virtue of which the wife gets case transferred at her native place or how can I restrict her in filing other cases against husband like 498a or 125.
Pls help. Tnx in advance.

Query raised: I have submitted my return through online by filing ITR-4 for the assessment year 2014-15 on Oct'15 and clain refund Rs.22,784/- according to 26AS statement.But in the month of Jan'15 the I.T.dept give me only Rs,5,057/- without any reason.Later my complain the Dept respond that mismatching of TAN.I filed a rectification within 7days but it was rejected without any reason.Then within seven days of issuing Sec.143(1) order I filed a revise return by claiming rest of the amount..But till date I have not receive.Now I.T.Dept respond the below mentioned words:
Resolution: Dear Taxpayer, Rectification Return has been filed after the due date, Hence, Revised return is treated as invalid as per the Income tax Act.
Please advice what way I get rest amount as refund.

Dear Sir!
I lost one of my unsigned cheque and in fact the same was stolen by one of our acquaintance and the same was presented with forged signatures in the bank by him which eventually got dishonoured with the reason 'signature differs.' I got to know about the same when I got a legal notice from the said person. I however replied stating the fact that I had lost that cheque and the cheque did not bear my signaturee at all. The expert also verified that the signature nowhere resembled with that of mine. The expert report is also lying with the court as an evidence But the case is still pending.
Please suggest me the future course of action.

Hi,
We have a bunglow in the residential area of about 5000 Sq ft and our compound wall on all sides are so small and we need privacy in our bunglow to use the garden and swimming pool.
Is there any legal restriction for the height of the compound wall.
We need to take around 15 feet high for privacy. Is this height ok legally?
Please guide us legally to build.

an family dispute both parties did amicable settle Rs.2,00,000/- and paid by husband. but at the time of passing divorce decree judge revealed the fact that wife is minor (17 years) at the time of marriage by school certificate of wife.
can husband plea for judge to return settle Rs.2,00,000/- at this circumstance or file criminal case against wife or her parents because marriage had solemnized by parents.
second question can judge pass the valid divorce decree in this stage.
third question if judge pass the divorce decree which he will void, voidable or valid marriage decree.
this question for maintenance if judge pass the valid marriage decree than wife certainly claim for maintenance.
this is unique and technical question all respected seniors
please provide any supreme court judgement so that i can assist to my little brother he is going on metal as well physical agony.
one more fact wife last month has got married her deceased sister's husband.
so please help us.

I had taken few loans from unknown parties through an finance broker ( not alive now )
Paid out these parties interest and also part payment of some amount via cheques
Due to dispute with the broker ( when alive)
Broker make these parties launch security cheque (without date) in bank after filling the date of full loan amount
I make stop payment, they filled cases against me u/s 138 claiming full amount
Without reducing the payment made before launching of cheque
They asked me to pay full cheque amount in notice , in their suit, in their statements and affidavit
Since payment are done through cheques
I can prove the same in court too
My lawyer is asking for doing compromise
Which I don't want to go cause I am feeling cheated
Please suggest what should I do, please also give me some judgment ruling to fight to win
My lawyer says that lower courts don't consider part payment they are in habit of punishing the accused

my name is amit, my father disowned( bedhakal) me via news paper under influence of my step mom.
my question: Can father bedhakal me from both farming and housing property (ghar and gher) . The property is pure ancestral property as my great grandfather was a land lord of the village . can my father will the whole property to my step mom or his son,
the property is farming land of 20 bighas and a ghar and gher in village

In my case decree for possession of property is being passed in my favor ie the landlord but still tenant has not contacted when he will be giving possession. In how many days can he appeal or i can file for execution and Execution will take how much time.

Sir, I am working in a PSU and want to apply for tatkal passport to dependents i.e. spouse and two minor sons. I applied for NOC of passport to my department and they issued NOC in prescribed format with attestation of my photo in it.
When I approached RPO Bikaji Cama Place, they require Annexure B with photo of my spouse and sons for their passports. But my department says that they have no any such instruction to issue certificate with the photo attestation of my wife and sons.
Please clarify whether there is any circular regarding the same.

my husband had filed a divorce petition in 2010.i have also filed for the same but with a permanent alimony/settltment.at present i am geting rs.10000 as im. i don't have any documents regarding his ancestrol property details to prove he is well off is there any documents equivalent to the property details.please help
