my mother was not entered in any agreement before die. but some person forged the signature of my mother and executed a gpa and sale half of the property.i want to canceelled the gpa for which how much i have to pay court fee

498a closure after quashing in bihar


Dear Sir,

I filed divorce case in Delhi which eventually transferred to wife's hometown Khagaria Bihar. She also files 498a against whole family along with other IPC 323, 341, 406, 313, 315 of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act.

Eventually on the ground of mutual agreement Patna high court quashed the case in last yer June for me. For my relatives HC quashed the case last month. we paid money for full settlement before the quashing. Now i have two query:

1) What is the procedure to close the case in lower court? I can see the lower (CJM) court is still has date (for appearance) next month.

2) What is the process in Bihar to get divorce on this basis. Mutual agreement also mentioned that both party (i and wife) will part their ways and get divorce from family court. No party has to do anything with other. Can she ask for more money in family court for divorce?

Indian succession act - about will and gift

Dear Experts,
i wish to know about a real life doubt which i have come across in relation to property to be handed over to me by my father:
Q1 - when the immovable property is bequeathed to me in the WILL by my father, what would be the status of the property as far as i am concerned..Will such property which i will get be called as Ancestral property or the property i have acquired during my life time?
Q2 - Whether i will have right to bequeath it to my successors or my brother or sister as per my wish or It will get devolved to
my only son as per the Act as my successor?

Q3 - If the same property instead of bequeathing on me through the WILL, is transferred to me by way of GIFT as per the Act, then after getting it, will it be called as property gained by me or still it will be called as an ancestral property. Whether i have right to give such property to any other person of my choice in addition to my own son or not?

Marriage

Sir I'm a muslim boy (22yrs) and i am in a relationship with a Hindu girl (17yrs) and 1st July is her birthday and she will became 18 in this July. my parents are agree with me but the girls family is preparing for her marriage after knowing that she is in a relationship with me so she have to eloped from her house so can I marry her this 2nd July ??? I'm very confused about the age. is she have to cross 18 years or she can be with me from the starting day of 18 years
(Really sorry for the English actually i was in Spain from when I was just 5 to 18) know Spanish

Respected Experts

I got married on october 15th, 2010. Its an arranged marriage. The marriage between her and me not consummated due to unwillingness of her. Every day and night she stayed along with me used to state different kind of reasons for her unwillingness and she also used to say that marriage has been got done by force of her parents. Ultimately she left the matrimonial life with in 15 days of the marriage i.e. on October 31, 2010 and never returned back.

I issued a lawyer notice her to return back and join the conjugal life but never returned back.

I filed u/s 12 1(a) HMA that marriage was not consummated due to impotence of respondent.

Now my problem is, though I have filed u/s 12 1 (a), I havent got any medical reports of about her to prove the impotence. I stated in my petition that impotence may be curable , not curable, permenant or temporary.

I also stated in my petition that respondent may be suffering at the time of 15days where she stayed along with me, may be suffering with temporary or curable impotence.

Now please state me whether my kind of approach to court is in right way or not.

Divorce by mutual consent in case of schizophrenia

I got married to my uncles daughter 16years ago in 1999.we have a daughter who is 13 years old now.my wife was diagnosed with schizophrenia in 2008 and she is under treatment since then.we are living together in our house along with my daughter.my parents live separately.my wife has refused to take medicines for the last 9months citing side effects of the medication.I have tried my level best to convince her but she has refused to take the medicines.the doctors at the government hospital for mental care have stressed that medication should not be stopped as schizophrenia could worsen.despite her illness my wife manages household chores but is unable to maintain good relations with her family or with me and my daughter.she has refused to cooperate in giving me sexual pleasure.my constant pestering to get her to take medication has resulted in a lot of arguments as she has suffered a relapse of the disease.our relationship has suffered due to the disease and now she wants to separate from me.she wants a divorce.I tried to take help of in-laws but they too were helpless.now they have distanced themselves from us.my wife gave a complaint of domestic violence against me in 2010which was not acted upon as I had produced the medical reports.I would like to know if I can opt for divorce by mutual consent in this case.my wife wants a flat to live which I have arranged and 10k for her monthly expenses.my daughter doesn't want to go and live with her mother.she wants to stay with me.I fear that after all this my in laws would file a 498a case against me and destroy my career.I don't want to mention about psychiatric illness and go for mutual consent divorce as my wife too is willing.can I opt for MCD.How can I protect myself from my in-laws in the future.they have recorded phone calls to trouble me in the future.please advise.my email is veeramallur@yahoo.com

Execution petition

Hi,
We obtained a decree, ex-parte, for around Rs.3 crores...I have the following questions regarding EP:
1) Can we have both movable and immovable properties in one EP?

2) What will happen to the attached properties in EP, if JD goes for (successful) appeal or set aside petition? Can the JD dispose the attached properties after this?

3) JD has one proprietary/partnership firm under which there are some courier franchises. How do we include this into EP? That is, can we include the income or just offices or the franchises (which may be at the discretion of the courier) or all ?

4)In general, how long it takes for the EP to complete?

Also appreciate if you could point to the sample EP.
