Relinquishment of shares

Dear Sir,

My father had nominated myself and my brother in a flat he owned in Mumbai. After my fathers death, society transferred the shares in the name of my brother and myself on the basis of my fathers nomination.

Now I want to relinquish my 50% shares in the name of my brother. The society says, I have to give an Affidavit to that effect. Besides my wife, I have one son aged 18 and daughter aged 14.

Please advise me on the format of the Affidavit to be given to the society.

Your advise on the matter is appreciated.

Manhani case

Dear sir,
can I file the Manhani case Against 34 persons(including male and female)who have complain against me to my higher officer.What is the time limit in which i can file manhani case.Please guide us.



I am employed in polytechnic college.Investigation has already done.No result of investigation.I was assigned the charge of Head of Department.Now With reference of the letter came from higher authority principal of college give me office order in which my HOD charge given to ELECTRONICS DEPARTMENT HOD.I am from IT department.In IT department I am the Seniour Most.Complain Details are following below:
1)They have told as i belong to uppar caste i always trouble lower caste people in my department and college.
2)They told that I am of Business mentality and that's why every work of renumeration is given to me by principal.
3)my behaviour is not good and i am treating others in my department as servant and consider myself as "MALAK".
4)Principal of college always give work to me by passing the seniour people.
5)I am not taking the lectures and upto 6 hours i am sitting With the principal.
6)I also told the others in the college that I am Assistant Principal.
7)I trouble to students also.
8)we have already informs to principal orally and in writing many times about LUCKYKUMAR AGRAWAL but principal is ignoring.

These are all the points which are mention in my complaint.My good relations with principal are the major cause of these complaint.

Payment of gratuity

Myself Dilip Balvant Kulkarni joined in Mitcon Consultancy & Engg. Services, Pune as Sr. Vice President on 7th Sept. 2006.
My date of birth is 18th Dec. 1952.
As per the service conditions date of superannuation is on completion of age of 58. In my case it would have been 18th Dec. 2010. However , Mitcon management extended my services beyond the date of super annuation and I retired from the service as at the close of business on 31st March 2015.
I completed total continuous service of 8 years 6 months and 24 days as on date of my retirement i.e. 31st March 2015.
However, I was denied payment of gratuity on the that I have not completed minimum five years of service as on date of super annuation i.e. 18th Dec. 2010, though my services were extended by the Mitcon management upto 31st March 2015.

Please advise me
1. Whether I am eligible for gratuity considering my total service upto 31st March 2015 ( 8 years 6 months & 24 days)including extension in service.
2. I am eligible , what period will be considered for calculation of gratuity.

False case of molestation

We are living in a joint property having dispute with my husband's cousin . last week we were installing a meter in our common passage ON OUR SIDE OF THE WALL and my husbands bhahbi enetered forcibly in our gate and tried to disrupt the work.My husband pushed her out of the gate and then her son came and attacked my husband.They have filed police complaint and we have also filed police complaint Now they are pressurising the police to register a molestation case under 354 on my husband.We are greatly worried , my questions are is it bailable , when should we apply for bail , can anticipatory bail be granted . The police are not telling us much only that there is pressure on them .PLEASE HELP US.

Clarification on a gifted property

Hello Sir,

The case which I am going to share is a peculiar one.

Background - My mother-in-law bought a property for Rs. 24,000/- in 1971 from the money given by her father and the property was registered on my father-in-law's name.....however, they had a happy married life with 6 children.

As the years passed, my mother-in-law got to know that her husband had an illicit relationship and with family involvement, they had many meetings but, it did not work. Hence, my mother-in-law had to walk out in his life with her children.

But, all the children had contacts with their father and they would visit him very often (He would stay in the same property...part of the portions were rented out for a petty shop and a small hotel). The father would always mention to his children until his last breath that he s staying in their mother's house....so, everyone was under the impression that they will get their mother's property back.

Last year, my father-in-law passed away, and we also got to know that he has gifted the property to his second's wife daughter (they are 4 children). It was a shocking for my mother-in-law and her children. With this regard, we consulted a couple of advocates to seek their advice, but everyone said that nothing can be done as its been gifted to her and they asked us to keep in touch with her. But, both the families do not have contacts with each other.

Can you please advice?

Emancipation law

i am 22(f), the only daughter of my parents, my father has not been providing m my mother and me with financial support since they got married. My mother has been a victim of domestic violence since the time she got married, it finally stopped when i turned 6-7 years. but when i turned 14 my father has been mercilessly beating me up, he has tied me up my hands and mouth as well and has beaten me up. he has even kicked me in my private area. I want to know what i can do legally about it. also, can i claim maintenance.?

Bank charged penal interest

sir,

i am a small businessmen,
and is working in scrap business

I took a bank Loan from a concerned bank,which included the terms that

you r not supposed to operate with other bank except the concernced bank Account from were i took the loan

i had an bank to be dealt for my inter bank transactions.
the bank noticed from my balance sheet that

i had some other bank besides the concerned bank

so they charged me the penal interest @ 2percent on loan account

pls help me to deal it for refund

I want to take a MHADA property which is 2 years old. What all documents needs to be verified before considering this proposal? As I need to be quite sure that the property will only belong to me and no one else can claim once I purchased the flat.

Taking back 498a case

Hello,
I filed 498a case against my husband and his family. But now we both want to stay together and I want to take case back however police has not submitted charges heat. And main query is my husband's lawyer is saying you need to file divorce case then only I can take all case back. However what I heard is I can compromise in front of judge and take case back. Please help me out my hubby is already depressed don't want to give him more tension
