What law should be applicable

sir in case plaintiff has filed a case against defendant that locker no 341 should not be opened by the defendant that is he filed a injuction suit but aftr 4 days of filing of plaint thye defendant break open the locker now under what law should defendant make a written statement? should he filed a written statement under sec 151 and if yes why? and if no then which sec should he envocke

Tendering additional documents in 340 crpc case

Sir,
We have filed the application u/s 340 crpc in Civil suit and court has given date for the evidence..we have annexed documenst with the Application/Complaint but some documents were left and could not be placed on records

Now at the time of leading evidences, can we tendered those documents by requesting the judge/magistrate to place it on records..or we have to move an application for placing the documents on records??

Property Rights of a Child from her Mother

Hi, My mom and dad got separated around 15 years ago, and ever since I and my sister had been living with my dad until he passed away in 2010. My dad was a retired govt employee and was a pensioner, my mom has been a govt employee too so the pension rights were ideally reserved for us and we even withdrew the pension as per legal terms. My mom has her own house and her savings which she doesn't want us to be a part of, so I just want to know what rights do the children hold for the property of their mother. FYI, she has been staying with her sister and her sister doesn't have any source of income other than my mom. She doesn't want us to be in talking terms with my mom and we even feel that she has been keeping my mom on some suspicious medication because of which my mom doesn't behave normally and says whatever she asks. My mom even met with a severe accident and she had a brain injury, hence a little damage to it. We want to file a case against my mom's sister. Please guide.

Things to be mentioned in a house sale deed?

Hi,

I am new to the forum. I am about to finalise a flat near chengalpattu, chennai and give advance. Its a new flat built by Acc foundations.They have all the papers and approval in place.However they say for a new flat only the UDS can be registered (which is fine), but the flat details like flat number (F1,T2,B3) will not appear in the sale deed and also the flat area in sqft will not appear in the sale deed for first sale.These will be part of the construction agreement between the builder and the buyer (construction agreement is not a govt registered document).Is this fine. Is this the way all builders do.Can you please help me in this ASAP.Thanks in advance.

If this is the way then what is the proof that so and so number flat for e.g T8 belongs to me.

Hello sir meri knowledge ke bina hi bihar ma divorce le liya hai...jabki mera divorce ka case delhi ma chal rha hai...or uske baad marriage bhi kar li hai or ab usko us marriage se ek beta bhi hai....ma kya kar sakti hu pls advise

Business name

Respected Experts,

I am running a sole proprietorship business & also running such for last 5 yrs. but i do not have any website.

now i am finding a co. probably incorporated in England is running their business by the same name & that is a limited co.

In India No such named co or llp or website exist & also no trade mark i have found in that name.
so now what i can do - because in future it may create problem in our expansion.

Position of the land after the sale deed.

i have bought 3 arces of land in 2013. The land owner are not giving me land position. they are saying we need to survey the land first and give you the position. they are doing the same thing from Aug 2013 the day i got registered from them. even today they are saying the same thing. (need to do the survey)

q1 how should i get me position as per the sale deed.?
q2.in my sale deed it is very clearly the land sketch of the land is give with the dimension?

Man have a two wife. First wife have a one daughter that daughter have a one son his age is 57 right now. And the second wife have a two sons and three daughter the last daughter age is now 67.now the matter the man buy one land in1944. Who is the right person to get that land

Registered will - query & clarification

Dear All,

My mother has 2 children and she has made a registered will in sub-registered office in the name of my younger brother and myself equally. This is her self-earned house and not ancestor property. She has mentioned a sentence in the registered will that "this would be the final & last will". Is there any possibility that she can cancel this current will and re-register a new will or gift deed without my consent in the name of my brother. Can she do it without my signature or NOC from my side. from the point of legal, is there any compulsion that they may ask for NOC or signature from me before doing any new gift deed or will. Will the new one stand valid if so they did without my concern..request you to confirm on the same.
