Regarding Resignation under probation period

Dear Sir

I have joined a company on April1 2015 and due to my Health problem I cannot continue to work there...I have told my problem to the GM of company on 6July 15 and he start to threaten me and I have to pay of rupees 50k-my 3month salary +penalty. I PUT MY Resignation mail next day...The HR of the company replied me that I have to come to office and give reason or They will take legal action. IN my letter of invitation they have not mentioned anything like this...in the LOI they mentioned probation period 6month and notice period 45 days...If I leave under my 6month probation..can they take action??pls reply

Valid Adoption

Respected Sir, recently I have gone through old documents and learned that my father was adopted in 1946. Adoption was registered in sub-registers office with index. At the time of adoption, age of my father was 7 years. Hence, he was unknown about that. When he saw the documents regarding adoption, he shocked. In 1972 heir from adopted father's brothers daughters were stood and� became owner of the property. My question is that can my father claim the right of heir? Because as per tenancy act, adoption could not cancelled in any how condition. Next, in 1972 my father was 33 years. Can his adopting mother has legal right of distribution of property or again to stand new heir? Waiting for reply. Thank you. Somnath

One time Settlement Educational loan

Hi. I am making an enquiry for my husband. He has acquired a UG Engineering loan and later acquired a PG loan for studying abroad from a nationalised bank. We have been making apt repayments for the past 3 years and have a good payer history. Our total loan was around 18L and currently our pending loan amount is 14L. In the past 3 years i have made around 10L as repayment inclusive of interest. I would like to make a one time settlement to reduce the unwanted over heads. Can i have some good advice on proceeding with this?

Documents with registration department

My flat documents are with the registration department since 1998. We have paid the registration dues. Stamp duty is pending. How do I get my documents back and what is the procedure to pay stamp duty and how much penalties will get attracted.

Query on section 14 of divorce act

Section 14 of the divorce act states that Power to Court to pronounce decree for dissolving marriage. —In case the Court is satisfied on the evidence that the case of the petitioner has been proved, and does not find that the petitioner has been in any manner accessory to, or conniving at, the going through of the said form of marriage, also
Provided that the Court shall not be bound to pronounce such decree if it finds that the petitioner has, during the marriage, been guilty of adultery, or if the petitioner has, in the opinion of the Court, been guilty of unreasonable delay in presenting or prosecuting such petition, or of cruelty towards the other party to the marriage

1. What does it mean accessory to, or conniving at, the going through of the said form of marriage? Does it mean that the if the wife has instigated the husband towards hitting her because of her irritating behaviour court will not grant divorce? Or that if the wife knew about the husbands temper and alcoholism before marriage and still married him no divorce will be granted?

2. What does it mean court is not bound to pronounce the decree if the petitioner has been guilty of cruelty towards the other party of marriage?There are several instances of my wife's cruelty towards me? Does it mean I can ask court not to grant divorce as she is also guilty of cruelty?

Lost original documents

I got a property I had given cheque to the seller so he insisted that he keeps the mother deed and kept my orginal deed till the cheque is cleared.He returned me the papers back after the cheque was cleared.
I learned from my friends that there can be a misuse of the documents in such cases.He can even replace the original document with a duplicate one.
What can I do to prevent any misuse of my document?

maintenance for child born out of first wedlock

Hi Ld experts,

I would like to know the legal standpoint for the below marriage issues:

Both husband and wife are divorcee and remarried. Wife has a girl daughter born out of first Wed lock, court has granted custody rights.

Second marriage done 11 months back, now again the husband and wife are going through the rough patch due to misunderstanding and has filed a maintenance case U/S CRPC 125. Wife is working in corporate earning 40k month, she has claimed maintenance for herself and daughter.

In the above scenario would the second husband responsible for maintenance of the daughter? As she was born out of the wedlock of first marriage, what defensive options we have to take care of the situation.

Hello Seniors,

I am complainant in my this N I Act matter 313 & 2 witnesses are already done and very near to completion, now advocate for accused is pressing matter for transfer as per 15 June 2015 ordinances but he has not done any written application.

My query is on this stage will my matter get transfer as per new ordinance?

Divorse

Hi..We had married before 3 years love cum arrange, our marriage not registered.

After 1.5 years of married life, many times she has fight with me and tried to pull matter up to sepration. One day without telling anything she went to her Father home and then from their told she will not come back.
Even if we tried to make her and her family to understand but they said we want divorse only.
Because of her and her family pressure, i have to take mutual consent divorse before 1 year by making Sepration Document which was on Rs.100 Stamp paper and notarised. We have given all their things, gold, money etc.return back. Everything is metioned in Divorse Agreement that it is mutually and everything of her given back, waivr of Maintenance money etc. and on that her and her father and mine and my father sign was there.We thought that Divorse Procedure over as marriage was not registered.

But after 1 year of divorse when i am planning for remarriage, we came to know about Decree to be obtain.

When we approach them , they are asking adhoc heavy amount of money to sign Mutual Divorse for Decree.

I dont want to delay remarriage.Now what should i do ?

1) Should i give them sum money to sign mutual divorse ? or

2) Should i remarriage without applying for Divorse as Notarised Divorse Agreement is there with me of before 1 year.

3) Should I file Petition for Divorse in Court ? If i file, whether curt can order for maintenance money to her and how much it can be ? she is also working and earning around Rs.12000 p.m. , I am earning Rs. 50,000 p.m.
Divorse happens because she wants , why should i pay anything after 1 year again. ?

Please advice..
