Kindly provide list of notified centre for equitable morthage in Maharashtra as I m unable to find the same on google.

Disput in property

Hi,

I receive property from my Nanaji (father in law) he transferred all his property on my individual self (Farming property ). Later on i transferred half of the property to my younger brother. Now my younger brother has built a house on the property which is on my own name after demolish my fathers house where we lived jointly. my father is no more and i lived in some other place and now when i go to build my house on the property which is on my name my younger brother is denying to give the property of me and are claiming some more property from me.

Important Note :- I am not living on the property from last 20 Year but i occasionally visit there.
My brothers family have been using my property for farming after taking my verbal permission.

My question is :-

Can i claim a stay on the house they have buildup on my property ?
Can they claim some more property from us ?
Will this property consider as my self acquired property ?

Kindly suggest.

Jurisdiction u/s.452 companies act 2013

Company in Mumbai wants to file a prosecution under section 452 of the Companies Act against its employee. In which Court should it be filed? Metropolitan Magistrate or Sessions Court? Is there any case law?

Land property transfer

My sister-in-law and my wife jointly own a plot in Hosur, Tamil Nadu and they would now like to transfer the same in the name of my son who is 21 years old.

Kindly advice on the best way to transfer this to my son's name so that there is no legal or taxation issues for my son later.

status of property owned by partnership firm

Sir in this case their were 4 partners of a partnership firm in which 2 partners retired from partnership firm in 1980 That firm is working till date & is not disolved ...in 1981 the retired partners sue the remaining partners for having share in the property of firm what will be the status of property of firm now.....sir the firm is working till date & have not be dissolve.... Please provide proper guidance in above said subject matter.

सम्मानीय,
व्यवहारी जो कि एक पंजीकृत संविदाकार है, ने जोधपुर विधुत वितरण निगम लिमिटेड द्वारा अवार्ड की गई टर्नकी संकर्म संविदा के मामले मे अवार्डर (जो. वि. वि. नि. लि.) को मूपक बीजक के प्रति माल की आपूर्ति की संविदा की है, जिसके लिए व्यवहारी को अवार्डर द्वारा जो वर्क आर्डर जारी किया गया है उस पर वर्क आर्डर फॉर सप्लाई ऑफ़ मटेरियल अंकित किया गया है !

व्यावहारी द्वारा संविदा की पालना मे वित्त वर्ष 2014-2015 मे आंशिक आपूर्ति की जा चुकी है ! अवार्डर से भुगतान प्राप्त करने की श्रृंखला मे भुगतान में से अवार्डर द्वारा की जाने वाली संभावित कटौतियों के सन्दर्भ में पूर्व में श्रीमान सहायक आयुक्त महोदय झुंझुनू से भी दिशा निर्देश यथा मार्गदर्शन के निमित व्यक्तिशः और लिखित प्रार्थना की है, किन्तु श्रीमान जी के द्वारा इस विषय में दिशा निर्देश आप सम्मानीय से प्राप्त किये जाने के प्रावधान होने की सूचना प्रेषित की हे !


अतः आपश्री से प्रार्थना है की कृपया निचे वर्णित बिन्दुओ पर कानून के प्रावधानों को स्पष्ट करवाने की कृपा करे :-

1. उक्त आपूर्ति पर कर (वेट) की दर क्या होगी !
2. उक्त आपूर्ति पर TDS (WCT) की क्या स्थिति होगी !
3. व्यवहारी दवारा उक्त आपूर्ति को संपूरित करने की श्रृंखला मे राजस्थान राज्य के पंजीकृत व्यवहारियो से जो खरीद की गयी है उस पर चुकाई गयी VAT INPUT का भराव एवं रिफंड की क्या स्थति होगी !

Safaesi act, 2002

A person X borrowed loan in the year 2006 mortgaging a plot of land over which he had no possession. X filed a title suit in the year 2008 against Y who had the possession of land. X filed the case for declaration of right title interest and for eviction of Y. In the year 2014 bank evicted Y for non payment of loan by X. After 40 days X paid all the loan and keys of Y's house given to him by the bank. Y approached high court wherein he was asked to go to DRT. DRT says everything is done as per SARFAESI act so there is no wrong in the action of bank. Y again approach high court his petition was again rejected and he was asked to go to civil court. Is civil court proper place for Y?

Property division by father

My Father has asked me to leave the house( which was built by him), by taking 1/3rd share. We were 2 brothers & 3 sisters ( all married) , 1 sister and 1 brother passed away in the last 3 years. Earlier my father sold the ancestral property and divided the property shares among his brother. I never received any share from this property.

I have been living with my family and my parents at the present residence for the past 30 years. I have provided for all expenses and taken care of my parents over all these years.
2 years back my elder brother died, and my parents want to shift with my nephew in another city. They have more affection towards him.

Presently I am pressurized to leave the house by taking 1/3rd share of the house value. I am not ready for this separation, and I also feel this division is not proper. Also I don't have any other house, immediately to occupy.

Is there any way, that my father could sell this house to other person, without giving me any share. Or in case if they go to court, what would be the result out of it.
Can my son have any claim on his grandfathers property. We are a Hindu family.

Consumer complaint

I have purchased Intex Tablet including mobile in year 2013 which was under warranty for one year. During December 2014 Intex Tablet stopped working and I submitted for repairs at Intex authorised dealer and they told that its battery needs replacement which I agreed to replace the battery on payment. Now almost more than five months have passed but Intex authorised dealer is unable to replace the battery due to non availability in stock. Ultimately the Intex tablet is of no use without the battery as it cannot be operate even on power. This tantamounts to unfair trade practice as Intex company is not able to provide sales after service which is claimed by Intex Co. usually while selling their products. Kindly advice me that can I file consumer case against Intex Company for not providing battery of Tablet even on payment as without battery tablet is of no use.

Filing charge sheet

if a charge sheet is filed in the court but charges not framed. the accused has got proceeding stayed from high court while challenging charge sheet. The matter pending before high court through criminal application u/s 482 CrPC.
In such circumstances can the accused person legally called guilty?
