Reg- injunction and eviction

Dear Sir,
I own an independent house in madurai which i had let out 8 years back. The tenant who is a lady became a ruling party counsellor afterwards. She has not been paying the rent on time, she pays only once in two or three months, moreover she has also not been maintaining the house proper, she has made some tent and erections in the premises of the house for party office without our knowledge, so i had asked her many times to vacate the house but she has not till now. last month i had warned her orally to vacate immediate otherwise to face legal action. but i dnt take any legal action against her till now. but she has approached the court and filed injunction suit against me. Now what should i do now? Shall i file an eviction suit against her? Is she trying to drag the issue and prolong her stay? How can the court support this inspite of the fact that she deserves to be evicted? My lawyer says she can be easily evicted but i am afraid whether the case will drag, and she will continue there, and whether the lawyers will exploit me by taking maximum from me dragging the case. Pl advise

False 498a case in fasttrack court

Dear Experts
My wife had filed a false 498a case against me, chargesheet was filed and the first hearing date was in SEP 15. Now I got summons from fasttrack court, so I came to know that she has moved the case to fasttrack court. I did few quick searches on google and came to know that FT courts verdicts can be made on incomplete information/arguments, so I am worried. I have following questions -

1. How did court allow her to move the case to fasttrack, even before the first hearing?

2. Can I apply for moving the case back to normal sessions court, if I feel later that the FT court is not listening enough to my arguments?

3. How long it will take for the case to be disposed off by the FT court?

4. What is the general gap between 2 dates of a FT court? This is because my job is outside India, and although I dont have to be present for each date, I want to be present personally for each date. I also want speedy justice.

Thank you

To vacant the shop which is rented since 1986/1987

A shop in West Bengal was given on rent by my late grandfather in around 1986/1987 without any kind of AGREEMENT. We only have a hand written letter with the tenant signature that the room has been given on rent. The tenant has regularly and promptly paying the rent though much less compared to the valuation. He owned another shop nearby recently, and refused to increase the rent of our room. He even threatens to give the rent to Rent Control.
We have also offered compensation to vacate the shop, but he is demanding money in advance with 3 months’ time.
Question is can a tenant directly go and pay the rent to rent control when the landlord has not refused to accept the rent? Secondly, after getting the possession of own shop, does not he bound by law to vacate our room. We are on the upper hand on his point. Can we ask the court to lock the room till any judgement has been passed?
Please reply as soon as possible.
