In a Suit consisting a Plaintiff private party and two Govt Departments as respondents. One of the Govt Dept chose to be Ex Parte and accordingly was set exparte.
In a call for records / documents petition involving the Exparte Govt. Dept. The petition was allowed by the Court and the Respondents did not file counter.
Now after the warrant for call for records is issued they say that the said information is not available.
Moreover the Judge/Presiding officer was transferred to another court and the New Judge / Presiding Officer could not understand a single thing. This new Judge says he wants to give a hearing to this again. What does this mean?
A petition that has already been allowed by the court how it can be heard again that to with a Defendant that chose to be exparte?
Is the action of Govt Dept correct in denying information without filing a counter?
Please Justify the action of the Presiding Officer and the Govt Dept.

we have a farm which we have eeceived in inheritance after death of father .now while in mutation in all we were 6 members .name of two (child at that time) were left out with some request with sarpanch and due to that my share is wrongly entered as 1/4instead of 1/6.i have come to know recently as I was not member to those proceeding and staying out of village .now for corrections I have to make lot of efforts in tehsil etc and incur expenses ,if I want sale of my share etc.and I do not want wrong share at all as in future any action can be taken.can I take criminal action for such wrong entry in my name without my consent under section 415 467 etc ipc,for wrong records and putting me in trouble for corrections etc. though my share is entered higher but I do not want that type of wrong mutation.

A awarded a contract to B to take parcels in his trains from X to Y for a period of three years. After completion of the said contract period B asked for a extension for two years. Hence, extension for two years was granted by A to B. During the period of extension of two years B was found indulged in the practice of overloading. A terminated the contract of B. A After conducting an enquiry of the same it was found that overloading was not done by B. A took 50 days to found out that the overloading is not done by B and there was a wrongfull termination of contract.
Now B is seeking a claim of Rs. 1,000,00/- from A as a loss of profit which he has to earn from the parcel services if his contract was not terminated.
Can this be defended in arbitration & his claim can be set a side or A has to provide the compensation.

    I purchased a plot in Akola from landlord ( S) .previously to sale agreement, Land lord's relative filed sivil suit for their claim. It's wone by land lord (S) on the basis of resjudicata rules. There is no stay up till now.Again landlord's relative gone in appeal. Is there any problem for me?.

I have a query
we have inherited land inour joint "khata"ie undevided name of 2 brother 2 sisters and wido mother in records .now I want to release my share in favour of my one sister only and my mother want to release in favour of my one brother only .whether consent of all is necessary or any body can do as per choicefor releasing .if release is posiible by choice then no need of sale or gift in family land and we can avoid stamp implications, or release means renounce only without choice. And such type of document like release is not mentioned in transfer of property act.still how title is transferred by release.

Sir my marriage date is 9/12/12. After the 1 and a half year of my marriage my FIL came to my house in my absence and took my wife and her complete stridhan and her all other things in front of my land lord after that my wife filed a case under sec 323, 342,504,384,307,294 dated 8/7/14 against me after that my FIL filed a dowry case against me my parents and my younger brother dated 8/9/14 then my wife files a dv case against me dated 23/10/14 now she filed a divorce dated 31/3/15
In first case I got a FR by police in second case they filed a chargesheet against me after bail from hc in third dv case my wife got interim maintenance of 2500 rs. Per month from the date of application now what to do because they did lots of mistakes in their cases the biggest one is they living in jodhpur Rajasthan since 15 years and the marriage ceremony held in jaipur but they made jurisdiction of alwar Rajasthan because they were living their before year of 2000 what should I do plz tell me

Sir mere papa ki 2 wife hai 1st wali ki deth ho gae..or second wali jo meri mummy hi wo jinda hai but papa mummy ko ghr se nikal diya hai 1st wife ki do ladkiye hai n meri ek bhen hai papa sab se nafrat karte hai bas mjhe acha rakhte hai papa unkri government job hai... or ek mkan hai 1 crore ka or kuch bank balance hoga kitna hai wo nhi pta.....so sir mere papa ki tabyat bhi kharab rehti hai or wo akele hai koi unse milne nhi aata koi ladkiye unki nhi aati milne unse

Property registration against hiba
Sir,
My Mother gifted our parental house(in my mother name) to two brother under oral HIBA documents.
I have the few question
1. Can I register my portion of house from these papers
2. Does it require signature of my brother and mother for registration
3. This property comes in urban area of UP
3. Any other suggesation from your side.
