Applicability of labour law to ngos

If certain NGO has secured exemption from Labor Law from a certain High Court and this is overturned by another High Court after a number of years, is the NGO concerned justified in going on producing the earlier HC order of exemption for securing the same benefits?

Service tax on maintanance charges collected by rwa from its members.

1. What was the implication of service tax on maintenance charges collected prior to 2012? When negative list was introduced in July 2012, many experts started discussing and advising societies to take registration numbers. This brought us to the presumption that no service tax was applicable to societies prior to that. So what was the exact position prior to that or what was the exact change that was brought in which made the experts start discussing about it so seriously?
2. After 2012 it was notified that if per month per member contribution of any or some members of a RWA exceeds five thousand rupees, the entire contribution of such members whose per month contribution exceeds five thousand rupees would be charged service tax. But in January 2015, there was an appeal filed with CESTAT and the tribunal delivered a judgement based on the principle of mutuality stating that there is no service tax liability. And thus news started flashing that no service tax is chargeable on maintenance charges by any of the co-operative societies in Maharashtra. What is the legal stand thereof as on today?

Modification in the sra survey list

Hello all,

I have a room in a chawl situated in Byculla region. It has gone under redevelopment plan through SRA scheme. The initial survey is held by SRA (with my father's name)and the list of eligible candidates is forwarded to BMC for photopass issuance.
Now there is a problem in photopass issuance to my father due to lack of voterID card on his name, whereas my mother is having all the documents required for eligibility. So could you please suggest us that is there any possibility of replacing name of my father by my mother's name in the SRA survey itself at this stage? i.e. showing my mother as the landlady so that the photopass can be issued on her name.

Thanks in advance.

Cheated by an insurance comoany

Hello sir/Madam,

I got call from a firm named MAXPRO(Tambaram) that i got free medical claim for one year. When we went to claim it they introduced a general policy for 17 years term in the company AEGON Religare Life Insurance. They brain washed us about the policy and after verifying about the aegon religare if its legitimate we have opted for the policy.i invested my pension amount in it sir.We paid the premium amount also to that agency. But even after the verification calls we did not get login information from the company. following up with that maxpro took place for two months but of no use.after 3rd month the company itself wasn't there.we found its head office at arumbakkam after a deliberate search and we contacted the agency manager. They dragged us now more than 8 months and we did not get login details. We asked our money back but they said we cant return and instead we will put insurance in some other company named future general. But no progress in that also.we travel daily 80 km to get their update.but no use. Please help us and show us the way to get our money back sir and guide us how to proceed legally. your timely help is much appreciated.Thank you.

Writing a will

I am a doctor. Married twice. Got 2 sons through my first wife who lived with me for only 7 years, who for a silly quarrel comitted suicide leaving behind a 5 year old son and 1 year old son.The way she ended her life left lot of scars both mentally and physically in me .Later I got remarried and got a son through my second wife who had literally healed all my earlier scars.
Now I have brought up all my sons with the help of my second wife and made all of them doctors- postgraduates. I have also accumulated about 12 no of immovable properties. My Elder son had done my speciality and is likely to take care of my scan centre with all costly equipments and good will. I have constructed a small nursing home for my second and last sons who are likely to take it up but have to start from scratch. I have to support them for basic infrastructure.
Now in my will I have mentioned that both my Elder son and other two must share 20% of their nett income from practice with their parents in case of my disability or retirement from work, and with my wife after my period. While I have divided other properties equally, for the above mentioned commercial poperties I have given life time rights to my wife and absolute rights to my sons only after her life. I feel I have done a right thing. Will there be any legal lacuna or hitch? because I can not take my daughter in laws for granted. My third son is yet to be married. By the way all my properties are self aquired and only one is my father's.
